Hegner and Frederick A. Rusch; and 13 14 WHEREAS, Gary F. Hegner and Frederick A. The vacations shall be contingent on the successful completion of the proposed high school in accordance with plans approved by the Department of Public Works and the Saint Zoning Office. 2. The petitioner shall be responsible for the reconstruction of street intersections involved in the vacation, under permits issued by the Department of Public Works, Street Engineering Division. This shall include but not be limited to, curbs, sidewalks, boulevards, drainage structures, and signage, to remove all appearances of public right-of-way, all to the satisfaction of the Department of Public Works. 3. The petitioner shall dedicate, for public right-of-way purposes, cul-de-sacs at Marion and Nebraska, Albemarle and Nebraska, and turnarounds at the alley deadends south of Nebraska in Blocks 15 and 16, Rice Street Villas as shown on the attached "Public Right-of-Way Easement Drawing" for Saint Paul Public Schools and as described in the attached "Roadway Easement Descriptions." 4. A full width permanent utility easement shall be retained on, over, under and across vacated Hoyt Avenue between Matilda and Galtier Streets, on behalf of the City of Saint Paul, Department of Public Works to reserve the right of the City to maintain and operate any sewer in or upon said easement and to enter upon said easement or any portion thereof at any time and from time to time, for the purposes of future construction, reconstruction, inspecting, maintaining, or repairing the same or any part thereof, subject to restrictions as set forth in the attached "Utility Easement Restrictions." 5. PAUL, according to the recorded plat thereof, Ramsey County, Minnesota. Together with a permanent easement for utility purposes over, under and across that part of Lot 1, Block 16, RICE STREET VILLAS, according to the recorded plat thereof, Ramsey County, Minnesota, which lies northeasterly of a line drawn from a point on the north line of said Lot 1, distant 25.00 feet west from the northeast corner of said Lot 1, to a point on the east line of said Lot 1, distant 25.00 feet south from said northeast corner. 7. The petitioner shall be responsible for the proper abandonment of existing public sewer mains in vacated Matilda and Marion Streets to the satisfaction of the Department of Public Works. 8. The petitioner shall pay all costs for the removal and salvage of existing street lights along Marion Street between Arlington and Nebraska Avenues and shall properly abandon the existing conduit and footings all to the satisfaction of the Department of Public Works, Traffic Division. 9. The petitioner shall submit plans for Public Works approval and obtain all required permits for the street modifications where the vacated streets intersect with Arlington and/or Nebraska Avenues as well as the construction of street cul-de-sacs and alley turnarounds required due to this vacation.
