Fischer, as documented in Finance Department 2 File Number 27-1997, public properties hereinafter described are hereby vacated and discontinued 3 as public property; and, subject to the herein stated exceptions, the easements within those public 4 properties are hereby released. 5 6 The property to be vacated is described as follows: 7 8 Hubbard Avenue, from the southerly extension of a party wall in Lot 6 Block 4, Winter's Addition 9 to St. Paul, located 731 feet easterly of the centerline of Victoria Street to the northerly 10 extended east line of Lot 4, Block 3, Joseph R. Weide's Rearrangement of Block 3 and North one 11 half of Block 2, Winter's Addition to St. Paul, Minnesota. 12 13 Also, all that part of Lots 1 and 2, Block 4, Winter's Addition to St. Paul lying within the arc of 14 a 100 foot diameter circle whose radius point is located 10 feet south of the south line of said 15 Block 4 and 50 feet west of the northerly extension of the westerly line of Lot 3, Block 3, Joseph 16 R. Weide's Rearrangement of Block 3 and North one half of Block 2, Winter's Addition to St. Paul, 17 Minnesota. 18 19 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the 20 Saint Paul Legislative Code as amended, and to the following conditions: 21 22 1. That the petitioners, their successors and assigns shall pay $500.00 as an administrative fee for 23 this vacation which is due and payable within 60 days of the effective date of this resolution. 24 25 2. That a permanent utility easement shall be retained on behalf of the City of Saint Paul, Board of 26 Water Commissioners, in that part of the area being vacated which lies west of the extended east 27 line of Lot 19, Block 3, Joseph R. Weide's Rearrangement of Block 3 and North one half of 28 Block 2, Winter's Addition to Saint Paul, Minnesota, subject to the following restrictions: 29 30 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or 31 other object that will prohibit normal access to water facilities for maintenance purposes 32 will be permitted within the easement area. 33 3114422 96?-3g4/ 1 b. No change from the existing grade will be permitted without written permission from the 2 Water Utility. 3 4 c. No change in surfacing within the easement area will be permitted without written • 5 permission from the Water Utility. 6 7 d. The petitioner, its successors and assigns shall fully indemnify, defend and save harmless 8 the Board of Water Commissioners, its officers, agents, employees, and servants from all 9 suits, action or claims which shall arise from any injuries or damages received or 10 sustained by any break in any service pipe, water main, or connection in said reserved 11 easement, arising out of or resulting from any action or negligence of the petitioner, its 12 employees, agents or business invitees. 13 14 3. That a permanent utility easement shall be retained within the vacated area to protect the interest 15 of Northern States Power Company described as follows: 16 17 All that part of vacated Hubbard Avenue which lies westerly of a line drawn 100 feet east 18 of and parallel to the extended east line of Avon Street. 19 20 4. That with the accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily 21 on behalf of US West Communications, Incorporated, Northern States Power Company, District 22 Energy St. Paul, Incorporated, MCI Telecommunications Corporation, Continental Cablevision, 23 The Water Utility, and The Department of Public Works, made a part hereof by this reference and 24 filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these 25 corporations and departments, waives the right to the utility easements in the vacated area 26 described above except as documented herein. 27 28 5. That the City Council of the City of Saint Paul hereby authorizes the proper City Officials to 29 convey to the respective adjoining property owners the vacated property described as follows: 30 31 Also, all that part of Lots 1 and 2, Block 4, Winter's Addition to St. Paul lying within the 32 arc of a 100 foot diameter circle whose radius point is located 10 feet south of the south 33 line of said Block 4 and 50 feet west of the northerly extension of the westerly line of Lot 34 3, Block 3, Joseph R.
