1 BE IT RESOLVED,that,upon the petition of the Housing and Redevelopment Authority, on behalf of
2 the Lander Group, as documented in Finance Department File Number 18-2000 -Phase II,public
3 properties hereinafter described are hereby vacated and discontinued as public property.

5 The property to be vacated is described as follows:

7 that part of Sibley Street lying south of a line between the northeast corner of Block 6 and the
8 northwest corner of Block 3, both of Hoyt's Addition to Saint Paul, Ramsey County, Minnesota,
9 and lying north of a line between the southeast corner of said Block 6 and the southwest corner of
10 said Block 3.

12 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
13 Saint Paul Legislative Code as amended, and to the following conditions:

15 1. That the petitioner shall be responsible for replanting the property being developed, including
16 dedication the relocated Sibley Street right-of-way and the additional right-of-way along the east
17 'side of the existing Temperance Street right-of-way in accordance with plans approved by the
18 Department of Public Works.

20 2. That the petitioner shall pay all costs and expenses for the relocation and reconstruction of Sibley
21 Street, and all reconstruction of Eighth and Ninth Streets that are necessary due to said
22 relocation, including but not limited to the construction of new pavement, curbs, sidewalks,
23 sewer, water, lighting, traffic signals and drainage structures, to the satisfaction of the
24 Department of Public Works,under an ordinance permit, or as a City contract.

26 3. That the petitioner shall replace, in kind, existing street lighting on Temperance and Eighth
27 Streets, and submit its design of new lighting to the Department of Public Works,Traffic
28 Engineering for approval.

30 4. That the relocation of Sibley Street necessitates restricted traffic movements, specifically that
31 only right turns shall be permitted onto Sibley Street and only right turns out of Sibley Street,
32 both north and south of Ninth Street.

1 5. That a permanent, full-width, utility easement shall be retained on, over,under and across the
2 vacated area on behalf of the City of Saint Paul, Department of Public Works to reserve the right
3 of the City to maintain and operate any sanitary or storm sewers, street lighting and traffic signal
4 facilities in or upon said easement and to enter upon said easement or any portion thereof at any
5 time and from time to time, for the purposes of future construction, reconstruction, inspecting,
6 maintaining or repairing the same or any part thereof. Said utility easement shall be subject to
7 the following conditions: -

9 a. No buildings, structures, trees or any temporary structure,material storage, fixture, or any
10 other objects that will prohibit normal access to utility facilities for maintenance purposes
11 will be permitted within the easement area.

13 b. Improvements in or upon the above described easement that do not prohibit the City from
14 exercising its reserved rights may be allowed by obtaining written permission from the
15 Department of Public Works Sewer Division with the understanding that the restoration
16 and costs of such improvements shall be the sole responsibility of the petitioner, its
17 successors and assigns in the event the City exercises its reserved easement rights.

19 c. No change from the existing grade within the easement area will be permitted without
20 written permission from the Department of Public Works.

Dear Mr. White:
On behalf of the developers, The Lander Group and Sherman Associates, we are submitting the
plans and descriptions for Petition to Vacate City Interest, for the Sibley Park Apartments located
between 7th and 9th streets and Wacouta and Temperance.
The property, comprised of 3 city blocks, is located in T29N R22W in the SE 1/4 of Section 31.
The general legal description of those blocks are Lots 1-6,Block 6; and Lots 1-6,Block 3, Hoyt's
Addition; and Lots 1-10, Block 2, Whitney and Smith's Addition to St. Paul. The site is
currently occupied by fee parking lots and a one-story auto repair shop located on the south
corner of Block 3.
The project consists of housing on Blocks 2 and 6 and a City Park on Block 3. Each block of
housing consists of apartments and condominiums with underground parking. The project will
be done in two phases: Phase 1 - Housing on Block 2; and Phase 2 - Housing on Block 6 and
City Park on Block 3.
The vacation is necessitated by the development of the three blocks:
1. The vacations and dedications on Block 2 accommodate the building site and the realignment
of 7th Street.
2. The dedication on Block 6 is to accommodate the widening of Temperance Street to a58 foot
right-of-way.
3. The dedication and vacation of Sibley Street is to realign the street to accommodate the
building site on Block 6. I
