1 RESOLVED, that upon the petition of The City of St. Paul, per Finance Department File Number 16-1996,
2 public properties hereinafter described are hereby vacated and discontinued as public property; and, subject to
3 the herein stated exceptions, the easements within those public properties are hereby released. The vacated
4 area is described as follows:

6 All that part of C Street as originally platted, which lies westerly and southwesterly of the southerly
7 extension of the westerly right-of-way line of B Street, all in Montville Dayton and Warrens Prospect
8 Addition to St. Paul, Ramsey County, Minnesota

10 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
11 Saint Paul Legislative Code as amended, and to the following conditions:

13 1. That the petitioner, its successors and assigns, agree to indemnify, defend and save harmless the City
14 of Saint Paul, its officers and employees, from all suits, actions, or claims of any character brought as
15 a result of injuries or damages received or sustained by any person, persons, or property on account
16 of this vacation or petitioner's use of this property, including but not limited to a claim brought
17 because of any act of omission, neglect, or misconduct of said petitioner or because of any claims or
18 liability arising from any violation of any law or regulation made in accordance with the law, whether
19 by the petitioner or any of its agents or employees.

21 2. That the petitioner, its successors and assigns, shall within 60 days of the effective date of this
22 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and
23 shall within the period(s) specified in the terms and conditions of this resolution, comply in all
24 respects with these terms and conditions.

I am requesting that a date of April 23, 1997, be set for a Public Hearing to approve the
attached Council Resolution. The purpose of the resolution is to vacate C Street
Southwesterly of B Street, allowing the vacated area to accrue to the Battle Creek
Regional Park.
The utilities and City offices with rights to the subject area have all responded to our
inquiries regarding the proposed vacation. Their responses are with the original
resolution as it is routed for signatures. The resolution is currently in Martha Larson's
office.
I have attached photocopies of the Green Sheet, the Council Resolution, and a map of the
area to be vacated. Please let me know if there is anything else you might need for this.

1 RESOLVED, that upon the petition of The City of St. Paul, per Finance Department File Number 16-1996,
2 public properties hereinafter described are hereby vacated and discontinued as public property; and, subject to
3 the herein stated exceptions, the easements within those public properties are hereby released. The vacated
4 area is described as follows:

6 All that part of C Street as originally platted, which lies westerly and southwesterly of the southerly
7 extension of the westerly right-of-way line of B Street, all in Montville Dayton and Warrens Prospect
8 Addition to St. Paul, Ramsey County, Minnesota

10 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
11 Saint Paul Legislative Code as amended, and to the following conditions:

13 1. That the petitioner, its successors and assigns, agree to indemnify, defend and save harmless the City
14 of Saint Paul, its officers and employees, from all suits, actions, or claims of any character brought as
15 a result of injuries or damages received or sustained by any person, persons, or property on account
16 of this vacation or petitioner's use of this property, including but not limited to a claim brought
17 because of any act of omission, neglect, or misconduct of said petitioner or because of any claims or
18 liability arising from any violation of any law or regulation made in accordance with the law, whether
19 by the petitioner or any of its agents or employees.

21 2. That the petitioner, its successors and assigns, shall within 60 days of the effective date of this
22 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and

The City of Saint Paul hereby petitions to vacate a portion of unimproved "C" Street
southwesterly of "B" Street as shown on the attached map and described as follows:
All that part of C Street as originally platted, which lies westerly and southwesterly of the
southerly extension of the westerly right-of-way line of B Street, all in Montville Dayton
and Warrens Prospect Addition to St. Paul, Ramsey County, Minnesota.
This unimproved roadway right-of-way is being vacated to allow the area to accrue to the
adjoining properties.

1 RESOLVED, that upon the petition of The City of St. Paul, per Finance Department File Number 16-1996,
2 public properties hereinafter described are hereby vacated and discontinued as public property; and, subject to
3 the herein stated exceptions, the easements within those public properties are hereby released. The vacated
4 area is described as follows:

6 All that part of C Street as originally platted, which lies westerly and southwesterly of the southerly
7 extension of the westerly right-of-way line of B Street, all in Montville Dayton and Warrens Prospect
8 Addition to St. Paul, Ramsey County, Minnesota

10 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
11 Saint Paul Legislative Code as amended, and to the following conditions:

13 1. That the petitioner, its successors and assigns, agree to indemnify, defend and save harmless the City
14 of Saint Paul, its officers and employees, from all suits, actions, or claims of any character brought as
15 a result of injuries or damages received or sustained by any person, persons, or property on account
16 of this vacation or petitioner's use of this property, including but not limited to a claim brought
17 because of any act of omission, neglect, or misconduct of said petitioner or because of any claims or
18 liability arising from any violation of any law or regulation made in accordance with the law, whether
19 by the petitioner or any of its agents or employees.

21 2. That the petitioner, its successors and assigns, shall within 60 days of the effective date of this
22 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and
23 shall within the period(s) specified in the terms and conditions of this resolution, comply in all
24 respects with these terms and conditions.
