• Return copy to: Council File# 00-clog Real Estate Division Gc �5 �" °o , 140 City Hall Green Sheet# 10 4 cf q RESOLUTION CITY OF SAINT PAUL, MINNESOTA Presented By /.Si Referred To Committee: Date 1 BE IT RESOLVED, that, upon the petition of Donald and Doriene Callais, as documented in Finance 2 Department File Number 8-2000, public properties hereinafter described are hereby vacated and 3 discontinued as public property: and, subject to the herein stated exceptions, the easements within those 4 public properties are hereby released. 5 6 The property to be vacated is described as follows: 7 8 that part of the east-west alley in Block 14, Hayden Heights Addition lying westerly of a line 9 15.00 feet westerly of and parallel to the southerly extension of the east line of Lot 12, said Block 10 14, and northerly of a line 20.00 feet northerly of and parallel to the north line of Lot 18, said 11 Block 14 and the westerly extension thereof. 12 13 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the 14 Saint Paul Legislative Code as amended, and to the following conditions: 15 16 1. That the petitioner's, their successors and assigns shall pay$500.00 as an administrative fee for 17 this vacation which is due and payable within 60 days of the effective date of this resolution. 18 19 2. That a permanent utility easement shall be retained on, over, under and across the vacated area on 20 behalf of the City of Saint Paul, Department of Public Works to reserve the right of the City to 21 maintain and operate any sewer in or upon said easement and to enter upon said easement or any 22 portion thereof at any time and from time to time, for the purposes of future construction, 23 reconstruction, inspecting, maintaining or repairing the same or any part thereof. Said utility 24 easement shall be subject to the following conditions: 25 26 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any 27 other objects that will prohibit normal access to utility facilities for maintenance purposes 28 will be permitted within the easement area. 29 1 b. Improvements in or upon the above described easement that do not prohibit the City from 2 exercising its reserved rights may be allowed by obtaining written permission from the 3 Department of Public Works Sewer Division with the understanding that the restoration 4 and costs of such improvements shall be the sole responsibility of the petitioner, its 5 successors and assigns in the event the City exercises its reserved easement rights. 6 7 c. No change from the existing grade within the easement area will be permitted without 8 written permission from the Department of Public Works. 9 10 d. No change in surfacing within the easement area will be permitted without written 11 permission from the Department of Public Works. 12 13 e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless the 14 City of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or 15 claims which shall arise from any injuries or damages received or sustained by any break 16 in any service pipe or connection in said reserved easement arising out of or resulting 17 from any action or negligence of the petitioner, its employees, agents, or business 18 invitees. 19 20 3. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless 5 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character 6 brought as a result of injuries or damages received or sustained by any person, persons or 7 property on account of this vacation or petitioners' use of this property, including but not limited 8 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or 9 because of any claims or liability arising from any violation of any law or regulation made in 10 accordance with the law, whether by the petitioners or any of their agents or employees. 11 12 8.
