Lain's Rearrangement of part of Block 4, Leech's Addition lying Westerly of 6 the Northwesterly line of West Seventh Street; and 7 8 That part of Lot 1, C. L. Lain's Rearrangement of part of part of Block 4, Leech's Addition 9 lying East of a line perpendicular to and intersecting the Northwesterly line of West Seventh to Street at a point 5 feet Southwesterly of its intersection with the Northerly line of said Lot 1; 11 and 12 13 WHEREAS, the above referenced vacation was subject to certain conditions including the dedication 14 by the petitioner of access and drainage easements and a right-of-way easement for a turn lane across 15 part of the east ten feet of Lot 1, Block 4. CFA 90-326. be hereby amended as follows: Condition i . shall be amended to read: That, in lieu of the S500.00 administrative fee for this vacation, otherwise due and payable 29 within 60 days of the effective date of this resolution. the petitioner shall dedicate to the City 30 of Saint Paul. for the purpose of widening Smith Avenue to accommodate a turn lane. a 31 permanent right-of-way easement over and across the following described lands: 33 all that part of the east seven feet of Lot 1. That the petitioner shall provide an access easement, in accordance with a site plan, 5 which shall be filed with and subject to approval by Saint Paul Traffic Engineering, 6 running from West Seventh Street, through its proposed parking lot, to that portion of 7 the alley in Block 4, Leech's Addition to Saint Paul not subject to this vacation. Failure 8 by the petitioner to secure approval of its site plan by Saint Paul Traffic Engineering will 9 render this resolution null and void. 10 11 3. That the petitioner shall provide a public drainage easement to be approved by Saint 12 Paul Sewer Engineering and in accordance with an approved site plan. 13 14 4. That the petitioner shall submit to the Department of Public Works a survey showing 15 and describing the above referenced right-of-way dedication, access and drainage 16 easements. 17 18 5. That the petitioner shall be responsible for reconstructing the intersection of that portion 19 of the alley to be vacated with adjacent West Seventh Street to remove all appearances 20 of public right-of-way. This shall include, but not be limited to, new curbing, sidewalks, 21 boulevards, drainage structures and signage, constructed under permits, all to the 22 satisfaction of the Department of Public Works. 23 24 6. That a permanent utility easement shall be retained for electric power line purposes in 25 that part of the area to be vacated lying Westerly of a line 15 feet Easterly of and 26 parallel to the Southerly extension of the Westerly line of Lot 3, said Block 4 to protect 27 the interests of Northern States Power. 28 29 7. That a permanent sub-surface utility easement shall be retained within the vacated area 30 to protect the interest of U.S. West Communication, Inc. 31 32 8. That the petitioner its successors, and assigns, shall within 60 days of the effective date 33 of this resolution, file with the City Clerk an acceptance in writing of the conditions of 34 this resolution and shall within the period(s) specified in the terms and conditions of this 35 resolution, comply in all respects with these terms and conditions. 36. 37 9. That, the petitioner, its successors, and assigns agree to indemnify, defend and save 38 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or 39 claims of any character brought as a result of injuries or damages received or sustained 40 by any person, persons, or property on account of this vacation or petitioner's use of this 41 property, including but not limited to a claim brought because of any act of omission, 42 neglect, or misconduct of said petitioner or because of any claims or liability arising from 43 any violation of any law or regulation made in accordance with the law, whether by the 44 petitioner or any of its agents or employees 45 ;F ..? r4, : < v.. . Following are guidelines for initiating vacations by petition of the owners of property abutting such public lands. A petition to vacate public lands may be filed by a majority of the owners of property abutting the lands to be vacated. A. • A majority shall mean a number greater than 50%. This implies that, for instance, if there are only two owners of property abutting lands to be vacated, then both must sign the petition. B. Owners shall mean current owners, including contract purchasers. 1. For properties owned by two or more joint tenants, all joint tenants must sign. 2. For properties owned by partnerships, one of the partners must sign. 3.
