I am requesting that a hearing date of November 29, 1995, be set for approval of the
attached Council Resolution. The purpose of the resolution is to vacate a portion of
platted Park Street due to a building which encroaches onto the street right-of-way.
The utilities and City offices who had rights to easements on the subject property have
all signed Certificates of Intended Non-use to their easement rights. The original
certificates are with the Council Resolution as it is being routed for signatures. It is
currently in the City Attorney's Office.
I have attached a copy of the Green Sheet, the Council Resolution and a map of the
subject area. I have also enclosed 7 copies of the map and resolution for the
Councilfolks if needed. Please let me know if there is anything else you might be
needing for this.

I am requesting that a hearing date of November 29, 1995, be set for approval of the
attached Council Resolution. The purpose of the resolution is to vacate a portion of
platted Park Street due to a building which encroaches onto the street right-of-way.
The utilities and City offices who had rights to easements on the subject property have
all signed Certificates of Intended Non-use to their easement rights. The original
certificates are with the Council Resolution as it is being routed for signatures. It is
currently in the City Attorney's Office.
I have attached a copy of the Green Sheet, the Council Resolution and a map of the

12 This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1,
13 1981, of the Saint Paul Legislative Code as amended, and to the following conditions:

15 . 1. That the petitioners, their successors and assigns shall pay $500.00 as an administrative
16 fee for this vacation which is due and payable within 60 days of the effective date of this
17 resolution.

1 2. That subject vacation shall be for the life of the existing structure only.

3 3. That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
4 voluntarily on behalf of U.S. West Communications, Incorporated, Northern States
5 Power Company, District Energy St. Paul, Incorporated, Access Transmission Services
6 Incorporated, Continental Cablevision, The Water Utility, and The Department of Public
7 Works, made a part hereof by this reference and filed in the office of the City Clerk of
8 Saint Paul, the City, for itself and on behalf of these corporations and departments,
1 waive the right to the utility easements in the vacated area described above.

3 4. That the petitioners, their successors and assigns, agree to indemnify, defend and save
4 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or
5 claims of any character brought as a result of injuries or damages received or sustained

B. A plat map, blueprint or scaled drawing showing the lands to be vacated, the
boundary streets and all abutting properties. A copy of a plat map may be
obtained in Room 140, City Hall.
C. A Certified Ownership Report, which shows all fee owners and contract
purchasers of all properties abutting the lands proposed to be vacated. The
report must identify, by legal description, the property owned by each person
1) signing the petition. The names of the owners on the report must agree with
( ? the names on the petition and must be current to the petition at the time of
�C� filing. If, for any reason, all names on the petition do not correspond to the
names on the Certified Ownership Report, the petition will be considered
