That an easement shall be retained for Northern States Power Company, Electric, over, under 22 and across said vacated area for the purpose of protecting its distribution facilities. 23 24 3. That an easement shall be retained for US West Communications over,under and across said 25 vacated area for the purpose of protecting its existing facilities. 26 27 4. That an easement shall be retained for Northern States Power Company, Gas, over, under and 28 . across said vacated area for the purpose of protecting its existing facilities. 29 30 5. That the petitioner's their successors, and assigns agree to indemnify, defend and save harmless 31 the City of Saint Paul, its officers, and employees from all suits, actions, or claims of any 32 character brought as a result of injuries or damages received or sustained by any person,persons, 33 or property on account of this vacation or petitioner's use of this property, including but not 34 limited to a claim brought because of any act of omission, neglect, or misconduct of said 35 petitioner or because of any claims or liability arising from any violation of any law or regulation 36 made in accordance with the law, whether by the petitioner or any of their agents or employees. 37 38 39 1 2 3 6.
