1 BE IT RESOLVED, that, upon the petition of Tuan Joseph Pham, as documented in Finance
2 Department File Number 22-1997, public properties hereinafter described are hereby vacated and
3 discontinued as public property: and, subject to the herein stated exceptions, the easements within
4 those public properties are hereby released.

6 The property to be vacated is described as follows:

8 that part of the east-west alley in Block 2, Mackubin and Marshall's Addition lying westerly of
9 the southerly extension of the east line of Lot 10, said Block 2, Mackubin and Marshall's
10 Addition.

12 This vacation shall be subject to the terms and condition of Chapter 130. codified March 1, 1981, of
13 the Saint Paul Legislative Code as amended, and to the following conditions:

15 1. That the petitioner's. their successors and assigns shall pay S500.00 as an administrative fee
16 for this vacation which is due and payable within 60 days of the effective date of this
17 resolution.

19 2. That a permanent utility easement shall be retained within the vacated area to protect the
20 interest of U.S. West Communication, Inc.

22 3. That a permanent utility easement shall he retained within the vacated area to protect the
23 interest of Continental Cablevision, Saint Paul, Inc.

25 4. That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
26 voluntarily on behalf of Northern States Power Company, District Energy St. Paul,
27 Incorporated, MCI Metro, the Water Utility, and the Department of Public Works, made a part
28 hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City, for
29 itself and on behalf of these corporations and departments, waive the right to the utility
30 easements in the vacated area described above.

2 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of
3 any character brought as a result of injuries or damages received or sustained by any person,
4 persons, or property on account of this vacation or petitioner's use of this property, including
5 but not limited to a claim brought because of any act of omission, neglect, or misconduct of
6 said petitioner or because of any claims or liability arising from any violation of any law or
7 regulation made in accordance with the law, whether by the petitioner or any of their agents or
8 employees

10 6. That the petitioner's their successors, and assigns, shall within 60 days of the effective date of
11 this resolution, file with the City Clerk an acceptance in writing of the conditions of this
12 resolution and shall within the period(s) specified in the terms and conditions of this resolution,
13 comply in all respects with these terms and conditions.

Dear Ms. Gasterland:
After discussing the pole building constructed at the rear of these addresses
and which has been constructed on city right-of-way, Henry Ung and Jim
Hehn again reviewed the construction and its position in relation to the
platted alley. The pole shed is constructed substantially on the platted alley.
Public Works would either require the shed to be removed or the alley be
vacated. Even if the alley is vacated, half of it would go to the property to the
south of the alley, and thus the property owner would have to have
arrangements with the abutting property owner to self that property or transfer
that property upon vacation to him.
I understand that the Building Department will proceed with an order to
remove the building, since it was done without permit or proper setbacks and
that this letter will serve as support to that decision.

health being as well. The alley is completely covered through which made it impossible
for trafficking day to day.
Since the police patrol cannot pass by for inspection, the garbages have become the
usual addition to the area. As a result, more crimes have been committed , and our level
of safety is being threatened. If you all recalled of the past fire incident that had occurred
during July of 1995. The fire disaster had damaged our property so severely that the
emotional impact is still inflicting upon our family and its members to this day.
Due to its tightness, and narrow-minded area, the firetrucks were unable to pass through
and as a result, the property was damaged tremendously by the fire. If there were more
spaces to pass through, the firetruck would arrive more promptly. Since the incident that
occurred, I have sent a memo to the proper authority to request for assistance in relating
to this alley. To our disappointment, no favorable respond were replied. Further actions
needed to be taken care of. I met with some neighbors around this area, and talk to them
about this issue. With their generous moral support, and our hearted-spirit, we all came
to a final conclusion about the problem of the back alley. With my own pocket money, I
had to hire contractor for the garbage to be removed; reconstructed the alley by black
topping it; and building a front gate for a more secured place to pass by. (please see
enclosures). Before all of the above factors that were done, I have already asked
permission from the Office of Licensing department, but no solutions were offered.
Therefore, I would like to ask you to look over these request once again.
1) I would like for the gate to remain where it was, and LEGALIZED IT.( as
already mentioned in the letter from Mr. Thomas E. Kuhfeld) (See
Enclosures).
21 A reconstruction of the alley especially the corner of Mackubine St. is needed.
The alley itself needed to be straighten in order to make it easier for the police
to patrol the area. However, if another foregoing fire might strike us again,
the reconstruction of this alley will be utmost vital for everyone concern. The
larger space which we can provide, the better it will be.
One final thought before I conclude this letter. I truly am aware of all the issues that
concern you, the City, and myself a private operator as a whole. I understand that my
decision of building such a gate can be a big nuisance for local citizens whom wish to
pass by the alley. It was only built out for safety reason, and nothing more. If you
choose the second request from the above list, it will be nothing but a pleasure for me to
destroy that gate right away when the City start to open and to reconstruct this DEAD
END VACATED ALLEY.

The purpose of this memo is to respond to your letter in relating to the shed that
was built behind our business property. Enclosed you will find some research articles
that supported the ongoing problems which we all had to face with over the past seven
years. On behalf of my family and the business that we operated, I have submitted some
letters in the past to request for a solution from the City of Saint Paul. Unfortunately,
there was no response that would favor us, and so here 1 am with another letter to re-
explain the circumstances surrounding this problem. The alley is covered with a rounded
fence from one end to the other. Since the other end is connected to the corner of
Markubine St. the area of the dead end Alley behind the parking lot of building #490 has
become nothing but a trash-dumpsite for the public to view. Not only it is absolutely
unsanitary to look at, but it also endangered the safety of my family's and our neighbor's
