1 BE IT RESOLVED, that, upon the petition of the Housing and Redevelopment Authority of Saint
2 Paul , as documented in Finance Departmetn File Number 11-1995 , public properties hereinafter
3 described are hereby vacated and discontinued as public property: and, subject to the herein stated
4 exceptions, the easements within those public propertries are hereby released.

6 The property to be vacated is described as follows:

8 All that part of the easterly-westerly alley abutting Lots 1,2,3,28,29 & 30 Block 5 Holcombe's
9 Addition to Saint Paul

11 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of
12 the Saint Paul Legislative Code as amended, and to the following conditions:

14 1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
15 for this vacation which is due and payable within 60 days of the effective date of this
16 resolution.

18 2. That the Housing and Redevelopment Authority shall dedicate to the Department of Public
19 Works an easement for alley purposes within 60 days of adoption of this resolution and that
20 said dedication shall be subject to approval of the proposed site plan by the Department of
21 Public Works.

23 3. That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
24 voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
25 Company, District Energy St. Paul, Incorporated, Access Transmission Services Incorporated,
26 Continental Cablevision, The Water Utility, and The Department of Public Works, made a part
27 hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City, for
28 itself and on behalf of these corporations and departments, waive the right to the utility
29 easements in the vacated area described above.

31 4. That the petitioner's their successors, and assigns agree to indemnify, defend and save
32 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of
33 any character brought as a result of injuries or damages received or sustained by any person,
34 persons, or property on account of this vacation or petitioner's use of this property, including
35 but not limited to a claim brought because of any act of omission, neglect, or misconduct of
36 said petitioner or because of any claims or liability arising from any violation of any law or

OF TENTATIVE DEVELOPER STATUS FOR SELBY DALE PARTNERS
FOR REDEVELOPMENT OF THE HRA OWNED PARCELS
KNOWN AS SELBY/DALE REDEVELOPMENT S17E,
SUMMIT-UNIVERSITY DISTRICT 8
AND
AUTHORIZING INITIATION OF APPLICATION TO VACATE A PORTION
OF THE ALLEY ON THE DEVELOPMENT SITE
1 WHEREAS, Selby Dale Partners, a partnership consisting of Selby Area Community
2 Development Corporation and Baumeister & Associates, Inc., submitted a proposal calling for a
3 20,000 square foot office/retail facility on the southwest corners of the Site and a 5,000 square
4 foot bank/retail facility on the northeast corner; and
5
6 WHEREAS, at its meeting on July 27, 1994, the SUPC Board of Directors recommended that
7 Selby Dale Partners be designated tentative developers of the Site; and
8
9 WHEREAS, on August 10, 1994 the HRA Board designated the Selby Dale Partners as
10 tentative developer for a period of 180 days; and
11
12 WHEREAS, on January 24, 1995 the Summit University Planning Council approved a resolution
13 supporting an extension of tentative developer designation for the Selby Dale Partners; and
14
15 WHEREAS, on February 8, 1995, the HRA Board designated the Selby Dale Partners as the
16 tentative developers for an additional period of 180 days; and
17
18 WHEREAS, on July 25, 1995 the Summit-University Council recommended that the Selby Dale
19 Partners be designated as tentative developers for an additional 180 days, and approved
20 initiation of an application for the vacation of a portion of the alley within the development site;
21 and
22
23 WHEREAS, in accordance with HRA Board policy, the Selby Dale Partners have submitted an
24 additional good faith deposit; and
25
26 WHEREAS, the Developer's site plan calls for the vacation of the east-west alley which runs
27 parallel and adjacent to the HRA parcels located between Selby Avenue and Hague; and
28
29 WHEREAS, an easement for access from the alley through the proposed development will be
30 provided by the Selby Dale Partners; and
31
32 WHEREAS, the vacation of the alley will be contingent upon final designation of the Selby Dale

33 Partners as developers for the project, finalization of all required financing for the project and
34 City approval of the final site plan; and
35
36 WHEREAS, it takes approximately three months to process an alley vacation and staff wishes to
37 ensure that the project is not delayed by the process;

39 NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the
40 Housing and Redevelopment Authority of the City of Saint Paul as follows:

42 1. Selby Dale Partners are hereby approved as tentative developers of the HRA parcels on
43 the northeast and southwest corner of Selby and Dale and the northwest and southwest
44 corners of Dale and Hague, known as the Selby/Dale Redevelopment Site for a period
45 of 180 days to finalize all required financing and documentation to proceed with the
46 proposal.

48 2. Tentative developer designation is conditioned upon Selby Dale Partners providing HRA
49 and the Summit-University Planning Council with monthly progress reports.

51 3. If the project does not go forward for any reasons other than Selby Dale Partners'
52 inability to obtain financing, all deposits will be retained to offset services and
53 administrative costs extended on the property.

55 4. That the appropriate HRA Officers are authorized to execute a Petition which will be
56 submitted to the City Clerk, for the vacation of the east-west alley, located between the
57 HRA parcels between Selby and Hague.

Notice is hereby given that the petition of the Housing and
Redevelopment Authority of the City of Saint Paul for the vacation
of that part of the alley adjacent to Lots 28, 29 and 30 and Lots
1, 2 and 3 Block 5 Holcomes Addition to Saint Paul according to the
plat thereof on file and of record in the office of the Register of
Deeds in and for Ramsey County, Minnesota, will be heard and
considered by the Saint Paul City Council at a meeting thereof to
be held in the Council Chambers 3rd Floor in the City Hall and
Court House on the 10th day of September, 1997 at 4 : 30 P.M.
