1 BE IT RESOLVED, that, upon the petition of Tom Huonder, as documented in Real Estate
. 2 Division File Number 21-2001, public properties hereinafter described are hereby vacated and
3 discontinued as public property:

5 The property to be vacated is described as follows:

7 that part of Ruth Avenue lying north of the westerly extension of the south line of Block
8 1,Norton's Lincoln Park and south of the westerly extension of the north line of said
9 Block 1.
10
11 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981,
12 of the Saint Paul Legislative Code as amended, and to the following conditions:
13
14 1. That the petitioners, their successors and assigns shall pay$500.00 as an administrative
15 fee for this vacation which is due and payable within 60 days of the effective date of this
16 resolution.

18 2. That the erection of a fence on the vacated property shall not interfere with Excel
19 Energy's access rights to its facilities. The petitioner shall be responsible for fence
20 maintenance within Excel's easements.

22 3. That, on behalf of the Board of Water Commissioners of the City of Saint Paul, a
23 permanent utility easement shall be retained on, over, under and across the vacated area to
24 reserve the right of the Board to maintain and operate any water facility in, on or upon
25 said easement, and to enter upon said easement or any portion thereof at any time, and
26 from time to time for the purposes of future construction, reconstruction, inspection,
27 maintenance or repair of the same or any part thereof. The said utility easement shall be
28 subject to the following restrictions:

30 a. No buildings, structures, trees or any temporary structure, material storage,
31 fixture, or other object that may prohibit normal access to water facilities for
32 maintenance purposes will be permitted within the easement area.
33
34 b. With written permission from the Saint Paul Regional Water Services,
35 improvements in or upon the above described easement that do not prohibit or
36 limit the full and free exercise by the Saint Paul Regional Water Services of its
37 reserved rights may be allowed, with the understanding that the restoration and
38 costs of such improvements, should the Water Services exercise its easement
39 rights, shall be the sole responsibility of the fee owner, its successors and assigns.
1 c. Should it be necessary that the petitioner's works or improvements be removed, or
2 should the said works or improvements be damaged as a result of the Saint Paul 0 a- IS
3 Regional Water Services' operations, all removal, replacement or modification
4 costs shall be borne solely by the petitioner.

6 d. No change from the existing grade within the easement shall be permitted without
7 written permission from the Saint Paul Regional Water Services.
8
9 e. No change in surfacing within the easement area shall be permitted without
10 written permission from the Saint Paul Regional Water Services.

12 f. The petitioner, its successors and assigns shall fully indemnify, defend and save
13 harmless the Board of Water Commissioners of the City of Saint Paul, its officers,
14 agents, employees, and servants from all suits, actions or claims that shall arise
. 15 from any injuries or damages received or sustained by any break in any service
16 pipe, water main, or connection in said reserved easement, arising out of or
17 resulting from any action or negligence of the petitioner, its employees, agents or
18 business invitees.

20 4. That the petitioners, their successors and assigns agree to indemnify, defend and save
21 harmless the City of Saint Paul, its officers and employees from all suits, actions or
22 claims of any character brought as a result of injuries or damages received or sustained by
23 any person,persons or property on account of this vacation or petitioners' use of this
24 property, including but not limited to, a claim brought because of any act of omission,
25 neglect, or misconduct of said petitioners or because of any claims or liability arising
26 from any violation of any law or regulation made in accordance with the law, whether by
27 the petitioners or any of their agents or employees.

29 5. That the petitioners, their successors and assigns shall, within 60 days of the effective
30 date of this resolution, file with the City Clerk an acceptance in writing of the conditions
31 of this resolution and shall, within the period(s) specified in the terms and conditions of
32 this resolution, comply in all respects with these terms and conditions.

This property is located in City Council District 6, Planning District 2.
The subject petition is in proper form and has been signed by the requisite number of property
owners.
