1 BE IT RESOLVED, that, upon the petition of Joe Felt, as documented in Technology Department File
2 Number 2001-05, public properties hereinafter described are hereby vacated and discontinued as public
3 property: and, subject to the herein stated exceptions.

6 The property to be vacated is described as follows:
7 The North 20 feet of Lot 7 and the alley between
8 Lots 6 and 7, Block 3, King's Addition to St. Paul.

11 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
12 Saint Paul Legislative Code as amended, and to the following conditions:

14 1. That the petitioner's, their successors and assigns shall pay$500.00 as an administrative fee for
15 this vacation which is due and payable within 60 days of the effective date of this resolution.

17 2. That a permanent utility easement shall be retained within the vacated area to protect the interest
18 of AT&T Broadband .

20 3. That a permanent utility easement shall be retained within the vacated area to protect the interest
21 of Qwest and any of its existing facilities in the vacated area..

23 4. That the Council of the City of Saint Paul authorizes the proper City Officials to convey by
24 by Quit Claim Deed any portions of the vacated property that was not originally platted as right
25 of way, to the to the Petitioner; and that any expenses incurred as a result of this conveyance shall
26 be incurred by said petitioner.

28 5. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
29 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
30 brought as a result of injuries or damages received or sustained by any person, persons or
31 property on account of this vacation or petitioners' use of this property, including but not limited
32 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
33 because of any claims or liability arising from any violation of any law or regulation made in
34 accordance with the law, whether by the petitioners or any of their agents or employees.
