3 BE IT RESOLVED, that, upon the petition of the Saint Paul Port Authortiy, as documented in
4 Technology Department File Number 1997-26, the public right of way hereinafter described is hereby
5 vacated and discontinued as public property and, subject to the herein stated exceptions.

11 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
12 Saint Paul Legislative Code as amended, and to the following conditions:

15 1. That the petitioner's, their successors and assigns shall pay$500.00 as an administrative fee for
16 this vacation which is due and payable within 60 days of the effective date of this resolution.

18 2. That the following conditions sustained by the Petitioner, their successors and assigns were
19 acknowledged by the City of Saint Paul, Department of Public Works and as outlined in
20 Exhibit`B":

22 a) The plat describing the property affected by this vacation will remain in place, that no
23 re-platting of the property will occur.

25 b) That permanent right of way easements will be dedicated in the name of the City of
26 Saint Paul as described Exhibit "C" , said exhibit describes the property to be dedicated
27 in both the torrens and abstract form as noted in said exhibit.

30 3. That the petitioner's their successors, and assigns agree to indemnify, defend and save harmless
31 the City of Saint Paul, its officers, and employees from all suits, actions, or claims of any
32 character brought as a result of injuries or damages received or sustained by any person, persons,
33 or property on account of this vacation or petitioner's use of this property, including but not
34 limited to a claim brought because of any act of omission, neglect, or misconduct of said
35 petitioner or because of any claims or liability arising from any violation of any law or regulation
36 made in accordance with the law, whether by the petitioner or any of their agents or employees.

4 this resolution, file with the City Clerk an acceptance in writing of the conditions of this

This is a note to the file pertaining to the vacation of City right of way in connection with
the construction Minnesota Mutual Building on the block bounded by Minnesota, Sixth,
Seventh Place and Robert .
In attendance were representatives for the vacation petitioners, the Saint Paul
Port Authority, Minnesota Mutual and their project consultants.
In attendance for the City of Saint Paul was City Engineer, Ton Kuhfeld, Map & Permits
Technician Linda Dickhut and Real Estate Technician Juan Ortiz.
It was requested by the City that the petitioner re-plat the block and dedicate the proper
right of way needed in the new plat.
The petitioner said that this was not agreed on previously and asserted that the existing
plat remain in place and they would convey any right of way easements necessary from
the existing plat.
The City hesitantly agreed. Since it didn't detriment the City or the petition, the City
could not demand the petitioner to re-plat the property.

PETITION FOR VACATION OF
VARIOUS STREETS AND ALLEY AROUND
BLOCK 4 CITY OF SAINT PAUL WHICH INCLUDES
EAST SIXTH STREET, EAST SEVENTH PLACE,
ROBERT STREET AND MINNESOTA STREET
TO: THE HONORABLE COUNCIL PRESIDENT
AND
MEMBERS OF THE CITY COUNCIL
YOUR PETITIONER, the Port Authority of the City of Saint Paul
respectfully states and alleges that we are the fee owners of record of the real
estate abutting East Sixth Street, East Seventh Place, Robert Street and
Minnesota.
The proposed area to be vacated is colored in red on the attached
Exhibit.
The proposed vacation is required for the development of the Minnesota
Mutual Insurance Company expansion.
Your Petitioner herein requests that there be no assessment of
compensation to Petitioner on account of the value of the accrual; and that in
lieu of a bond, and by acceptance of the terms of the vacation, the Port Authority
agrees to fully indemnify, defend and save harmless the City of Saint Paul and
the Board of Water Commissioners, its officers, agents, employees and servants
from all suits, actions or claims which may arise from any injuries or damages
received or sustained by a break in any service pipe, water main, or connection
in said vacated areas, arising out of or resulting from any action or negligence of
the Petitioner, its employees, agents or business invitees. Your Petitioner
herein further requests that the provisions of the Saint Paul legislative Code,
Chapter 130, pertaining to the reservation of easements be waived upon
presentation to and approval by the City Council of Saint Paul.
We request Certificates of Intended Non-Use over the vacated area for
electrical, gas, water, sanitary sewer, storm sewer, U. S. West, Cable television,
and any other parties interest.
WHEREFORE, your Petitioner respectfully requests your Honorable Body
to vacate various streets and alley around Block 4 City of Saint Paul which
includes East Sixth Street, East Seventh Place, Robert Street and Minnesota
Street for the purposes above-stated.
