That the petitioners, their successors and assigns, shall pay $500.00 as an administrative fee for 13 this vacation which is due and payable within 60 days of the effective date of this resolution. 14 15 2. That a permanent utility easement shall be retained within the vacated area to protect the 16 interest of MCIWorldCom. 17 18 3. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless 19 the City of Saint Paul, its officers and employees from all suits, actions or claims of an 20 character brought as a result of injuries or damages received or sustained by any person, 21 persons or property on account of this vacation or petitioners' use of this property, including 22 but not limited to, a claim brought because of any act of omission,neglect, or misconduct of 23 said petitioners or because of any claims or liability arising from any violation of any law or 24 regulation made in accordance with the law, whether by the petitioners or any of their agents or 25 employees. 26 27 4. The purpose of the resolution is to vacate part of the alley in Block 5, Norwood Addition, near I-35E and Michigan and Oneida Streets. This is to allow for the petitioners, Pam and John Boardman, to join together two parcels of property that they own into one continuous parcel. The area to be vacated is between these two parcels. The utilities and usual City offices with rights to the area to be vacated have all responded to our inquiries regarding the proposed vacation. Photocopies of their responses are with the resolution as it is being routed for signatures. The resolution is currently in the City Attorney's office. I have attached a copy of the green sheet, the Council Resolution, and a map of the area to be vacated. Please let me know if there is anything else you might need for this.
