AI J4'i f` Sponsor: RESOLUTION NO. 98-11/25-2, Resolution Authorizing Funding for Westminster/Hoyt Site for Potential House Moves of Homes from the Hoyt-Montana Flood Area, Payne-Phalen District 5 1 WHEREAS, the Hoyt/Montana neighborhood on the City's East Side suffered a devastating 2 flash flood as a result of the July 1, 1997 storm and was subsequently designate a Federal 3 disaster area; and 4 5 WHEREAS, on July 22, 1998, by City Council Resolution 98-658, the Council of the City of 6 Saint Paul, upon recommendation of the May and advise of the Long Range Capital 7 Improvement Budget Committee approved specific budget amendments to proceed with the 8 acquisition and removal of thirty-four (34) houses in the Hoyt-Montana flood area; and 9 10 WHEREAS, to-date the City has either acquired or has executed purchase agreements on 11 twenty-one of the thirty-four (34) homes in the Hoyt-Montana flood area; and 12 13 WHEREAS, in an effort to save good affordable housing stock and maintain the City's tax base, 14 various neighborhoods are looking at the potential of moving some of the houses to sites and/or 15 lots where the houses are compatible with the adjacent properties; and 16 17 WHEREAS, East Side Neighborhood Development Company (ESNDC) has been working to 18 identify potential housing development sites in an effort to replace some of the houses that will 19 be taken for the new 740 York Achievement Plus school; and 20 21 WHEREAS, the Westminster-Hoyt vacant site consists of 52,299 sq/ft or approximately 1.2 22 acres and has the development potential for 8-9 homes; and 23 24 WHEREAS, the preliminary proposal outlines the potential of purchasing the Westminster-Hoyt 25 site and working with ESNDC and the neighborhood to move 8-9 homes from the Hoyt- 26 Montana flood area, providing housing to be offered to both displaced persons from the 740 27 York school development and the Hoyt-Montana families. 28 29 NOW THEREFORE, BE IT RESOLVED that the Housing and Redevelopment Authority of the 30 City of Saint Paul, Minnesota, hereby supports every effort to retain valuable housing stock 31 within the City of Saint Paul, and hereby supports and approves funding for the potential 32 development of Westminster-Hoyt site with the following conditions: 33 34 1. That Rivertown Homes and East Side Neighborhood Development Company (ESNDC) 35 continue to work together and with the neighborhood to finalize this preliminary 36 proposal. 37 2. That any final Agreement with the HRA will require HRA to be in a first mortgage 38 position on the site. 39 40 3. That any Agreement with HRA would require the developer execute a Limited Warranty 41 Deed back to the HRA, which would be recorded in case of any default or breach 42 related to performance or time line performance for completion of development. 43 44 4. That relocation of the homes from the Hoyt-Montana flood area move forward as 45 expeditiously as possible once the proposal has been finalized and all supporting 46 documentation submitted to the HRA/PER. Performance time would require that the 47 neighborhood review be completed by December 31, 1998; costs for acquisition 48 (justified by an appraisal) and firm budget for soil correction and alley improvements be 49 completed by January 31, 1999; site plan review complete and houses identified for 50 moving by March 1, 1999; soil correction work completed by June 1, 1999; basement 51 construction and house moves underway by June 1, 1999; completion of all house 52 moves by August 1, 1999. 53 54 5. That funds for acquisition, soil correction and alley improvements would only be 55 released incrementally at time of closing on the property; completion of soil correction 56 activities; and alley improvements complete, subject to a proper appraisal and 57 competitive bidding for improvements. 58 59 6. That if homes have not been identified to be moved to this site by April 1, 1999, the site 60 will be evaluated by HRA and the community for new housing development. 61 62 7.
