4 and The Department of Public Works, made a part hereof by this reference and filed in the
5 office of the City Clerk of Saint Paul, the City, for itself and on behalf of these corporations
6 and departments, waive the right to the utility easements in the vacated area described above.

8 3. That the petitioner's their successors, and assigns agree to indemnify, defend and save
9 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of
10 any character brought as a result of injuries or damages received or sustained by any person,

12 but not limited to a claim brought because of any act of omission, neglect, or misconduct of
13 said petitioner or because of any claims or liability arising from any violation of any law or

YOUR PETITIONER, the Port Authority of the City of Saint Paul
respectfully states and alleges that we are the fee owners of record of the real
estate abutting Montreal Avenue further described as follows:
Parcel A
All that part of Montreal Avenue across Government Lot 3, Section 14,
Township 28, Range 23, Ramsey County, Minnesota and of Lot 19, Block
41, West End that lies Easterly of the southeasterly right-of-way of the
Chicago, Milwaukee and St. Paul Railroad and Easterly of the Easterly
right-of-way of Interstate Highway 35W and Westerly of a line drawn from
a point on the North line of said Montreal Ave. that is 448.85 feet West of
the intersection of said North line with the West line of Government lot 2

Your Petitioner herein requests that there be no assessment of
compensation to Petitioner on account of the value of the accrual; and that in
lieu of a bond, and by acceptance of the terms of the vacation, the Texaco
Refining & Marketing Inc. agrees to fully indemnify, defend and save harmless
the City of Saint Paul and the Board of Water Commissioners, its officers,
agents, employees and servants from all suits, actions or claims which may arise
from any injuries or damages received or sustained by a break in any service
pipe, water main, or connection in said vacated areas, arising out of or resulting
from any action or negligence of the Petitioner, its employees, agents or
business invitees. Your Petitioner herein further requests that the provisions of
the Saint Paul legislative Code, Chapter 130, pertaining to the reservations of
easements, rights and other claims for the installation, maintenance and
operation of any water, gas, telephone, or electrical main, pipe or conduit, or any
other conduit of public instrumentality for the City of Saint Paul and for other
persons or corporations having public instrumentalities in the land to be vacated,
be waived upon presentation to and approval by the City Council of statements
to the effect that any such instrumentality will be abandoned.
WHEREFORE, your Petitioner respectfully requests your Honorable Body
to vacate the portions of Montreal Avenue for the purposes above-stated.

TO: THE HONORABLE COUNCIL PRESIDENT
AND
MEMBERS OF THE CITY COUNCIL
YOUR PETITIONER, the Port Authority of the City of Saint Paul
respectfully states and alleges that we are the fee owners of record of the real
estate abutting Montreal Avenue further described as follows:
Parcel A
All that part of Montreal Avenue across Government Lot 3, Section 14,
Township 28, Range 23, Ramsey County, Minnesota and of Lot 19, Block
41, West End that lies Easterly of the southeasterly right-of-way of the
Chicago, Milwaukee and St. Paul Railroad and Easterly of the Easterly
right-of-way of Interstate Highway 35W and Westerly of a line drawn from
a point on the North line of said Montreal Ave. that is 448.85 feet West of
the intersection of said North line with the West line of Government lot 2
in said Section 14 to a point on the South line of said Montreal Ave. that is
499.71 feet West of the intersection of said South line with the Southerly
extension of the West line of said Government Lot 2.
Parcel B
All that part of Montreal Avenue in Government lot 3, Section 14,
Township 28, Range 23, Ramsey County, Minnesota that is described as
follows:
Beginning at the Southwest corner of Government Lot 2 in said Section
14; thence North 89°52'37" East along the South line of said Government
Lot 2, also being the North line of said Government Lot 3, a distance of
107.00 feet; thence south 61°52'01" West a distance of 70.27 feet to the
South line of said Montreal Ave; thence South 89°52'37" West, along said
South line, a distance of 45.05 feet to the intersection with the Southerly
extension of the West line of said Government Lot 2; thence North 0°02'

The proposed area to be vacated is colored in red on the attached
Exhibit.
The proposed vacation is required for the development of Crosby Lake
Business Park.
Your Petitioner herein requests that there be no assessment of
compensation to Petitioner on account of the value of the accrual; and that in
lieu of a bond, and by acceptance of the terms of the vacation, the Texaco
Refining & Marketing Inc. agrees to fully indemnify, defend and save harmless
the City of Saint Paul and the Board of Water Commissioners, its officers,
agents, employees and servants from all suits, actions or claims which may arise
from any injuries or damages received or sustained by a break in any service
pipe, water main, or connection in said vacated areas, arising out of or resulting
from any action or negligence of the Petitioner, its employees, agents or
business invitees. Your Petitioner herein further requests that the provisions of
the Saint Paul legislative Code, Chapter 130, pertaining to the reservations of
easements, rights and other claims for the installation, maintenance and
operation of any water, gas, telephone, or electrical main, pipe or conduit, or any
other conduit of public instrumentality for the City of Saint Paul and for other
persons or corporations having public instrumentalities in the land to be vacated,
be waived upon presentation to and approval by the City Council of statements
to the effect that any such instrumentality will be abandoned.
WHEREFORE, your Petitioner respectfully requests your Honorable Body
to vacate the portions of Montreal Avenue for the purposes above-stated.
