1 BE IT RESOLVED, that, upon the petition of Legacy Properties of Minnesota, as documented in
2 Finance Department File Number 20-1999, public property hereinafter described is hereby vacated and
3 discontinued as public property.
4 Parcel 1. that part of Pierce Street lying southerly of the westerly extension of the north line of
5 Block 5, Excelsior Park and northeasterly of the northeast line of the Soo Line Railroad
6 right-of-way;
7 BE IT FURTHER RESOLVED, that, to clear a cloud on the title caused by a building encroachment,
8 as documented in Finance Department File Number 20-1999, public property hereinafter described is
9 hereby temporarily vacated and discontinued as public property.
10 Parcel 2. the southerly 1.00 feet of that part of Carroll Avenue lying easterly of the east right-of-
11 way line of Pierce Street and westerly of the northerly extension of the east line of Lot 3,
12 Block 5, Excelsior Park.
13 And, subject to the herein stated exceptions, the easements therein are hereby released.
14 These vacations shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of
15 the Saint Paul Legislative Code as amended, and to the following conditions:
16 1. That the vacation of Parcel 2., described above, and the release of easements therein, shall be
17 only temporary. Upon demolition of the encroaching building, the said Parcel 2. shall revert to
18 public right-of-way and all easements therein shall be restored.
19 2. That the petitioner's, their successors and assigns shall pay$500.00 as an administrative fee for
20 this vacation which is due and payable within 60 days of the effective date of this resolution.
21 3. That, with the accompanying Utility Easement Certificates of Intended Non-Use, filed
22 voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
23 Company, District Energy St. Paul, Incorporated, MCI Metro Incorporated, MediaOne, The
24 Water Utility, and The Department of Public Works, made a part hereof by this reference and
25 filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
26 corporations and departments, waives the right to the utility easements in the vacated Parcel 2.

1 4. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
2 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
3 brought as a result of injuries or damages received or sustained by any person, persons or
4 property on account of this vacation or petitioners' use of this property, including but not limited
5 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
6 because of any claims or liability arising from any violation of any law or regulation made in .
7 accordance with the law, whether by the petitioners or any of their agents or employees.
8 5. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
9 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
10 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in
11 all respects with these terms and conditions.
