2 Department of Technology File Number 14-1997, public properties hereinafter described are hereby
3 vacated and discontinued as public property.

7 Erie Street, from the Easterly extension of the South line of Lot 7, Block 3, Norwood Addition
8 to the City of Saint Paul, to the Southeasterly right-of-way line of Interstate 35E.

10 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981,
11 of the Saint Paul Legislative Code as amended, and to the following conditions:

13 1. That the petitioners, their successors and assigns, shall pay $500.00 as an administrative
14 fee for this vacation which is due and payable within 60 days of the effective date of this
15 resolution.

17 2. That the petitioner shall be responsible for removing snow from the alley entrance and
18 their drive entrance as it accumulates due to City plowing of the remainder of Erie Street.

20 3. That the existing street light on the east side of Erie Street, north of the alley, shall be removed
21 or relocated at the petitioner's expense.

23 4. That the petitioner shall be responsible for the reconstruction of Erie Street where it
24 intersects their private property, to remove all appearances of public right-of-way,
25 including, but not limited to, boulevard work, curbs, drainage structures and signage.
26 All such work shall be done in accordance with City standards and specifications and to
27 the satisfaction of the Department of Public Works.

29 5. That a permanent utility easement shall be retained within the vacated area to protect the
30 interest of Northern States Power Company.

32 6. That the petitioners their successors and assigns, agree to indemnify, defend and save
33 harmless the City of Saint Paul, its officers, and employees, from all suits, actions, or
34 claims of any character brought as a result of injuries or damages received or sustained
