97-819 (2) • Return copy to: Council File # 9 7 419 v Real Estate Division 140 City Hall Green Sheet # 3ct S 3G RESOLUTION CITY OF SAINT PAUL, MINNESOTA Presented By /4 I Referred To Committee: Date 1 BE IT RESOLVED, that, upon the petition of C & E Partnership, as documented in Finance 2 Departmetn File Number 8-97, public properties hereinafter described are hereby vacated and 3 discontinued as public property: and, subject to the herein stated exceptions, the easements within 4 those public propertries are hereby released. 5 6 The property to be vacated is described as follows: 7 8 North Albert Street lying between Pierce Butler Route and the Great Northern Railroad right- 9 of-way. 10 11 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of 12 the Saint Paul Legislative Code as amended, and to the following conditions: 13 14 1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee 15 for this vacation which is due and payable within 60 days of the effective date of this 16 resolution. 17 18 2 That a permanent utility easement shall be retained on, over, under and across the vacated area 19 on behalf of the City of Saint Paul, Department of Public Works to reserve the right of the 20 City to maintain and operate any sewer in or upon said easement and to enter upon said 21 easement or any portion thereof at any time and from time to time, for the purposes of future 22 construction, reconstruction, inspecting, maintaining or repairing the same or any part thereof 23 and shall be subject to the following conditions: 24 25 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or 26 any other objects that will prohibit normal access to utility facilities for maintenance 27 purposes will be permitted within the easement area. 28 29 b. Improvements in or upon the above described easement that do not prohibit the City 30 from exercising its reserved rights may be allowed by obtaining written permission 31 from the Department of Public Works with the understanding that the restoration and 32 costs of such improvements shall be the sole responsibility of the petitioner, its 33 successors and assigns in the event the City exercises its reserved easement rights. 34 35 c. No change from the existing grade within the easement area will be permitted without 36 written permission from the Department of Public Works. . 1 • d. No change in surfacing within the easement area will be permitted without written 2 permission from the Department of Public Works. �' 3 4 e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless 5 the City of Saint Paul, its officers, agents, employees, and servants from all suits, 6 actions, or claims which shall arise from any injuries or damages received or sustained 7 by any break in any service pipe or connection in said reserved easement arising out of 8 or resulting from any action or negligence of the petitioner, its employees, agents, or 9 business invitees. 10 11 3. That a permanent utility easement shall be retained on, over, under and across the vacated area 12 on behalf of the Saint Paul, Board of Water Commissioners to reserve the right of the Water 13 Utility to maintain and operate any water main in or upon said easement and to enter upon said 14 easement or any portion thereof at any time and from time to time, for the purposes of future 15 construction, reconstruction, inspecting, maintaining or repairing the same or any part thereof 16 and shall be subject to the following restrictions: 17 18 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or 19 other object that will prohibit normal access to water facilities for maintenance purposes 20 will be permitted within the easement area,. 21 22 b. Should it be necessary that the petitioner's works or improvements be removed or 23 damaged as a result of Water Utility operations, all removal, replacement or 24 modification costs to restore the petitioner's works shall be borne solely by the 25 petitioner. 26 27 c. No change in surfacing within the easement area will be permitted without written 31 permission from the Water Utility. 32 33 e. There is an an existing 12" sanitary sewer serving properties on both sides of Albert. For the protection of this sewer we will need to retain an easement over the south 20 feet of the proposed area to be vacated. See attached sewer records. Therefore, the Department of Public Works has no objections to the vacation subject to the following: 1 . The petitioner shall pay all costs and expenses for the reconstruction of the intersection of vacated Albert and Pierce Butler to properly eliminate the appearance of a public thoroughfare, including but not limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street sign removal, all to the satisfaction of the Department of Public Works. 2. Tschida Unit Supervisor DATE: May 19, 1997 SUBJECT: Finance Department File Number 8-97 The Water Utility has a 6-inch water main and fire hydrant in that part of North Albert Street proposed for vacation. To provide for continued access to our facility, the Utility requires an easement be retained over the entire portion of North Albert Street northerly of the north line of Pierce Butler Route. Restrictions within the area are as follows: 1. No buildings, structures or trees are permitted within the easement area, or any temporary structure, material storage, fixture or other objects that may prohibit normal access to water facilities for maintenance purposes without written permission from the Water Utility. 2. No change from the existing grade or change in surfacing within the easement area is permitted without written permission from the Water Utility. 3. Should it be necessary that the petitioner's works or improvements be removed or damaged as a result of Water Utility operations, all removal, replacement or modification costs to restore the petitioner's works shall be borne solely by the petitioner. 4. That the petitioner, its successors and assigns shall fully indemnify, defend and save harmless the Board of Water Commissioners, its officers, agents, employees and servants from all suits, actions or claims which shall arise from any injuries or damages received or sustained by any break in any service pipe, water main, or connection in said reserved easement, arising out of or resulting from any action or negligence of the petitioner, its employees, agents or business invitee. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee 15 for this vacation which is due and payable within 60 days of the effective date of this 16 resolution. 17 18 2. That a permanent utility easement shall be retained on, over, under and across the vacated area 19 on behalf of the City of Saint Paul, Department of Public Works to reserve the right of the 20 City to maintain and operate any sewer in or upon said easement and to enter upon said 21 easement or any portion thereof at any time and from time to time, for the purposes of future 22 construction, reconstruction, inspecting, maintaining or repairing the same or any part thereof 23 and shall be subject to the following conditions: 24 25 a. No buildings, structures,trees or any temporary structure, material storage, fixture, or 26 any other objects that will prohibit normal access to utility facilities for maintenance 27 purposes will be permitted within the easement area. 28 29 b. Improvements in or upon the above described easement that do not prohibit the City 30 from exercising its reserved rights may be allowed by obtaining written permission 31 from the Department of Public Works with the understanding that the restoration and 32 costs of such improvements shall be the sole responsibility of the petitioner, its 33 successors and assigns in the event the City exercises its reserved easement rights. 34 35 c. No change from the existing grade within the easement area will be permitted without 36 written permission from the Department of Public Works. 1 d. No change in surfacing within the easement area will be permitted without written 0 2 permission from the Department of Public Works. 3 4 e.
