1 BE IT RESOLVED,that,upon the petition of Pamela and John Boardman, as documented in Finance
2 Department File Number 1-1999, public properties hereinafter described are hereby vacated and
3 discontinued as public property:

5 All that part of the alley in Block 5, Norwood Addition, Ramsey County, Minnesota,
6 which lies west of the northerly production of the west line of the east 15.00 feet of Lot
7 10 of said Block 5.

9 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of
10 the Saint Paul Legislative Code as amended, and to the following conditions:
11
12 1. That the petitioners, their successors and assigns, shall pay $500.00 as an administrative fee for
13 this vacation which is due and payable within 60 days of the effective date of this resolution.

15 2. That a permanent utility easement shall be retained within the vacated area to protect the
16 interest of MCIWorldCom.

18 3. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
19 the City of Saint Paul, its officers and employees from all suits, actions or claims of an
20 character brought as a result of injuries or damages received or sustained by any person,
21 persons or property on account of this vacation or petitioners' use of this property, including
22 but not limited to, a claim brought because of any act of omission,neglect, or misconduct of
23 said petitioners or because of any claims or liability arising from any violation of any law or
24 regulation made in accordance with the law, whether by the petitioners or any of their agents or
25 employees.

27 4. That the petitioners, their successors and assigns shall, within 60 days of the effective date of
28 this resolution, file with the City Clerk an acceptance in writing of the conditions of this
1 resolution and shall, within the period(s) specified in the terms and conditions of this a‘_ao

Subject: Vacation#1-1999-Ailey vacation near 135EL Michigan &Oneida
I have requested a date of January 24, 2001 for a Public Hearing to approve the attached
Council Resolution. The purpose of the resolution is to vacate part of the alley in Block 5,
Norwood Addition, near I-35E and Michigan and Oneida Streets. This is to allow for the
petitioners, Pam and John Boardman, to join together two parcels of property that they own
into one continuous parcel. The area to be vacated is between these two parcels.
The utilities and usual City offices with rights to the area to be vacated have all responded to
our inquiries regarding the proposed vacation. Photocopies of their responses are with the
resolution as it is being routed for signatures. The resolution is currently in the City
Attorney's office.
I have attached a copy of the green sheet, the Council Resolution, and a map of the area to
be vacated. Please let me know if there is anything else you might need for this.
Needs to be published BEFORE JANUARY 3, 2001 for the Public Hearing to be held on
January 24, 2001!
