Chairman Glassman welcomed Kathleen Milner to the Board. 2. Approval of the minutes for the meeting of June 10, 1993 as submitted in writing. Case Hearings: Case No: Property Appealed Appellant 61-93-H 1334 Arcade Street Thomas Lindbeck (Single Family) SUBJECT: Appellant is appealing the orders to remove car parked in front of house. PROCEEDINGS: Testimony was presented by Thomas Lindbeck stating that the vehicle in the front of house is a piece of art and not a vehicle at all. A letter was presented to Mr. Lindbeck from one of his neighbors objecting to the vehicle being in the yard. This vehicle is a vintage car with his business name on the side of it. Don Juenemann, Housing Code Programs, testified regarding ordinances that this vehicle was served orders under. Discussion continued. Larry Zangs, Zoning Inspector, testified to the fact that zoning issues also exist on this property and it does not carry a Certificate of Occupancy. Pat Fish, Fire Prevention, testified with information regarding requirements to obtain a Certificate of Occupancy. BOARD ACTION: Motion was made by Glassman to grant an extension of time to October 10, 1993 to give Mr. Lindbeck time to explore all options in making the vehicle legal to be where it is. Seconded by Winter. Motion carried unanimously. 59-93-B 1835 St. Clair Avenue Thomas Reddy (Single Family Home) Lisa Kopp SUBJECT: Appellant is requesting a variance for an eight foot fence. PROCEEDINGS: Testimony was presented by Thomas Reddy. Discussion continued. Larry Zangs, Zoning, testified. BOARD ACTION: Motion was made by Winter to grant the variance for an eight foot fence. Seconded by Dunn. Motion carried unanimously. 63-93-R 160 Western Avenue South Dick Gilbertson (Multi Unit) Sharon Kluver SUBJECT: Appellant is appealing orders to disconnect the rainleader. J 2774890 Board of Appeals - July 8, 1993 Page: 3 PROCEEDINGS: Testimony was presented by Dick Gilbertson. Discussion ensued. Karl Johnson, Rainleader Program, also testified. There was much discussion on the cost and the area in which this building is located; also the time factor of the rainleader project. BOARD ACTION: Motion was made by Ankeny to grant an extension of time to July, 1996 for the back 13,000 feet (area drains and vacated banfil) to disconnect the rainleader or hook up to the new sewer system with the City. Seconded by Dunn. Motion carried unanimously. A tape malfunction took place at this point of the meeting. There is no recorded record from this point on. 41-93-F 300 4th Street Fast Kammie Hoyt, Manager (Multi Unit) SUBJECT: Appellant is appealing orders to discontinue use of manually operated flush bolt. PROCEEDINGS: Testimony was presented by Pat Fish, Fire Prevention, that this matter has been resolved. BOARD ACTION: None required. 62-93-F 516 Hunboldt Avenue Lynne Peterson, Manager (Multi Unit) SUBJECT: Appellant is appealing the order to install dead bolts on laundry room doors. PROCEEDINGS: Testimony was presented by Pat Fish, Fire Prevention. They have no problem with granting this variance. BOARD ACTION: Motion was made by Glassman to grant the variance for the laundry room doors not to have dead bolt locks. Seconded by Ankeny. Motion carried unanimously. 60-93-F 499-501 Grotto Street North Evan R. Williams (4-Plex) SUBJECT: Appellant is appealing orders to provide escape windows in apartment 2 of 499 and apartment 1 and 2 of 501. PROCEEDINGS: Appellant requested a carry over to the August 10, 1993 Board Meeting due to a conflict. //L5 2'774890 Board of Appeals - July 8, 1993 Page: 4 BOARD ACTION: No action required. 67-93-F 747 Iowa Avenue Fast Robert Johnson (Single Family Home) SUBJECT: Appellant is appealing orders to remove the incinerator from inside the dwelling. PROCEEDINGS: Testimony was presented by Robert and Marguerite Johnson claiming financial hardship to remove incinerator. Pat Fish, Fire Prevention, testified regarding ordinance regulations. Randy Nelson, neighbor, testified to the continuous usage of the incinerator. BOARD ACTION: Motion was made by Ankeny to deny the variance. The incinerator must be removed from inside the dwelling. Seconded by Dunn. Motion carried unanimously. 64-93-F 61 St. Albans Street South James P. Fritz (Multi Unit) SUBJECT: Appellant is appealing orders to provide smoke detectors in rear bedrooms off kitchens, provide 1" dead bolt locks where lacking, provide adequate number of electrical outlets throughout, remove all illegally installed lamp cord wiring throughout and provide GFCI outlets for all bathrooms. PROCEEDINGS: Testimony was presented by Mr. Fritz. Pat Fish, Fire Prevention also testified. Discussion ensued. BOARD ACTION: Motion was made by Ankeny to grant a variance on the dead bolt locks with the stipulation that they be replaced with 1" dead bolts when repair/replacement is needed; to deny the variance on the smoke detectors in rear rooms off kitchens; to grant an extension of time on all electrical to August 1, 1995. 65-93-F 1280 Grand Avenue Eugene Sitzman (Multi Unit) SUBJECT: Appellant is appealing orders to install 1" dead bolt locks on all apartment entry doors. PROCEEDINGS: Testimony was presented by Mike Keller. PROCEEDINGS: Testimony was presented by Mike Keller. Pat Fish, Fire Prevention, also testified. BOARD ACTION: Motion was made by Ankeny to grant the variance and allow the present dead bolt locks to be sufficient. Seconded by Weida. Motion carried unanimously. 4. The Board discussed the case for 208 Hoyt Avenue West and the request to be reheard due to appellants opinion that he was not properly notified to appear.
