8 West of a line lying 70 feet West of and parallel to the East line of Bidwell Street and lying Easterly
9 and Southerly of the following described line: Beginning at the Southeast corner of Lot 8, Block 159,
10 Robertson's Addition, thence on a curve.to the left with a radius of 65 feet and an angle of 45 degrees,
11 thence on a tangent to the above curve to a point 70 feet West of East line of Bidwell Street and there
12 terminating.

15 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
16 Saint Paul Legislative Code as amended, and to the following conditions:

18 1. That the petitioner's, their successors and assigns shall pay$500.00 as an administrative fee for
19 this vacation which is due and payable within 60 days of the effective date of this resolution.

21 2. That an easement shall be retained for Northern States Power Company, Electric, over, under
22 and across said vacated area for the purpose of protecting its distribution facilities.

24 3. That an easement shall be retained for US West Communications over, under and across said
25 vacated area for the purpose of protecting its existing facilities.

27 4. That an easement shall be retained for Northern States Power Company, Gas, over, under and
28 across said vacated area for the purpose of protecting its existing facilities.

31 the City of Saint Paul, its officers, and employees from all suits, actions, or claims of any

34 limited to a claim brought because of any act of omission, neglect, or misconduct of said

3 BE IT RESOLVED,that, upon the petition of Tara&Eric Neumann, as documented in Technology
4 Department File Number 1999-08 the public right of way hereinafter described is hereby vacated and
5 discontinued as public property and, subject to the herein stated exceptions.

7 Subject property is as follows: That part of Lot 9 and Lot 10, Block 159,Robertson's Addition lying
8 West of a line lying 70 feet West of and parallel to the East line of Bidwell Street and lying Easterly
9 and Southerly of the following described line: Beginning at the Southeast corner of Lot 8, Block 159,
10 Robertson's Addition, thence on a curve to the left with a radius of 65 feet and an angle of 45 degrees,
11 thence on a tangent to the above curve to a point 70 feet West of East line of Bidwell Street and there
12 terminating.

15 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
16 Saint Paul Legislative Code as amended, and to the following conditions:

18 1. That the petitioner's,their successors and assigns shall pay$500.00 as an administrative fee for
19 this vacation which is due and payable within 60 days of the effective date of this resolution.

21 2. That an easement shall be retained for Northern States Power Company, Electric, over, under
22 and across said vacated area for the purpose of protecting its distribution facilities.

24 3. That an easement shall be retained for US West Communications over,under and across said
25 vacated area for the purpose of protecting its existing facilities.

27 4. That an easement shall be retained for Northern States Power Company, Gas, over, under and
28 . across said vacated area for the purpose of protecting its existing facilities.

30 5. That the petitioner's their successors, and assigns agree to indemnify, defend and save harmless
31 the City of Saint Paul, its officers, and employees from all suits, actions, or claims of any
32 character brought as a result of injuries or damages received or sustained by any person,persons,
33 or property on account of this vacation or petitioner's use of this property, including but not
34 limited to a claim brought because of any act of omission, neglect, or misconduct of said
35 petitioner or because of any claims or liability arising from any violation of any law or regulation
36 made in accordance with the law, whether by the petitioner or any of their agents or employees.

3 6. That the petitioner's their successors, and assigns, shall within 60 days of the effective date of
4 this resolution, file with the City Clerk an acceptance in writing of the conditions of this
5 resolution and shall within the period(s) specified in the terms and conditions of this resolution,
6 comply in all respects with these terms and conditions.
