F C TY OF •AIN PAUL, MINNESOTA Presented By AV ■ Referred To Committee: Date 1 RESOLVED, that upon the petition of The Minnesota Club and The Ordway Music Theatre, per Finance 2 Department File Number 19-1996, public properties hereinafter described are hereby vacated and 3 discontinued as public property; and, subject to the herein stated exceptions, the easements within those 4 public properties are hereby released. 5 6 The vacated area is described as follows: 7 8 West Fourth Street, from the West line of Washington Street to a line 143 feet westerly of and 9 parallel to the West line of Washington Street. 10 11 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of 12 the Saint Paul Legislative Code as amended, and to the following conditions: 13 14 1. That the petitioners, their successors and assigns, shall pay $500.00 as an administrative fee 15 for this vacation which is due and payable within 60 days of the effective date of this 16 resolution. 17 18 2. That a 15 foot wide subterranean easement shall be retained within the vacated area, on behalf 19 of the City of Saint Paul, Department of Public Works, centered on the center line of West 20 Fourth Street between elevations of 50.0 feet and 70.0 feet, City of Saint Paul Datum. 21 22 3. That the existing catch basins and sewer leads on the north and south side of Fourth Street, 23 west of Washington Street, shall become the ownership and responsibility of the petitioner. 24 25 4. That the petitioner shall be responsible for all costs and expenses associated with the removal 26 of the existing city street light and associated conduit. 27 28 5. That the petitioner shall, at its cost and expense, be responsible for removing all appearances 29 of public right-of-way, to the satisfaction of the Department of Public Works. 30 31 6. That the petitioner shall record the necessary pedestrian and vehicular access easements 32 required for all abutting property owners. 33 34 7. That a permanent surface access easement shall be retained within the vacated area to protect 35 the interest of District Energy Saint Paul, Inc. 36 37 38 39 1 8. That a permanent utility easement shall be retained within the vacated area on behalf of the Qi_ 2 City of Saint Paul, Board of Water Commissioners subject to the following restrictions: 3 4 a. No buildings, structures or trees are permitted within the easement area, nor any 5 temporary structure, material storage, fixture or other objects that may prohibit normal 6 access to water facilities for maintenance purposes without written permission from the 7 water utility. 8 9 b. No change from the existing grade is permitted without written permission from the 10 Water Utility. 11 12 c. No change in surfacing within the easement area is permitted without written 13 permission from the Water Utility. 14 15 d. Should it be necessary that the petitioner's works or improvements be removed or 16 damaged as a result of Water Utility operations, all removal, replacement or 17 modification costs to restore the petitioner's works shall be borne solely by the 18 petitioner. 19 20 e. The petitioner, its successors and assigns shall fully indemnify, defend and save 21 harmless the Board of Water Commissioners, its officers, agents, employees and 22 servants from all suits, actions or claims which shall arise from any injuries or damages 23 received or sustained by any break in any service pipe, water main, or connection in 24 said reserved easement, arising out of or resulting from any action or negligence of the 25 petitioner, its employees, agents or business invitees. 26 27 9. That a permanent utility easement shall be retained within the vacated area to protect the 28 interest of Northern States Power Company. 29 30 10. That a permanent utility easement shall be retained within the vacated area to protect the 31 interest of U.S. West Communication, Inc. 32 33 11. That a permanent utility easement shall be retained within the vacated area to protect the 34 interest of Continental Cablevision, Saint Paul, Inc. 35 36 12. That a fire lane be maintained to the satisfaction of the Department of Fire & Safety to allow 37 access to the rear of the Minnesota Club. This lane must be kept clear of obstructions such as 38 trees, curbings, and decorative or ornamental structures. The minimum clear height to be 13.5 39 feet, and the minimum width to be 20 feet. 40 41 13. That the petitioners, their successors and assigns, agree to indemnify, defend and save 42 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of 43 any character brought as a result of injuries or damages received or sustained by any person, 44 persons, or property on account of this vacation or petitioner's use of this property, including 45 but not limited to a claim brought because of any act of omission, neglect, or misconduct of 46 said petitioner or because of any claims or liability arising from any violation of any law or 47 regulation made in accordance with the law, whether by the petitioner or any of their agents or 48 employees. 49 50 51 1 14. The utilities and usual City offices with rights to the area being vacated have all responded to our inquiries regarding the proposed vacation. Fourth Street The Water Utility has a 6-inch water main in that part of West Fourth Street proposed for vacation. To provide for continued access to our facility,the Utility requires an easement be retained over the entire portion of West Fourth Street westerly of the west line of Washington Street. Restrictions within the area are as follows: 1. No buildings, structures or trees are permitted within the easement area, or any temporary structure, material storage, fixture or other objects that may prohibit normal access to water facilities for maintenance purposes without written permission from the Water Utility. 2. No change from the existing grade or change in surfacing within the easement area is permitted without written permission from the Water Utility. 3. Should it be necessary that the petitioner's works or improvements be removed or damaged as a result of Water Utility operations, all removal, replacement or modification costs to restore the petitioner's works shall be borne solely by the petitioner. 4. That the petitioner, its successors and assigns shall fully indemnify, defend and save harmless the Board of Water Commissioners, its officers, agents, employees and servants from all suits, actions or claims which shall arise from any injuries or damages received or sustained by any break in any service pipe, water main, or connection in said reserved easement, arising out of or resulting from any action or negligence of the petitioner, its employees, agents or business invitee. The vacated area will be used for the Rice Park Lobby and as an entrance plazas to the renovated Civic Center. In this regard, we understand that the vacated area must allow sufficient drive area for access by fire and safety equipment. You have indicated that a minimum of twenty-five (25) feet must be maintained for emergency vehicles. It is important to note that the vacated street will continue in City ownership as a part of the Civic Center complex.
