20 This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the
21 Saint Paul Legislative Code as amended, and to the following conditions:

23 1. That the petitioner's, their successors and assigns shall pay$500.00 as an administrative fee for
24 this vacation which is due and payable within 60 days of the effective date of this resolution.
25
26 2. That a 30 foot wide permanent utility easement centered on a line 30 feet north of the south line
27 of Fifth Street on behalf of the City of Saint Paul Department of Public Works to reserve the
28 right of the City to maintain and operate any sewer in or upon said easement and to enter upon
29 said easement from time to time, for the purposes of future construction, reconstruction,
30 inspecting, maintaining or repairing the same or any part thereof and shall be subject to the
31 following conditions:

33 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
34 other objects that will prohibit normal access to utility facilities for maintenance purposes
35 will be permitted within the easement area.

37 b. Improvements in or upon the above described easement that do not prohibit the City from
38 exercising its reserved rights may be allowed by obtaining written permission from the
39 Department of Public Works Sewer Division with the understanding that the restoration
40 and costs of such improvements shall be the sole responsibility of the petitioner, its
41 successors and assigns in the e t the City exercises its reserved easement rights.

7 e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless the G10

9 claims which shall arise from any injuries or damages received or sustained by any break I
10 in any service pipe or connection in said rreserved easement arising out of or resulting
11 from any action or negligence of the petitioner, its employees, agents, or business
12 invitees.

14 3. That the petitioner shall pay all costs and expenses for the reconstruction of the intersection of
15 Fifth and Clarence Streets; and the north and south ends of Etna Street where the public right-of-
16 way intersects with the vacated right-of-way, to the satisfaction of the Department of Public
17 Works under an ordinance permit, including but not limited to, the construction of new curbs,
18 sidewalks, boulevards, drainage structures and signage, to remove all appearances of public
19 right-of-way.

21 4. That the petitioner shall be responsible for the construction, maintenance and ongoing liability of
22 their private drive in that part of Fifth Street lying east of Clarence Street and west of the portion
23 of Fifth Street being vacated. This includes but is not limited to pavement, curb, gutter, sewer
24 construction, repair and reconstruction, snow plowing, sanding, sign installation and
25 maintenance, all to the satisfaction of the Department of Public Works.

27 5. That the petitioner shall be responsible for all costs and expenses for any work in the piblic right-
28 of-way required due to their development; all such work to be accomplished to the satisfaction of
29 the Department of Public Works under an ordinance permit.

31 6. That the private drive in the vacated portion of Fifth Street shall be designated as Fifth Street to
32 allow for continuity in house numbering and appropriate addresses shall be officially assigned by
33 the Department of Public Works.

35 7. That a permanent utility easement shall be retainedwithin the vacated area to protect the interest
36 of U.S. West Communications, Inc.
37
38 8. That a permanent utility easement shall be retained within the vacated area to protect the interest
39 of MediaOne.

41 9. That the petitioner, their successors and assigns agree to idemnify, defend and save harmless the
42 City of Saint Paul, its officers, and employees from all suits, actions, or claims of any character
43 brought as a result of injuries or damages received or sustained by any person, persons, or
44 property on account of this vacation or petitioner's use of this property, including but not limited
45 to a claim brought because of any act of omission, neglect, or misconduct of said petitioner or
46 because of any claims or liability arising from any violation of any law or regulation made in
47 accordance with the law, whether by the petitioner or any of their agents or employees.

49 10. That the petitioner, their successors and assigns, shall within 60 days of the effective date of this
50 resolution, file with the City Clerk an acceptance in writingof the conditions of this resolution
51

and shall within the period(s) specified in the terms and conditions of this resolution, comply in
2 all respects with these terms and conditions.

1 WHEREAS, the Council of the City of Saint Paul, upon the petition of Dennis Guptil, as contained in
2 Technology Department File Numbered 21-99 did, by that resolution stated in Council File Numbered
3 00-321, approve the petition to vacate and discontinue as public property the following property:

16 NOW THEREFORE BE IT RESOLVED, that the above mentioned description in Council File
17 Numbered 00-321 is hereby amended as follows:

1 BE IT RESOLVED, that upon the petition of Dennis Guptil, as documented in Technology Department
2 File Number 21-99, public properties hereinafter described are hereby vacated and discontinued as
3 public property.

5 The property to be vacated is described as follows:

8 A portion of East Fifth Street lying between the northerly extension of Lot 8 Hamer's Subdivision
9 and the southerly extension of the easterly line of the westerly 5.75 feet of Lot 15, Block 3,

13 A portion of Etna Street lying between the south line of the alley in Block 3 Birmingham's
14 Addition extended and the north line of the alley in Hamer's Subdivision extended.

17 A portion of the alley in Hamer's Subdivision abutting Lots 5, 6, 15 & 16

20 This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the
21 Saint Paul Legislative Code as amended, and to the following conditions:

23 1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
24 this vacation which is due and payable within 60 days of the effective date of this resolution.
25
26 2. That a 30 foot wide permanent utility easement centered on a line 30 feet north of the south line
27 of Fifth Street on behalf of the City of Saint Paul Department of Public Works to reserve the
28 right of the City to maintain and operate any sewer in or upon said easement and to enter upon
29 said easement from time to time, for the purposes of future construction, reconstruction,
30 inspecting, maintaining or repairing the same or any part thereof and shall be subject to the
31 following conditions:

33 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
34 other objects that will prohibit normal access to utility facilities for maintenance purposes
35 will be permitted within the easement area.
36
37 b. Improvements in or upon the above described easement that do not prohibit the City from
38 exercising its reserved rights may be allowed by obtaining written permission from the
39 Department of Public Works Sewer Division with the understanding that the restoration
40 and costs of such improvements shall be the sole responsibility of the petitioner, its
41 successors and assigns in the event the City exercises its reserved easement rights.
1 c. No change from the existing grade within the easement area will be permitted without
2 written permission from the Director of the Department of Public Works. 00.31

4 d. No change in surfacing within the easement area will be permitted without written
5 permission from the Director of the Department of Public Works.

7 e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless the
8 City of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or
9 claims which shall arise from any injuries or damages received or sustained by any break
10 in any service pipe or connection in said rreserved easement arising out of or resulting
11 from any action or negligence of the petitioner, its employees, agents, or business
12 invitees.

14 3. That the petitioner shall pay all costs and expenses for the reconstruction of the intersection of
15 Fifth and Clarence Streets; and the north and south ends of Etna Street where the public right-of-
16 way intersects with the vacated right-of-way, to the satisfaction of the Department of Public
17 Works under an ordinance permit, including but not limited to, the construction of new curbs,
18 sidewalks, boulevards, drainage structures and signage, to remove all appearances of public
19 right-of-way.

21 4. That the petitioner shall be responsible for the construction, maintenance and ongoing liability of
22 their private drive in that part of Fifth Street lying east of Clarence Street and west of the portion
23 of Fifth Street being vacated. This includes but is not limited to pavement, curb, gutter, sewer
24 construction, repair and reconstruction, snow plowing, sanding, sign installation and
25 maintenance, all to the satisfaction of the Department of Public Works.

27 5. That the petitioner shall be responsible for all costs and expenses for any work in the piblic right-
28 of-way required due to their development; all such work to be accomplished to the satisfaction of
29 the Department of Public Works under an ordinance permit.

31 6. That the private drive in the vacated portion of Fifth Street shall be designated as Fifth Street to
32 allow for continuity in house numbering and appropriate addresses shall be officially assigned by
33 the Department of Public Works.

35 7. That a permanent utility easement shall be retainedwithin the vacated area to protect the interest
36 of U.S. West Communications, Inc.
37
38 8. That a permanent utility easement shall be retained within the vacated area to protect the interest
39 of MediaOne.

41 9. That the petitioner, their successors and assigns agree to idemnify, defend and save harmless the
42 City of Saint Paul, its officers, and employees from all suits, actions, or claims of any character
43 brought as a result of injuries or damages received or sustained by any person, persons, or
44 property on account of this vacation or petitioner's use of this property, including but not limited
45 to a claim brought because of any act of omission, neglect, or misconduct of said petitioner or
46 because of any claims or liability arising from any violation of any law or regulation made in
47 accordance with the law, whether by the petitioner or any of their agents or employees.

49 10. That the petitioner, their successors and assigns, shall within 60 days of the effective date of this
50 resolution, file with the City Clerk an acceptance in writingof the conditions of this resolution
