If this complaint is true, we hope you consider this a friendly reminder to remove the graffiti as soon as possible. It is also important that you file a report with the Police Department by calling 291-1111 if you have not already done so. Unfortunately, in.an urban environment such as ours, graffiti vandalism occurs all too often. Studies have proven that one of the most successful ways to fight graffiti vandalism is to remove it as quickly as possible. This graffiti commonly represents the vandalism of youth street gangs or of juvenile youths called"taggers", who compete with each other for audience and territory. The purpose of this letter is to request that you remove the graffiti as soon as possible. Enclosed is a sheet with graffiti removal tips. You may wish to take photos of the graffiti in case they are needed by your insurance agent. If you already removed the graffiti, thank you! A City enforcement officer will check this property sometime after the date on the reverse side of this;letter. Please take notice that if the graffiti is still present, the inspector will determine a reasonable time for removal. At the end of this time period if the graffiti still remains, the City will remove or cover over the graffiti and the cost of this work will be charged to the real estate taxes as a special assessment against the property. That this vacation shall be subject to the terms and condition of Chapter 130, 7 codified March 1, 1981, of the Saint Paul Legislative Code as amended. • 8 9 2. That a easement shall be retained by Northern States Power Company's Electric& Gas 10 Divisions over the east 825 feet of said vacated street for the purpose of maintaining 11 their existing facilities. 12 13 3. PUB •RK`' E MEE •� MATTER S FT FOR THE COWICIL HEARING ON THIS M TER IS SET FOR !/,'� HAMLINE q 6 _ September 3, 1996 UNIVERSITY Mr. Juan Ortiz City of St. Paul Real Estate Division Room 140 City Hall St. Paul, Minnesota 55102 Dear Mr. Ortiz: In response to your FAX memo of August 20, 1996 containing concerns of utilities about the vacation of Snelling to Pascal, our representative Mr. Steve Erickson of BWBR Architects contacted all the parties involved and we have reached understandings as follows: 1) Fire prevention - A 25' drive aisle will be maintained. 2) NSP - An easement covering the current gas and electric (both overhead and ductline will be maintained. The overhead between Snelling and Asbury on the south side of Taylor will be abandoned by NSP and the easement will be modified as illustrated on the attached site plan. 3) Continental Cable Vision - The overhead lines currently hung on NSP poles between Snelling and Asbury on the south side of Taylor will have to be relocated, as the poles will be removed by NSP. Relocation will need to be on the north side of Taylor. Hamline University will cooperate in this relocation as required. 4) Public Works A) Hamline will make arrangements with NSP to install night watch lights to replace those removed by NSP. B) Hamline will construct driveway sections at the intersection of Snelling and Taylor, and Pascal and Taylor. This construction will coincide with the complete reconstruction of Taylor to take place after the construction of proposed new Fieldhouse. Tentative completion August 1998. Public Works Traffic Lighting Division would have to remove two overhead street lights. Hamline University would have to make arrangements with NSP to replace these with "night watch lights" if this area is to remain lit. 2. The university shall be responsible for removing all appearances of a public street, including , but not limited to, removing the street sections and constructing driveway sections at Taylor & Snelling and Taylor & Pascal, to the satisfaction of the Department of Public Works. 3. The university shall be responsible for the installation and maintenance of a stop sign at the intersection of Taylor and Snelling. 4. A 30 foot utility easement for sewer purposes shall be retained by the Department of Public Works as designated on the attached drawing and legal description. Tschid� ---- Unit Supervisor DATE: August 9, 1996 SUBJECT: Finance Department File Number 8-1996 Vacate Taylor Avenue The Water Utility has a twenty-inch water main, two six-inch water mains,three fire hydrants, and several large water services in that part of Taylor Avenue right-of-way proposed for vacation. To provide for continued access to our facilities the Utility requires that an easement be retained over the entire portion of Taylor Avenue proposed for vacation. Restrictions within the area are as follows: 1. No buildings, structures or trees are permitted within the easement area, or any temporary structure, material storage, fixture or other objects that may prohibit normal access to water facilities for maintenance purposes without written permission from the Water Utility. 2. No change from the existing grade or change in surfacing within the easement area is permitted without written permission from the Water Utility. 3. Should it be necessary that the petitioner's works or improvements be removed or damaged as a result of Water Utility operations, all removal, replacement or modification costs to restore the petitioner's works shall be borne solely by the petitioner. 4. That the petitioner, its successors and assigns shall fully indemnify, defend and save harmless the Board of Water Commissioners, its officers, agents, employees and servants from all suits, actions or claims which shall arise from any injuries or damages received or sustained by any break in any service pipe, water main, or connection in said reserved easement, arising out of or resulting from any action or negligence of the petitioner, its employees, agents or business invitees.
