That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee 15 for this vacation which is due and payable within 60 days of the effective date of this 16 resolution. 17 18 2. That a permanent utility easement shall be retained within the vacated area to to protect the 19 interest of Northern States Power Company. 20 21 3. That any landscaping and/or grading of the vacated area is subject tt review and approval by 22 Northern States Power Company, the City of Saint Paul Zoning Administrator and the City of 23 Saint Paul Parks and Recreation Department. 24 25 4. That the existing bollards delineating the boundaries of Taylor Park muust remain in place. 26 27 5. That a 15 foot boulevard must be retained at the end of improved Howard Street. 28 29 6. That the petitioner's their successors, and assigns agree to indemnify, defend and save 30 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of 31 any character brought as a result of injuries or damages received or sustained by any person, 32 persons, or property on account of this vacation or petitioner's use of this property, including 33 but not limited to a claim brought because of any act of omission, neglect, or misconduct of 34 said petitioner or because of any claims or liability arising from any violation of any law or 35 regulation made in accordance with the law, whether by the petitioner or any of their agents or 36 employees 1 7. The purpose of the meeting was to discuss the appropriate alternatives for the development of your property. Mike Kramer suggested the access from the North along Howard that was the basis of our final recommendation on a site plan. The basis of our recommendation was for the following reasons: 1. The grade work to come in from the Southeast along Winthrop would cause a drastic reshaping of Winthrop and its existing sideslopes. 2. The road into the subdivision from Winthrop would cause drastic grade changes on the Easterly lots. 3. Using Howard Street as an access would allow a sense of place as you enter the subdivision with some attractive entrance identification. 4. Using an access point West of Winthrop along Springside would make the existing home too prominent and would destroy the presentation of the lots. The drawings I provided were freehand based on my observations during Winter conditions and looked at creating a project with market appeal. It would take considerable planning and engineering work to reach a conclusion as to the final costs and profit from this opportunity. We believe you have the opportunity with the site plan we suggested to create a new subdivision that would add value to the community and create an exciting option for the residents of St. Paul to relocate within the City of St. Paul and obtain the type of housing that is typically associated with suburban communities like Woodbury, Maplewood, and Shoreview. We hope the City and neighbors will recognize that offering new subdivisions can be as important to the vitality of a community as restoring the original character of the many existing neighborhoods. The petitioner has recently extended the Howard Street improvements to serve the parcel at the northeast corner of Howard and unimproved Hadley Street. Attached is a copy of the recent construction plan. A 15 foot boulevard is to be retained beyond the end of improved Howard. There is a discrepancy between the lot lines shown on the plat map and the lot lines shown on the construction plan. Since the discrepancy would only create a larger boulevard rather than a smaller one, this should be acceptable. 2. Because of the unusual shape of the proposed vacated area, the City surveyor has concerns about how the vacated street would be split and how that split will be described. 3. The topography of unimproved Howard Street would probably suggest that it will not be improved through to Point Douglas Road. But, there is an 11.19 acre tract of developable land south of the proposed vacation. Slopes from the south end of Howard to this property are not so severe, that it may be feasible to extend Howard further to the south to serve this property, although sewer would not be extended through this portion of Howard. Sewer to serve this tract of land could be brought in from the portion of Howard St. west of this property or from Springside at the southeast corner of the property. Responsive Services • Quality Facilities • Employee Pride Therefore, because there are other options for access and public improvements to serve the property south of the proposed vacation, the Department of Public Works has no objections, provided the property owner to the south is adequately notified of this vacation proposal, and provided a 15 foot boulevard is retained.
