22 voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power

24 Water Utility, and the Department of Public Works, made a part hereof by this reference and
25 filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these

of the abutting properties, do hereby petition the Council of the City of Saint Paul to vacate its interests
in the property(ies) legally described as follows:
That part of the alley accruing to Block 7 as dedicated in the plat of Humphrey's
Addition to St. Paul, Ramsey County, Minnesota lying southeasterly of the
northeasterly extension of the westerly line of the easterly 33.00 feet of Lot 12,
Block 7, said Humphrey's Addition to St. Paul and lying westerly of the northerly
extension of the center line of Elfelt Street.

Petitioner, East Como Properties, is the sole owner of the property and building
lying southwesterly of the above described alley (see legal description in attached
Exhibit "C"). The alley was dedicated to the public as part of Humphrey's
Addition to St. Paul in 1882 (see Exhibit "A"). The alley is unimproved.
Several of the building's fixtures do presently and have historically encroached
on the alley, including two ramps, a loading dock, stairs, an air-conditioner, and
the concrete surface adjoining the building. Additionally, a portion of the alley
has erroneously been assigned a tax parcel number showing Burlington Northern
Railroad as "owner." Petitioner desires to acquire clear title to the described
alley.
