1 BE IT RESOLVED, that, upon the petition of the State of Minnesota - Department of Administration, as
2 documented in Finance Department File Number 21-1997, public properties hereinafter described are hereby
3 vacated and discontinued as public property:

5 THIRTEENTH STREET from the easterly line of Robert Street to the westerly line of Jackson Street

7 This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the
8 Saint Paul Legislative Code as amended, and to the following conditions:
9
10 1. That the petitioners, their successors and assigns shall pay $500.00 as an administrative fee for
11 this vacation which is due and payable within 60 days of the effective date of this resolution.
12
13 2. That the petitioner shall pay all costs and expenses for any reconstruction of the ends of the
14 vacated street to properly eliminate the appearance of a public thoroughfare in accordance with
15 the plans approved by the City of Saint Paul.
16
17 3. That a permanent fifteen foot (15')wide subterranean easement, centered on the centerline of the
18 street to be vacated, shall be retained between elevations 70 and 85 City datum, within the vacated
19 area, on behalf of the Department of Public Works for the protection of the existing sewer.
20
21 4. A permanent fifteen foot (15') wide surface easement, centered on the centerline of the street,
22 shall be retained on, over and across the vacated area, from the west line of Jackson Street to 180
23 feet westerly, on behalf of the City of Saint Paul, Department of Public Works, for the access to
24 and maintenance of the existing sewer, subject to the following conditions:
25
26 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
27 any other objects that will prohibit normal access to utility facilities for maintenance
28 purposes other than those approved by Permit Number 171000, dated February 2, 1998, will
29 be permitted within the easement area.

31 b. Improvements in or upon the above described easement other than those approved by Permit
32 Number 171000, dated February 2, 1998, that do not prohibit the City from exercising its
33 reserved rights may be allowed by obtaining written permission from the Department of
34 Public Works Sewer Division with the understanding that the restoration and costs of such
35 improvements shall be the sole responsibility of the petitioner, its successors and assigns
;6 in the event the City exercises its reserved easement rights.

1 c. No change of grade other than that approved by Permit Number 171000, dated February 2,
2 1998, issued by the City of Saint Paul, will be permitted within the easement area without
3 written permission from the Department of Public Works.

5 d. No change in surfacing other than that approved by Permit Number 171000, dated February
6 1998, issued by the City of Saint Paul, will be permitted within the easement area without
7 written permission from the Department of Public Works.

9 e. Petitioner shall be responsible for its own actions with respect to any injuries or damages•
10 received or sustained by any person, persons, or property on account of this vacation or
11 petitioner's use of this property, including but not limited to a claim brought because of
12 any act of omission, neglect, or misconduct of said petitioner or because of any claims or
13 liability arising from any violation of any law or regulation made in accordance with the
14 law, whether by the petitioner or any of their agents or employees.

16 5. That a twenty foot(20') wide utility easement, along the northwesterly twenty feet (20') of the
17 Right-of-Way of Thirteenth Street from Robert Street to Jackson Street, shall be retained under
18 the area to be vacated for the benefit of District Energy St. Paul, Inc., to maintain, inspect,
19 repair or reconstruct the existing utility or any part thereof and to enter upon said easement or
20 any portion at any time and from time to time.

22 6. Petitioner shall be responsible for its own actions with respect to any injuries or damages
23 received or sustained by any person, persons, or property on account of this vacation or
24 petitioner's use of this property, including but not limited to a claim brought because of any act

1 BE IT RESOLVED, that, upon the petition of the State of Minnesota - Department of Administration, as
2 documented in Finance Department File Number 21-1997, public properties hereinafter described are hereby
3 vacated and discontinued as public property:

5 THIRTEENTH STREET from the easterly line of Robert Street to the westerly line of Jackson Street
6
7 This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the
8 Saint Paul Legislative Code as amended, and to the following conditions:
9
10 1. That the petitioners, their successors and assigns shall pay $500.00 as an administrative fee for
11 this vacation which is due and payable within 60 days of the effective date of this resolution.
12
13 2. That the petitioner shall pay all costs and expenses for any reconstruction of the ends of the
14 vacated street, to property eliminate the appearance of a public thoroughfare, including but not
15 limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street sign removal, all
16 to the satisfaction of the City of Saint Paul, Department of Public Works.

18 3. That the petitioner shall pay all costs and expenses related to the removal of two Nema head street
19 lights which will be removed from wood NSP poles by the Department of Public Works.

21 4. That a fifteen foot (15')sewer easement, centered on the centerline of the street to be vacated,
22 shall be retained on, over, under and across the vacated area on behalf of the City of Saint Paul,
23 Department of Public Works to maintain, inspect, repair or reconstruct the existing sewer or any
24 part thereof and to enter upon said easement or any portion thereof at any time and from time to
25 time, subject to the following conditions:

27 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
28 any other objects that will prohibit normal access to utility facilities for maintenance
29 purposes will be permitted within the easement area.

31 b. Improvements in or upon the above described easement that do not prohibit the City from
32 exercising its reserved rights may be allowed by obtaining written permission from the
33 Department of Public Works Sewer Division with the understanding that the restoration and
34 costs of such improvements shall be the sole responsibility of the petitioner, its
35 successors and assigns in the event the City exercises its reserved easement rights.

1 c. No change from the existing grade within the easement area will be permitted without
2 written permission from the Department of Public Works.

4 d. No change in surfacing within the easement area will be permitted without written
5 permission from the Department of Public Works.

7 e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless the
8 City of Saint Paul, its officers, agents, employees, and servants from all suits, actions,
9 or claims which shall arise from any injuries or damages received or sustained by any break
10 in any service pipe or connection in said reserved easement arising out of or resulting
11 from any action or negligence of the petitioner, its employees, agents, or business
12 invitees.

14 5. That a permanent utility easement shall be retained within the vacated area on behalf of the City
15 of Saint Paul, Board of Water Commissioners subject to the following restrictions:
16
17 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
18 other object that will prohibit normal access to water facilities for maintenance purposes
19 will be permitted within the easement area, without written permission from the Water
20 Utility.

22 b. No change from the existing grade nor any change in surfacing will be permitted without
23 written permission from the Water Utility.

25 c. Should it be necessary that the petitioner's works or improvements be removed or damaged as
26 a result of Water Utility operations, all removal, replacement or modification costs shall
27 be borne solely by the petitioner.

29 d. The petitioner, its successors and assigns shall fully indemnify, defend and save harmless
30 the Board of Water Commissioners, its officers, agents, employees, and servants from all
31 suits, action or claims which shall arise from any injuries or damages received or
32 sustained by any break in any service pipe, water main, or connection in said reserved
33 easement, arising out of or resulting from any action or negligence of the petitioner, its
34 employees, agents or business invitees.

36 6. That a twenty-foot(20') wide surface access and subsurface easement shall be retained within the
37 area to be vacated to protect the interest of District Energy St. Paul, Inc. Location of said
38 easement is described as follows:
39 Beginning at the point of intersection of the northwesterly side of Thirteenth Street with
40 the east side of Robert Street, thence northeasterly along the northwesterly side of
41 Thirteenth Street to the westerly side of Jackson Street; thence southeasterly along the
42 extended westerly line of Jackson Street a distance of twenty (20) feet; thence
43 southwesterly along a line twenty (20) feet southeasterly of and parallel with the
44 northeasterly line of Thirteenth Street to the extended easterly line of Robert Street;
45 thence northwesterly to the point of beginning.

47 7. That the petitioner agrees to maintain a minimum of two feet (2') of cover over the direct buried
48 facilities of District Energy St. Paul, Inc. within the above-described surface access and
49 subsurface easement area unless special structure provisions are installed to protect the shallow
50 depth.

1 8. That the petitioner's their successors, and assigns agree to indemnify, defend and save harmless
2 the City of Saint Paul, its officers, and employees from all suits, actions, or claims of any
3 character brought as a result of injuries or damages received or sustained by any person, persons,
4 or property on account of this vacation or petitioner's use of this property, including but not
5 limited to a claim brought because of any act of omission, neglect, or misconduct of said
6 petitioner or because of any claims or liability arising from any violation of any law or
7 regulation made in accordance with the law, whether by the petitioner or any of their agents or
8 employees.

10 9. That the petitioner's their successors, and assigns, shall within 60 days of the effective date of
11 this resolution, file with the City Clerk an acceptance in writing of the conditions of this
12 resolution and shall within the period(s) specified in the terms and conditions of this
13 resolution, comply in all respects with these terms and conditions.

The Department of Public Works has completed a review of the above referenced proposal
and has no objects, subject to the following comments and/or requirements.
1. The petitioner shall pay all costs and expenses for any reconstruction of the ends of the
vacated street, to properly eliminate the appearance of a public thoroughfare, including but not
limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street sign removal, all

retained on, over and across the vacated area, from the west line of Jackson Street to 180 feet
westerly, on behalf of the Department of Public Works, for the access to, and maintenance of
the existing sewer.
