10 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of
11 the Saint Paul Legislative Code as amended, and to the following conditions:

14 for this vacation which is due and payable within 60 days of the effective date of this re

17 2. That a permanent utility easement shall be retained within the vacated area to to protect the
18 interest of Northern States Power Company.

22 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of
23 any character brought as a result of injuries or damages received or sustained by any person,

25 but not limited to a claim brought because of any act of omission, neglect, or misconduct of
26 said petitioner or because of any claims or liability arising from any violation of any law or

We, the undersigned, constituting a majority of owners(or their legally designated representatives) of the abutting
properties, do hereby petition the Council of the City of Saint Paul to vacate its interest in the property described
below:
A. All that part of the east-west alley in Block 8, Como Heights Addition to the City of Saint Paul lying
westerly of the west line of the north-south alley in the said Block 8, Como Heights Addition and
northwesterly of the northwest line of Wheelock Parkway.
We request this vacation for the following reasons.
1. The existing alley provides no accessible vehicular service to adjoining or other properties.
2. The existing alley has no outlet. •
S. The existing alley contains a steep grade, large stones, trees and shrubs making any vehicular access
difficult.
4. Use of the existing alley would adversely affect the privacy of adjoining owners.
5. The adjoining property owners have maintained and will continue to maintain the general appearance of
the existing alley without compensation.
6. The property owners adjacent to the existing alley have experienced numerous disturbances because the
alley continues to be utilized as a short-cut leading to trespasses on private property adjacent to the
alley.
6. The vacation of the existing alley would increase neighborhood security.
7. The vacation of the existing alley would help the general appearance of the neighborhood.
B. The alley would be added to the property of joining Lot 8 and Lot 9 as indicated on the enclosed survey.

We, the undersigned, constituting a majority of owners (or their legally designated representatives) of the abutting
properties, do hereby petition the Council of the City of Saint Paul to vacate its interest in the property described
below:
A. All that part of the east-west alley in Block 8, Como Heights Addition to the City of Saint Paul lying
westerly of the west line of the north-south alley in the said Block 8, Como Heights Addition and
northwesterly of the northwest line of Wheelock Parkway.
We request this vacation for the following reasons.
1. The existing alley provides no accessible vehicular service to adjoining or other properties.
2. The existing alley has no outlet.
The existing alley contains a steep grade, large stones, trees and shrubs making any vehicular access
difficult.
4. Use of the existing alley would adversely affect the privacy of adjoining owners. •
5. The adjoining property owners have maintained and will continue to maintain the general appearance of
the existing alley without compensation.
6. The property owners adjacent to the existing alley have experienced numerous disturbances because the
alley continues to be utilized as a short-cut leading to trespasses on private property adjacent to the
alley.
6. The vacation of the existing alley would increase neighborhood security.
7. The vacation of the existing alley would help the general appearance of the neighborhood.
B. The alley would be added to the property of joining Lot 8 and Lot 9 as indicated on the enclosed survey.
