1 BE IT RESOLVED,that, upon the petition of Scott Ferguson for Cayuga Street L.L.C., as documented
2 in TMS-Real Estate File Number 03-2001, public properties hereinafter described are hereby vacated
3 and discontinued as public property: arid, subject to the herein stated exceptions, the easements within
4 those public properties are hereby released.

6 The property to be vacated is described as follows:

8 That part of the alley in Block 2, Edmund Rice's Second Addition, according to the recorded plat
9 therof and situated in Ramsey County, Minnesota lying between the westerly extensions of the
10 north and south lines of Lot 6, said Block 2.

12 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
13 Saint Paul Legislative Code as amended, and to the following conditions:

15 1. That the petitioners, their successors and assigns shall pa $500.0 as an administrative fee for
16 this vacation which is due and payable within 60 days of the e ective date of this resolution.

18 2. That a permanent utility easement shall be retained within the vacated area to protect the interest
19 of Xcel Energy.
20
21 3. That a permanent utility easement shall be retained within the vacated area to protect the interest
22 of Qwest Communications by maintaining service to 850 Agate Street which is provided through
23 this easement.

25 4. That a permanent utility easement shall be retained within the vacated area to protect the interest
26 of A T & T Broadband.

28 5. That the petitioners shall obtain a build permit for the fence construction and possibly the
29 retaining wall depending on wall height and structural considerations.

31 6. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
32 the City of Saint Paul, its officers and employees from all suits, actions or claims of any

1 character brought as a result of injuries or damages received or sustained by any person, persons
2 or property on account of this vacation or petitioners' use of this property, including but not
3 limited to, a claim brought because of any act of omission, neglect, or misconduct of said
4 petitioners or because of any claims or liability arising from any violation of any law or
5 regulation made in accordance with the law, whether by the petitioners or any of their agents or
6 employees.

8 7. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
9 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution

33 other objects that will prohibit normal access to utility facilities for maintenance purposes

37 exercising its reserved rights may be allowed by obtaining written permission from the
38 Department of Public Works Sewer Division with the understanding that the restoration and

East Side Neighborhood Development Company (ESNDC) is proposing to develop the vacated alley
as part of the parking lot to support business and residential tenants at the G.A. Johnson Building (987-
989 Payne Avenue). A sketch of the plans for development is attached. ESNDC will be working with
Flannery Construction and Carley-Torgersen Surveyors and Larson Engineering to do a design build
on the property.
ESNDC has been working closely with Dan Bayers at Planning and Economic Development, Linda
Murphy at Public Works, and Dave Lang at the Public Housing Authority to address design, grading,
draining and aesthetic issues. Please do not hesitate to call me if you have any questions about the
proposed design.
