Any 16 development or use of the property shall be subject to the following conditions: 17 18 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any 19 other objects that will prohibit normal access to utility facilities for maintenance purposes 20 will be permitted within the easement area. 21 22 b. Improvements in or;upon the above described easement that do not prohibit the City from 23 exercising its reserved rights may be allowed by obtaining written permission from the 24 Department of Public Works Sewer Division with the understanding that the restoration 25 and costs of such improvements shall be the sole responsibility of the petitioner, its 26 successors and assigns in the event the City exercises its reserved easement rights. 27 28 c. No change from the existing grade within the easement area will be permitted without 29 written permission from the Department of Public Works. 30 31 d. No change in surfacing within the easement area will be permitted without written 32 permission from the Department of Public Works. 33 34 That a permanent utility easement shall be retained within the vacated area to protect the interest 35 of Xcel Energy Company 36 - 37 That a permanent utility easement shall be retained within the vacated area to protect the interest 38 of AT&T Broadband. 39 40 That the site plan for any proposed development of the vacated area will be approved by the 41 License, Inspection, Environmental Protection Office (LIEP)before any construction occurs. a% - (0G.1 1 2 That the petitioners, their successors and assigns agree to indemnify, defend and save harmless 3 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character 4 brought as a result of injuries or damages received or sustained by any person, persons or 5 property on account of this vacation or sustained due to drainage within the vacated area or the 6 petitioners' use of this property, including but not limited to, a claim brought because of any act 7 of omission, neglect, or misonduct of said petitioners or because of any claims or liability 8 arising from any violation of any law or regulation made in accordance with the law, whether by 9 the petitioners or any of their agents or employees. 10 11 12 That the petitioners, their successors and assigns shall, within 60 days of the effective date of 13 this resolution, file with the City Clerk an acceptance in writing of the conditions of this 14 resolution and shall, within the period(s) specified in the terms and conditions of this resolution, 15 comply in all respects with taese terms and conditions. Any l6development or use of the property shall be subject to the following conditions: 18 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any 19 other objects that will prohibit normal access to utility facilities for maintenance purposes 20 will be permitted within the easement area. 21 22 b. Improvements in or upon the above described easement that do not prohibit the City from 23 exercising its reserved rights may be allowed by obtaining written permission from the 24 Department of Public Works Sewer Division with the understanding that the restoration 25 and costs of such improvements shall be the sole responsibility of the petitioner, its 26 successors and assigns in the event the City exercises its reserved easement rights. 28 c. No change from the existing grade within the easement area will be permitted without 29 written permission from the Department of Public Works. 30 31 d. No change in surfacing within the easement area will be permitted without written 32 permission from the Department of Public Works. 33 34 That a permanent utility easement shall be retained within the vacated area to protect the interest 35 of Xcel Energy Company . 36 37 That a permanent utility easement shall be retained within the vacated area to protect the interest 38 of AT&T Broadband. 39 40 That the site plan for any proposed development of the vacated area will be approved by the 41 License, Inspection, Environmental Protection Office (LIEP) before any construction occurs.
