3 BE IT RESOLVED, that, upon the petition of State of Minnesota, as documented in Technology
4 Department File Number 2000-02, the public properties hereinafter described are hereby vacated and
5 discontinued as public property and are subject to the herein stated exceptions, further, the easements
6 rights mentioned in the executed Certificates of Intended Non-Use attached hereto are hereby released as
7 indicated.

9 The property to be vacated is described as follows: See Attached Exhibit "A"

12 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
13 Saint Paul Legislative Code as amended, and to the following conditions:
14
15 1. That the petitioner's, their successors and assigns shall pay$500.00 as an administrative fee for
16 this vacation which is due and payable within 60 days of the effective date of this resolution.

19 2. That upon the request of the Department of Saint Paul Public Works, the following conditions be
20 followed as a part of this vacation:
21
22 a) the petitioner shall be responsible for all cost associated with the removal of the existing street
23 lighting system and traffic signs within the vacated areas and street lighting west of Prosperity
24 will need to fed at a news location also at the petitioner's expense.
25
26 b) the petitioner shall be responsible for the proper abandonment of the existing 15" storm sewer,
27 8" sanitary sewer and related sewer structures within the vacated areas, to the satisfaction of the
28 Department of Public Works, Sewer Engineering Division.

30 c) the petitioner shall be responsible for the reconstruction of the west side of Barclay across the
31 alley and the reconstruction of the east side of Prosperity across Rose Avenue, which will be
32 necessary to properly eliminate the appearance of a Public thoroughfare, including, but not
33 limited to, costs for new curbs, sidewalks, boulevards, storm drains and signs, all to the
34 satisfaction of the Department of Public Works.

2 3. That with the accompanying Certificate of Intended Non-Use, filed voluntarily on behalf of the
3 Saint Paul Regional Water Services (SPRWS) made a part hereof by this reference and filed in
4 the office of the City Clerk of the City of Saint Paul as apart of this resolution, the City, for itself
5 and on behalf of said SPRWS, waives the right to its utility easements in the property described
6 in said certificates, subject to following conditions outlined here and in said certificate:

8 a) the petitioner shall be responsible for the proper abandonment of the existing water main
9 and any appurtenances within the vacated areas, to the satisfaction of the SPRWS.

11 b) the petitioner shall be responsible to reimburse all SPRWS construction costs for the above
12 mentioned abandonment, also including the installation of new 8-inch water main in Prosperity
13 between Rose and Maryland and a water main tie-in at Maryland and Barclay.

15 c) the SPRWS shall retain ingress/egress to the vacated area mentioned above to maintain said
16 existing water main and appurtenances until such time that proper abandonment these facilities
17 is completed.

20 4. That at the request of the Saint Paul Department of Planning and Economic Development (PED),
21 the petitioner shall construct as part of their project, a ten foot wide pedestrian/bicycle path
22 between Barclay and Prosperity (a.k.a Phalen Blvd.) along the southern edge of their property to
23 replace the pedestrian/bicycle access along Rose that will be lost when said project is completed,
24 said path shall be constructed to both the satisfaction of PED and Department of Saint Paul
25 Public Works.

28 5. That with the accompanying Certificates of Intended Non-Use, filed voluntarily on behalf of The
29 Department of Public Works, made a part hereof by this reference and filed in the office of the
30 City Clerk of the City of Saint Paul as apart of this resolution, the City, for itself and on behalf of
31 said Public Works, waives the right to its utility easements in the property described in said
32 certificates, subject to any conditions outlined in said certificates.

35 6. That with the accompanying Certificate of Intended Non-Use, filed voluntarily on behalf of
36 AT&T Broadband (fka MediaOne) made a part hereof by this reference and filed in the office of
37 the City Clerk of the City of Saint Paul as apart of this resolution, the City, for itself and on
38 behalf of said AT&T Broadband, waives the right to its utility easements in the property
39 described in above mentioned Exhibit "A" , subject to any conditions in said certificate.

42 7. That the Council of the City of Saint Paul hereby authorizes the proper City Officials to convey
43 any portions of the vacated property that was not originally platted as right of way, by
44 Quit Claim Deed, to the to the Petitioner; and that any expenses incurred as a result of this
45 conveyance shall be paid said petitioner.

2 8. Not withstanding Chapter 130, codified March 1St, 1981, of the Saint Paul Legislative Code as
3 amended, the Petitioner and the City of Saint Paul agree that each party will be responsible for its
4 own acts and the results thereof to the extent authorized by law and shall not be responsible for
5 the act of any others and the results thereof. The Petitioner's liability shall be governed by the
6 provisions of the Minnesota Tort Claims Act, Minnesota Statutes, Section 3.736.

9 9. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
10 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
11 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in
all respects with these terms and conditions.

September 27, 2000. The resolution provides for the vacation of that portion of Rose
Avenue and the east-west alley in block 2,Maryland Heights as more fully described in
the attached resolution.
The Ordinance pertaining to vacations requires that the compensation specified in the
resolution must be paid within sixty (60) days after adoption of the resolution.
