Dated September 21, 2000 Shari Moore Deputy City Clerk (September 25, 2000) • $00 r• PETITION TO VACATE CITY INTEREST I(we),the undersigned, constituting a majority of the owners(or their legally designated representatives)of the abutting properties,do hereby petition the Council of the City of Saint Paul to vacate its interests in the property(ies)legally described as follows: The rectangle of property seven (7) feet (running north-south) by forty and 75/100 (40.75) feet (running east-west) immediately to the south of the following lot owned by Uppertown Preservation League: "The West'A of Lot 9,Block 11, Winslow's Addition to Saint Paul, according to the recorded plat thereof, and situate in Ramsey County, Minnesota." I(we)request this vacation for the following reason(s). The single-family residence situated on the above-described lot has occupied the site since circa 1858 and ranks among the oldest in Saint Paul. The south-front of the residence protrudes 3 feet into the public sidewalk right-of-way. The residence is now under restoration, and will require an additional 4 feet(totaling 7)across the south-front of the lot in order to permit a code-compliant front step and stoop. Additionally, the house's current protrusion into the public right-of-way severely complicates lending and insurance issues, which if not remedied will render the preservation and re-use of this historic property more difficult. I(we)have attached six copies of the site plans of any development intended for construction on the lands to be vacated. I apologize for the delay. I believe our application is now complete, but let me know if you need anything else. I note in this letter, the land to be vacated is described as a rectangle. I believe you had subsequent discussions with John Yust, the architect, and a trapezoidal shape was selected. Whichever shape is ultimately vacated, the conclusion of this report remains valid: UPL's property is the only property abutting the property to be vacated. IF YOU DO NOT RECEIVE ALL PAGES.
