1 RESOLVED, that upon the petition of Gary W. Stockwell, per Department of Technology and Management
2 Services File Number 7-1998, public properties hereinafter described are hereby vacated and discontinued as
3 public property; and, subject to the herein stated exceptions, the easements within those public properties are
4 hereby released.

6 The vacated area is described as follows:

8 That part of MACKUBIN STREET from the North line of Hoyt Avenue to the South line of
9 Idaho Avenue.

11 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
12 Saint Paul Legislative Code as amended, and to the following conditions:
13
14 1. That the petitioner's, their successors and assigns shall pay$500.00 as an administrative fee for this
15 vacation which is due and payable within 60 days of the effective date of this resolution.

17 2. That a permanent utility easement shall be retained on behalf of the City of Saint Paul, Department
18 of Public Works on, over, under and across the following described area to allow access to existing
19 sewer mains;
20
21 That part of Mackubin Street lying southerly of the westerly extension of the north line of Lot
22 1, Block 5 of Edwin M. Ware's Cumberland Addition and northerly of the following
23 described line:
24
25 Beginning at the northwesterly corner of said Lot 1,Block 5 of Edwin M. Ware's
26 Cumberland Addition; thence southwesterly to a point on the west line of Mackubin
27 Street 40.00 feet southerly of the intersection of the westerly extension of said north
28 line of Lot 1, Block 5 with the westerly line of Mackubin Street.

30 and shall be subject to the following conditions:

32 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
33 other objects that will prohibit normal access to utility facilities for maintenance purposes
34 will be permitted within the easement area.

36 b. Improvements in or upon the above described easement that do not prohibit the City from
37 exercising its reserved rights may be allowed by obtaining written permission from the
38 Department of Public Works Sewer Division with the understanding that the restoration and

1 costs of such improvements shall be the sole responsibility of the petitioner, its successors p
and assigns in the event the City exercises its reserved easement rights. Qo � 1

4 c. No change from the existing grade within the easement area will be permitted without written

10 e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless the City
11 of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or claims
12 which shall arise from any injuries or damages received or sustained by any break in any
13 service pipe or connection in said reserved easement arising out of or resulting from any
14 action or negligence of the petitioner, its employees, agents, or business invitees.

16 3. That the petitioners, their successors, and assigns, agree to indemnify, defend and save harmless the
17 City of Saint Paul, its officers, and employees from all suits, actions, or claims of any character
18 brought as a result of injuries or damages received or sustained by any person, persons, or property
19 on account of this vacation or petitioner's use of this property, including but not limited to a claim
20 brought because of any act of omission, neglect, or misconduct of said petitioner or because of any
21 claims or liability arising from any violation of any law or regulation made in accordance with the
22 law, whether by the petitioner or any of their agents or employees
23
24 4. That the petitioners, their successors, and assigns, shall within 60 days of the effective date of this
25 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and
26 shall within the period(s) specified in the terms and conditions of this resolution, comply in all
27 respects with these terms and conditions.

I(we),the undersigned,constituting a majority of the owners(or their legally designated representatives)of the abutting properties,do hereby
petition the Council of the City of Saint Paul to vacate its interests in the property(ies)legally described as follows:
1.The Mackubin extension which is on the west side of Lot 1, of Block 5,
of the Edwin M. Wares Cumberland Plat 1.
2. The Mackubin extension which is on the west side of Lots 2,3,4, and 5 of
Block 5, of the Edwin M. Wares Cumberland Plat 1.
I(we)request this vacation for the following reason(s). I am requesting that the Mackubin extension be
vacated so that part of the vacated land on the west side of Lot 1., of Block 5, of
the Edwin M. Wares Cumberland Plat 1 could be added to Lot 1, of Block 5, of the
Edwin M. Wares Cumberland Plat 1 for the purpose of creating a larger lot which
will be sold. At the present time the Mackubin extension is not being used as a
street. The Tara Hills Condominums have already taken part of the Mackubin
extension and have landscaped it as part of their property.
