NOTICE TO REMOVE GRAFFITI
Dear Owner and/or Occupant:
We have received a complaint of graffiti on your property. If this complaint is true, we hope
you consider this a friendly reminder to remove the graffiti as soon as possible. It is also
important that you file a report with the Police Department by calling 291-1111 if you have
not already done so.
Unfortunately, in.an urban environment such as ours, graffiti vandalism occurs all too often.
Studies have proven that one of the most successful ways to fight graffiti vandalism is to
remove it as quickly as possible. This graffiti commonly represents the vandalism of youth
street gangs or of juvenile youths called"taggers", who compete with each other for audience
and territory.
The purpose of this letter is to request that you remove the graffiti as soon as possible.
Enclosed is a sheet with graffiti removal tips. You may wish to take photos of the graffiti in
case they are needed by your insurance agent. If you already removed the graffiti, thank you!
A City enforcement officer will check this property sometime after the date on the reverse side
of this;letter. Please take notice that if the graffiti is still present, the inspector will determine
a reasonable time for removal. At the end of this time period if the graffiti still remains, the
City will remove or cover over the graffiti and the cost of this work will be charged to the real
estate taxes as a special assessment against the property.

1 RESOLVED, that upon the petition of Dr. Orwin L. Carter, Acting Vice President for Finance and
2 Administration'Hamline University, per Finance File No. 08-1996, that Taylor Avenue from Snelling
3 Avenue, as widened, to Pascal Street, hereinafter referenced to, is hereby vacated and discontinued as
4 Public Property; subject to the following conditions:

6 1. That this vacation shall be subject to the terms and condition of Chapter 130,
7 codified March 1, 1981, of the Saint Paul Legislative Code as amended. •
8
9 2. That a easement shall be retained by Northern States Power Company's Electric& Gas
10 Divisions over the east 825 feet of said vacated street for the purpose of maintaining
11 their existing facilities.

13 3. That a easement shall be retained by Continental Cablevision over the vacated street
14 to maintain aerial facilities servicing the area, any relocation or adjustments to existing facilities
15 shall be subject to reimbursement by the Petitioner to said utility.

17 4. That a access easement shall be retained by the City of Saint Paul for the ingress and
18 egress of fire prevention apparatuses and parking shall not impede said fire apparatus movement.

20 5. That a easement shall be retained by Saint Paul Water Utility over the north 60 feet of said
21 vacated street, along with a 30 foot wide easement centered on the northerly extention of the
_. centerline of vacated Simpson Street from the south line of Taylor Avenue to 25 feet northerly,
23 all for the purpose of maintaining its existing facilities.
25 6. That a utility easement shall be retained by the City of Saint Paul Department of Public Works
26 over the west 30 feet of said vacated area, except for the east 10 feet of the south 10 feet of the
27 above described area, along with a 30 foot wide utility easement centered on the centerline of
28 that portion Taylor Avenue being vacated from east line of Snelling Avenue, as widened, to the
29 west line of Pascal Street and a 30 foot wide easement centered on the northerly extention of
30 the centerline of vacated Simpson Street from the south line of Taylor Avenue to 25 feet
31 northerly, all for the purpose of maintaining its facilities in said vacated area.

33 7. That the petitioner's, their successors and assigns shall remove all indications of public
34 right of way from the vacated street, including, but not limited to, removing street sections
35 and constructing driveway sections at Taylor & Snelling and Taylor and Pascal, installing
36 and maintaining a stop sign at Taylor& Snelling and the installation of"night watch lights"
37 by Northern States Power Company to replace the removal of the City's two overhead street
38 lights, also, said petitoner shall take over the rights of the existing storm sewer in Taylor Avenue.

Dear Mr. Ortiz:
In response to your FAX memo of August 20, 1996 containing concerns of utilities about the
vacation of Snelling to Pascal, our representative Mr. Steve Erickson of BWBR Architects
contacted all the parties involved and we have reached understandings as follows:
1) Fire prevention - A 25' drive aisle will be maintained.
2) NSP - An easement covering the current gas and electric (both overhead
and ductline will be maintained. The overhead between Snelling and
Asbury on the south side of Taylor will be abandoned by NSP and
the easement will be modified as illustrated on the attached site plan.
3) Continental Cable Vision - The overhead lines currently hung on NSP poles
between Snelling and Asbury on the south side of Taylor will have to be
relocated, as the poles will be removed by NSP. Relocation will need to
be on the north side of Taylor. Hamline University will cooperate in this
relocation as required.
4) Public Works
A) Hamline will make arrangements with NSP to install night watch
lights to replace those removed by NSP.
B) Hamline will construct driveway sections at the intersection of
Snelling and Taylor, and Pascal and Taylor. This construction will
coincide with the complete reconstruction of Taylor to take place
after the construction of proposed new Fieldhouse. Tentative
completion August 1998.
C) Hamline will install and maintain non-illuminated stop sign at the
intersection of Taylor and Snelling.

D) A sewer easement, as illustrated on the attached site plan will be
retained.
E) Hamline University accepts the responsibility for storm sewer in
Taylor Avenue which serves the University.
5) Water Utility-Hamline University accepts the restrictions mandated within the
required water easement, as illustrated on the attached site plan.

WAIVER OF NOTIFICATION
VACATION OF CITY PROPERTY
The undersigned has petitioned the City of Saint Paul to vacate the following property rights:
Taylor Avenue from Snelling Avenue to Pascal Street
and states that it was entitled to receive notification under Chapter 130 of the Saint Paul City Charter
prior to vacating and discontinuing said rights as Public Property.
Notwithstanding failure to receive such notice and concurring with the impending action of the
Saint Paul City Council, the undersigned does hereby waive notification of hearing requirements for
the vacation of said property rights by the City of Saint Paul. Said vacation is for the development
of facilities in connection with Hamline University..
Said vacation hearing before the Saint Paul City Council has been tentatively requested for
September 25, 1996.

The Department of Public Works has completed its review of the above referenced
proposal and has no objections to the vacation subject to the following conditions:
1. Public Works Traffic Lighting Division would have to remove two overhead street
lights. Hamline University would have to make arrangements with NSP to replace
these with "night watch lights" if this area is to remain lit.
2. The university shall be responsible for removing all appearances of a public street,
including , but not limited to, removing the street sections and constructing driveway
sections at Taylor & Snelling and Taylor & Pascal, to the satisfaction of the
Department of Public Works.
3. The university shall be responsible for the installation and maintenance of a stop
sign at the intersection of Taylor and Snelling.
4. A 30 foot utility easement for sewer purposes shall be retained by the Department
of Public Works as designated on the attached drawing and legal description. Note
the 10' x 10' "cut-out" to accommodate the northwest corner of their proposed sports
health and recreation facility. All the usual restrictions shall apply.

SUBJECT: Finance Department File Number 8-1996 Vacate Taylor Avenue
The Water Utility has a twenty-inch water main, two six-inch water mains,three fire hydrants,
and several large water services in that part of Taylor Avenue right-of-way proposed for
vacation. To provide for continued access to our facilities the Utility requires that an easement
be retained over the entire portion of Taylor Avenue proposed for vacation.
Restrictions within the area are as follows:
1. No buildings, structures or trees are permitted within the easement area, or any
temporary structure, material storage, fixture or other objects that may prohibit
normal access to water facilities for maintenance purposes without written
permission from the Water Utility.
2. No change from the existing grade or change in surfacing within the easement
area is permitted without written permission from the Water Utility.
3. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of Water Utility operations, all removal, replacement or
modification costs to restore the petitioner's works shall be borne solely by the
petitioner.
4. That the petitioner, its successors and assigns shall fully indemnify, defend and
save harmless the Board of Water Commissioners, its officers, agents, employees
and servants from all suits, actions or claims which shall arise from any injuries or
damages received or sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any action
or negligence of the petitioner, its employees, agents or business invitees.
