That the petitioner's, their successors and assigns shall pay$500.00 as an administrative fee for 16 this vacation which is due and payable within 60 days of the effective date of this resolution. 17 18 19 2. That upon the request of the Department of Saint Paul Public Works, the following conditions be 20 followed as a part of this vacation: 21 22 a) the petitioner shall be responsible for all cost associated with the removal of the existing street 23 lighting system and traffic signs within the vacated areas and street lighting west of Prosperity 24 will need to fed at a news location also at the petitioner's expense. 25 26 b) the petitioner shall be responsible for the proper abandonment of the existing 15" storm sewer, 27 8" sanitary sewer and related sewer structures within the vacated areas, to the satisfaction of the 28 Department of Public Works, Sewer Engineering Division. 29 30 c) the petitioner shall be responsible for the reconstruction of the west side of Barclay across the 31 alley and the reconstruction of the east side of Prosperity across Rose Avenue, which will be 32 necessary to properly eliminate the appearance of a Public thoroughfare, including, but not 33 limited to, costs for new curbs, sidewalks, boulevards, storm drains and signs, all to the 34 satisfaction of the Department of Public Works. 35 pp -40r 1 2 3. That at the request of the Saint Paul Department of Planning and Economic Development(PED), 21 the petitioner shall construct as part of their project, a ten foot wide pedestrian/bicycle path 22 between Barclay and Prosperity (a.k.a Phalen Blvd.) along the southern edge of their property to 23 replace the pedestrian/bicycle access along Rose that will be lost when said project is completed, 24 said path shall be constructed to both the satisfaction of PED and Department of Saint Paul 25 Public Works. 26 27 28 5. That with the accompanying Certificates of Intended Non-Use, filed voluntarily on behalf of The 29 Department of Public Works, made a part hereof by this reference and filed in the office of the 30 City Clerk of the City of Saint Paul as apart of this resolution, the City, for itself and on behalf of 31 said Public Works, waives the right to its utility easements in the property described in said 32 certificates, subject to any conditions outlined in said certificates. 33 34 35 6. That the Council of the City of Saint Paul hereby authorizes the proper City Officials to convey 43 any portions of the vacated property that was not originally platted as right of way, by 44 Quit Claim Deed, to the to the Petitioner; and that any expenses incurred as a result of this 45 conveyance shall be paid said petitioner. Not withstanding Chapter 130, codified March 15`, 1981, of the Saint Paul Legislative Code as 3 amended, the Petitioner and the City of Saint Paul agree that each party will be responsible for its 4 own acts and the results thereof to the extent authorized by law and shall not be responsible for 5 the act of any others and the results thereof. The Petitioner's liability shall be governed by the 6 provisions of the Minnesota Tort Claims Act, Minnesota Statutes, Section 3.736. 7 8 9 9.
