That the vacation be subject to all the terms and conditions of Chapter 130, codified 35 March 1, 1981, of the Saint Paul Legislative Code, as amended. 36 37 2. That the petitioners, their successors and assigns shall pay a $500 administrative fee 38 for this vacation, which is due and payable within 60 days of the publication date of 39 this resolution. ,' 1 3. That a 30-foot permanent sewer easement shall be retained on behalf of the City of 2 Saint Paul, Department of Public Works centered along the center line of vacated 3 Arundel Street and shall be subject to the following conditions: 4 5 a. No buildings, structures or trees are permitted within the easement area nor 6 any temporary structure, material storage, fixture or other objects that will GA 7 prohibit normal access to sewer facilities for maintenance proposes. - - 8 9 b. That the petitioners, their successors and assigns shall indemnify, defend and 16 save harmless the City of Saint Paul, its officers, agent, employees and 17 servants from all suits, actions, or claims which shall arise from any injuries 18 or damages received or sustained by any break in any service pipe or 19 connection in said reserved easement arising out of or resulting from any 20 action or negligence of the petitioners, their employees, agents, or business 21 invitees. 22 23 4. That a permanent Water Utility Easement be retained on behalf of the City of Saint 24 Paul, Board of Water Commissioners on, over,under and across the westerly 33 feet 25 of vacated Arundel Street and shall be subject to the following conditions: 26 27 a. No buildings, structures, or trees are permitted within the easement area nor 28 any temporary structure, material storage, fixture or other objects that will 29 prohibit normal access to water facilities for maintenance purposes. 30 31 b. No change from the existing grade is permitted without written permission 32 from the Water Utility. 33 34 c. No change in surfacing within the easement area is permitted without written 35 permission from the Water Utility. 36 37 d. That the petitioners, their successors and assigns shall fully indemnify, defend 38 and save harmless the Board of Water Commissioners, its officers, agents, 39 employees, and servants from all suits, actions or claims which shall arise from 40 any injuries or damages received or sustained by any break in any service 41 pipe, water main or connection in said reserved easement, arising out of or 42 resulting from any action or negligence of the petitioner, its employees, 43 agents or business invitees. 44 45 5. That a permanent easement be retained, on behalf of the City of Saint Paul, 46 Department of Public Works, to provide an area for snow storage and an emergency 47 vehicle access and turnaround on, over and across the southerly 21 feet of the 48 easterly one-half of vacated Arundel Street subject to the following conditions: 49 1 a. That this area will be used as a snow storage area for any plowing done on , the unvacated portion of Arundel Street south of the alley south of Selby 3 Avenue. 4 5 b. That the petitioners, their successors and assigns shall remove all snow which 6 may accumulate in this snow storage area either as a result of snowfall or the 7 plowing of the unvacated portion of Arundel Street south of the alley south rs• 8 of Selby Avenue. Cr, 9 10 c. All accumulated snow shall be removed within 24 hours of snowfall and 11 plowing. 12 13 d. That the petitioners, their successors and assigns shall pay all costs and C.3 14 expenses for all "No Parking" and "Emergency Vehicle Only" signs that are q 15 required in this easement area subject to the approval of the Department of 16 Public Works and the Department of Fire & Safety Services. 17 18 6. That the petitioner,the Port Authority of the City of Saint Paul,shall dedicate 19 a permanent easement for an emergency vehicle access and turnaround area, 20 in a form and manner to be approved by the City Attorney, and subject to the 21 approval of the Department of Public Works and the Department of Fire & 22 Safety Services. This easement shall be subject to the following conditions: 23 24 a. That the access and turnaround area easement be described as follows: 25 26 All that part of Lot 13 lying southerly of a line drawn from point "A" 27 on a line 15 feet east of and parallel to the west line of said lot 13, to 28 point on the South line of said lot 13. Point "A" being located on said 29 parallel line 7 feet north of the south line of said Lot 13 and Point "B" 30 being located on the south line of said Lot 13, 22 feet east of the 31 southwest corner thereof, all in Cochran's Subdivision of and Addition 32 to Block 11 of Woodland Park Addition. 33 34 b. That the petitioners, their successors and assigns shall keep this area 35 clear of all debris and accumulated snow at all times. 36 37 7. That the petitioner, the Port Authority of the City of Saint Paul, shall dedicate 38 a permanent easement for snow storage and an emergency vehicle access and 39 turnaround on, over and across the southerly 21 feet of the westerly 15 feet 40 of Lot 13, Cochran's Subdivision of and Addition to Block 11 of Woodland 41 Park Addition. This easement shall be subject to the following condition: 42 43 a. That the petitioners, their successors and assigns shall keep this area 44 clear of all debris and accumulate snow at all times. 45 46 8. That the petitioners, their successors and assigns shall construct a barricade 47 across vacated Arundel Street and a part of Lot 13, Cochran's Subdivision at 48 a time and in the manner determined by the Department of Public Works and 49 the Department of Fire & Safety Services. The location of this barricade 50 shall be along the following described line: 51 -l1(o 1 Beginning on a line 14 feet east of and parallel to point 7 feet north 2- , of the south line of Lot 13, Cochran's Subdivision and Addition to 3 Block 11, Woodland Park Addition; thence north along said parallel 4 line, a distance of 13 feet, thence left along a line parallel to the south 5 line of said lot 13 a distance of 41 feet; thence left along a line 41 feet 6 west of and parallel to the east line of vacated Arundel Street a 7 distance of 15 feet and there terminating. 9 This barricade shall be constructed of an appropriate material which will 3.0 prevent general vehicle to and from Block 10,Woodland Park Addition r+ 1 and Block 11, Cochran's s Subdivision, except that this barricade along its line 12 parallel to the alley in said Block 10 and Block 11 shall have a breakaway 13 feature which will permit emergency vehicle access. r4 R5 9. That the petitioners, their successors and assigns shall dedicate a 20-foot 16 permanent easement for fire-lane purposes along either side of the center line 17 of vacated Arundel Street. This easement shall be conveyed in a form and 18 manner to be approved by the City Attorney and the City of Saint Paul, Fire 19 & Safety Services Division and shall be conveyed to the City within 60 days 20 of the publication date of this resolution. 21 22 10. That a permanent easement be retained within the vacated area to protect the 23 interests of Northern States Power Company. 24 25 11. That a permanent easement be retained within the vacated area to protect the 26 interests of Continental Cablevision. 27 28 12. That no access shall be permitted from the vacated area of Arundel Street or 29 the proposed parking lot adjoining the vacated area to the alley in Block 10, 30 Woodland Park Addition or to the alley in Block 11, Cochran's Subdivision 31 of and Addition to Block 11, Woodland Park Addition. 32 33 13. That the petitioners, their successors and assigns, by acceptance of the terms 34 and conditions of this vacation, agree to indemnify, defend and save harmless 35 the City of Saint Paul, its officers and employees from all suits, actions or 36 claims of any character brought as a result of injuries or damages received or 37 sustained by any person, persons, or property on account of this vacation, or 38 petitioner's use of this property, including but not limited to a claim brought 39 because of any act of omissions, neglect or misconduct of said petitioner or 40 because of any claims or liability arising from any violation of any law or 41 regulation made in accordance with the law whether by the petitioner or any 42 of its agents or employees. All accumulated snow shall be removed within 24 hours of snowfall and 11 plowing. 12 13 d. That the petitioners, their successors and assigns shall pay all costs and 14 expenses for all "No Parking" and "Emergency Vehicle Only" signs that are 15 required in this easement area subject to the approval of the Department of 16 Public Works and the Department of Fire & Safety Services. 17 18 6. That the petitioner, the Port Authority of the City of Saint Paul,shall dedicate 19 a permanent easement for an emergency vehicle access and turnaround area, 20 in a form and manner to be approved by the City Attorney, and subject to the 21 approval of the Department of Public Works and the Department of Fire & 22 Safety Services. EXECUTIVE SUMMARY Starting in 1981 with receipt of a Urban Development Action Grant, the City of Saint Paul/HRA and the Port Authority together invested millions of dollars in the Selby- Western projects. In 1987, the HRA entered into a Reimbursement and Maintenance Agreement with the developers of the projects to develop parking, and eventually invested about $1 million in parking facilities at the northeast and southwest corners of Selby and Western Avenues. To develop the required parking, Arundel Street south of Selby Avenue and north of the alley, was vacated and developed as a comprehensive parking lot. Subsequently, each of the developers defaulted on the Port Authority and HRA financing, and the Port Authority repossessed the properties. Since the defaults, HRA and Port Authority staff have been unable to rationalize the operation and maintenance of the parking lots. Now a potential buyer - Ted Glasrud and Associates - has come forward with a cash offer to the Port to purchase the commercial portion of Blair Arcade and all of Hill Plaza, and an offer to the HRA to purchase the parking it owns to the west of Hill Plaza. The offer is contingent on the permanent vacation of Arundel Street. After considerable public investment, and years of effort trying to make a shared parking arrangement work, the HRA has an opportunity to end its public involvement in the Selby-Western projects and bring these defaulted structures back into productive use and on to the tax rolls, if it can permanently vacate Arundel Street and sell the parking lot west of Arundel to a private owner. While the HRA will be considering the sale of the lots it owns to Ted Glasrud Associates, Inc., the City Council needs to consider the permanent vacation of Arundel Street. The appropriate City agencies and outside organizations have been contacted regarding their support or opposition to vacation, and though some are concerned to maintain easements, wide support has been expressed for the permanent vacation. II. File No. 12-1992 Dear Mr. McCann: This letter is in response to your letter dated September 3, 1992 regarding the permanent vacation of Arundel Street from Selby Avenue south to the alley in Block 11, Woodland Park. The Department of Planning and Economic Development reviewed and approved the proposed vacation in 1988 on condition that there be a reversionary clause allowing for the vacated right of way to be retained by the City and returned to a public street if a parking ramp were ever built for the Selby-Western projects sufficiently large to eliminate the need for the parking developed in the vacated portion of Arundel Street. Since that time PED has reevaluated its position on a reversionary clause and now supports the permanent vacation of Arundel Street, free and clear of any provision for returning the street to a public right of way. We feel that the construction of a parking ramp is extremely unlikely, and feel that it is a mistake to obligate future Boards of Commissioners of the HRA to make an expenditure which they may not be willing or able to make in the future. While most neighbors were in favor (7-3, one favorable vote representing the Hill Plaza Tenant's Group) there were a number of concerns expressed as well. As noted in our previous letter to Craig O'Brien, of your department, after our last neighborhood input meeting neighbors continue to be concerned about the appearance of the parking area. It would be most desirable for the area to invite pedestrian traffic to pass from one section of the neighborhood to the other. It is rather perceived as an unsightly, industrial site set within our historic homes. We feel a need for an enhanced appearance, suitable landscaping and fencing which is sensitive to the historic character of the neighborhood. The general feeling of neighbors present indicated disappointment in not having been informed directly by the Glassrud Organization as to their plans for the project. I will be contacting him on behalf of the Ramsey Hill Association in order to facilitate some dialog regarding our concerns and questions.
