1 RESOLVED, that upon the petition of Truth Hardware, designated Finance Department File
2 No. 19-1991, public properties hereinafter described are hereby vacated and discontinued as
3 public property; and, subject to the herein stated exceptions, the easements within those public
4 properties are hereby released.

7 The vacated area is described as follows:

9 The alley in Block 26, Kittson's Addition.

12 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1,
13 1981, of the Saint Paul Legislative Code as amended, and to the following conditions:

15 1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative
16 fee for this vacation which is due and payable within 60 days of the effective date of this
17 resolution.

19 2. That a permanent utility easement shall be retained within the vacated area to protect
20 the interest of Northern States Power Company.

22 3. That the petitioner's their successors, and assigns agree to indemnify, defend and save
23 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or
24 claims of any character brought as a result of injuries or damages received or sustained
25 by any person, persons, or property on account of this vacation or petitioner's use of this
26 property, including but not limited to a claim brought because of any act of omission,
27 neglect, or misconduct of said petitioner or because of any claims or liability arising from
2$ any violation of any law or regulation made in accordance with the law, whether by the
29 petitioner or any of their agents or employees

1 4. That the petitioner's their successors, and assigns, shall within 60 days of the effective
2 date of this resolution, file with the City Clerk an acceptance in writing of the conditions
3 of this resolution and shall within the period(s) specified in the terms and conditions of
4 this resolution, comply in all respects with these terms and conditions.
This vacation shall be subject to the following conditions:
