01-581 (2) Return copy to: Real Estate Division 0 R C G i A L Council File# $$ 140 City Hall Green Sheet# \\\ RESOLUTION CITY ?F SAINT PAUL, MINNESOTA ?S Presented By A9-.7 Referred To Committee: Date 1 BE IT RESOLVED, that, upon the petition of Episcopal Health & Housing Services, as documented in 2 Finance Department File Number 01-2001, public properties hereinafter described are hereby vacated 3 and discontinued as public property.I 4 5 The properties to be vacated are desribed as follows: 6 7 Parcel 1. that part of Dewey Street lying southwesterly of the southwest line of University 8 Avenue and northwesterly of the northwest line of Feronia Avenue; and 9 10 Parcel 2. the northwest-southeast alley lying westerly of a line from the northeast corner of 11 Lot 100, Union Park to the southeast corner of Lot 181 Hinkel's 3rd Amendment, 12 and lying southeasterly of a line from the northwest corner of Lot 87, Union Park to 13 the southwest corner of Lot 193, Hinkel's 3`d Amendment; and 14 15 Parcel 3. the north-south dead-end alley, including cul-de-sac, extending southerly of a line 16 from the northeast corner of Lot 87 to the northwest corner of Lot 100, all in the 17 said Union Park. 18 19 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the 20 Saint Paul Legislative Code as amended, and to the following conditions: 21 22 1. That the petitioner's, their successors and assigns shall pay$500.00 as an administrative fee for 23 this vacation which is due arlid payable within 60 days of the effective date of this resolution. 24 25 2. That the petitioner shall pay 111 costs and expenses for any reconstruction of the 26 Dewey/University and Dewe /Feronia intersections that may be necessary to properly eliminate 27 the appearance of a public th roughfare, including but not limited to costs for new curbs, 28 sidewalks, boulevards, storm drains and street sign removal, all to the satisfaction of the 29 Department of Public Worksl. 30 31 3. That the petitioner shall notify the Department of Public works regarding removal of street 32 lighting within the vacated aea. All costs for the removal shall be the responsibility of the 33 petitioner. 34 II 41-311 1 4. That a permanent utility easement shall be retained on, over, under and across the vacated area on 2 behalf of the City of Saint Paul, Department of Public Works to reserve the right of the City to 3 maintain and operate any sewer in or upon said easement and to enter upon said easement or any 4 portion thereof at any time and from time to time, for the purposes of future construction, 5 reconstruction, inspecting, maintaining or repairing the same or any part thereof. Use of the 6 property within said utility easement shall be subject to the following conditions: 7 8 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any 9 other objects that will prohibit normal access to utility facilities for maintenance purposes 10 will be permitted within the easement area. 11 12 b. Improvements in or upon the above described easement that do not prohibit the City from 13 exercising its reserved rights may be allowed by obtaining written permission from the 14 Department of Public Works Sewer Division with the understanding that the restoration 15 and costs of such improvements shall be the sole responsibility of the petitioner, its 16 successors and assigns in the event the City exercises its reserved easement rights. 17 18 c. No change from the xisting grade within the easement area will be permitted without 19 written permission from the Department of Public Works. 20 21 d. No change in surfacing within the easement area will be permitted without written 22 permission from the Department of Public Works. 23 24 e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless the 25 City of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or 26 claims which shall arise from any injuries or damages received or sustained by any break 27 in any service pipe or connection in said reserved easement arising out of or resulting 28 from any action or negligence of the petitioner, its employees, agents, or business 29 invitees. 30 31 5. That a permanent utility easement shall be retained on, over, under and across the vacated area on 32 behalf of the Board of Water Commissioners of the City of Saint Paul, to reserve the right of the 33 Board of Water Commissioners to maintain and operate any water facility in or upon said 34 easement and to enter upon said easement or any portion thereof at any time for the purposes of 35 future construction, reconstruction, inspecting, maintenance or repair of the same, or any part 36 thereof. Use of the property within said utility easement shall be subject to the following 37 conditions: 38 39 a. Should it be necessary that the petitioner's works or improvements be removed or 2 damaged as a result Of Saint Paul Regional Water Services operations, all removal, 3 replacement or modification costs shall be borne solely by the petitioner. 4 5 d. The petitioner, its successors and assigns shall fully indemnify, defend and save harmless 6 the Board of Water Commissioners, its officers, agents, employees, and servants from all 7 suits, action or claim$ which shall arise from any injuries or damages received or 8 sustained by any break in any service pipe, water main, or connection in said reserved 9 easement, arising out of or resulting from any action or negligence of the petitioner, its 10 employees, agents or business invitees. 11 12 6. That a permanent utility easement shall be retained within the vacated area to protect the interest 13 ofd-Energy Company. 14 x C� 15 7. That a permanent utility easement shall be retained within the vacated area to protect the interest 16 of Qwest Communication, Inc. 17 18 8. That a permanent utility easement shall be retained within the vacated area to protect the interest 19 of A. T. &T. Broadband, Inc. 20 21 9. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless 22 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character 23 brought as a result of injuries or damages received or sustained by any person, persons or 24 property on account of this vacation or petitioners' use of this property, including but not limited 25 to, a claim brought because Of any act of omission, neglect, or misconduct of said petitioners or 26 because of any claims or liability arising from any violation of any law or regulation made in 27 accordance with the law, whether by the petitioners or any of their agents or employees. 28 29 10. That the petitioners, their su cessors and assigns shall, within 60 days of the effective date of this 30 resolution, file with the City Jerk an acceptance in writing of the conditions of this resolution 31 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in 32 all respects with these terms and conditions.
