1 RESOLVED, that upon the petition of Paul C. and Patricia J. Amidon, per Finance Department File
2 Number 4-1996, public properties herinafter described are hereby vacated and discontinued as public
3 property; and, subject to the herein stated exceptions, the easements within those public properties are hereby
4 released.

6 The vacated area is described as follows:

8 All that part of Leland Street southeasterly of the southeasterly line of Benson Street lying
9 within the northwesterly 1/4 of the southeasterly 1/4 of Section 15, Township 28 North, Range
10 23 West; also,

12 All that part of Parmer Street lying northwesterly and northerly of the northeasterly extension
13 of the southeasterly line of the vacated alley in Block 3, Major's Addition; all in Ramsey
14 County, Minnesota.

16 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of
17 the Saint Paul Legislative Code as amended, and to the following conditions:

19 1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
20 for this vacation which is due and payable within 60 days of the effective date of this
21 resolution.

23 2. That the petitioner shall pay all costs and expenses for the reconstruction of the intersection at
24 Benson Street, to properly eliminate the appearance of a public thoroughfare, including but not
25 limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street sign removal,
26 all to the satisfaction of the Department of Public Works.

28 3. That the petitioner shall submit a site plan to the Office of License, Inspection and
29 Environmental Protection (LIEP) for City review and approval of the proposed use of the
30 vacated area, including their building addition and/or their vehicular access via vacated Leland
31 Street.

33 4. That a permanent utility easement shall be retained within the vacated area to to protect the
34 interest of Northern States Power Company.

36 5. That a permanent utility easement shall be retained within the vacated area to protect the
37 interest of U.S. West Communication, Inc.

1. 6. That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
2 voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
' 3 Company, District Energy St. Paul, Incorporated, Access Transmission Services Incorporated,
4 Continental Cablevision, The Water Utility, and The Department of Public Works, made a
5 part hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City,
6 for itself and on behalf of these corporations and departments, waive the right to the utility
7 easements in the vacated area described above.

9 7. That the petitioner's their successors, and assigns agree to indemnify, defend and save
10 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of
11 any character brought as a result of injuries or damages received or sustained by any person,
12 persons, or property on account of this vacation or petitioner's use of this property, including
13 but not limited to a claim brought because of any act of omission, neglect, or misconduct of
14 said petitioner or because of any claims or liability arising from any violation of any law or
15 regulation made in accordance with the law, whether by the petitioner or any of their agents or
16 employees

18 8. That the petitioner's their successors, and assigns, shall within 60 days of the effective date of
19 this resolution, file with the City Clerk an acceptance in writing of the conditions of this
20 resolution and shall within the period(s) specified in the terms and conditions of this
21 resolution, comply in all respects with these terms and conditions.

January 8, 1997 which provides for the vacation of all that part of Leland Street
southeasterly of the southeasterly line of Benson Street lying within the northwesterly
1/4 of the southeasterly 1/4 Section 15, Township 28 North, Range 23 West as more
fully described in the attached resolution.
The Ordinance pertaining to vacations requires that the compensation specified in the
resolution must be paid within sixty (60) days after adoption of the resolution. However
because the original letter was mislaid you have 30 days from the date of this letter to
submit your check and confirmation.
Also enclosed is an acceptance of the terms of the resolution which must also be signed
and filed here within the same time.

I am requesting that a date of January 8, 1997, be set for the approval of the attached Council
Resolution. The purpose of the resolution is to vacate Leland Street southeasterly of Benson
Street and Parmer Street southwesterly of Leland Streett, so that the adjoining property owners
can buils an addition ti their existing building.
The utilities and City offices with rights to the subject area have all responded to our inquiries
regarding the proposed vacation. Their responses are with the resolution as it is being routed
for signatures. The resolution is currently in the Finance Director's Office.
I have attached photocopies of the Green Sheet, the Council Resolution, and a map of the area
to be vacated. Please let me know if there is anything else you might need for this.

Vacation of Leland Street southeasterly of Benson Street
The Department of Public Works has completed a review of the above referenced
vacation proposal and has no objections to the vacation subject to the following:
1. That the petitioner shall pay all costs and expenses for the reconstruction of the
intersection at Benson Street, to properly eliminate the appearance of a public
thoroughfare, including but not limited to, costs for new curbs, sidewalks, boulevards,
storm drains, and street sign removal, all to the satisfaction of the Department of Public
Works.
2. That the petitioner shall submit a site plan to the Office of License, Inspection and
Environmental Protection (LIEP) for City review and approval of the proposed use of
the vacated area, including their building addition and /or their vehicular access via
vacated Leland Street.
There are no easements being retained by the Department of Public Works within
Leland Street southeasterly of Benson and Parmer Street southwesterly of Leland
Street. As soon as I have the Certificate of Intended Non-Use signed and notarized, I
will be forwarding it to you.
