1 RESOLVED, that upon the petition of the City of Saint Paul , per Finance Department File Number 9-
2 2000, public properties hereinafter described are hereby vacated and discontinued as public property;
3 and, subject to the herein stated exceptions, the easements within those public properties are hereby
4 released.

6 The vacated area is described as follows:

8 All of Lot 8, Block 1, Point Douglas Addition, except the following described area:

10 Beginning at the most southerly corner of said Lot 8; thence in a
11 northwesterly direction along the southwesterly line of Lot 8, a distance of
12 129.60 feet; thence continuing in a northwesterly direction along the said
13 southwesterly line of Lot 8 at a deflection angle of 07 degrees, 22 minutes
14 to the left, a distance of 27.22 feet; thence in a northeasterly direction at a
15 deflection angle of 90 degrees to the right, a distance of 113.84 feet, more
16 or less, to the northeasterly corner of said Lot 8; thence southerly along the
17 east line of Lot 8 to the point of beginning, as shown on Opening Drawing
18 No. 2120 in Drawer 4, on file in the Department of Public Works, 800
19 City Hall Annex, 25 West Fourth Street, Saint Paul, Minnesota.

21 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
22 Saint Paul Legislative Code as amended, and to the following conditions:

24 1. That in accordance with Section 87A.01 (8) of the Saint Paul Legislative Code, the parcel of
25 property vacated, hereby having been acquired by the City by condemnation, and having been
26 dedicated for public street purposes, the Council of the City of Saint Paul does hereby approve
27 and authorize, without advertisement therefor and without competitive bids, the sale and
28 conveyance by quit claim deed of the City's interest to that portion of Lot 8 vacated, as described
29 above, to the owner of the parcel of land immediately abutting and contiguous to the portion of
30 vacated Lot 8, Nancy Larson, for the sum of$500.00, which sum is reported by the Valuation
31 Engineer to be the fair market value thereof, and the proper City officers are hereby authorized
32 and directed to execute and deliver the City's quit claim deed for this purpose.

34 2. That the purchaser, their successors, and assigns, agree to indemnify, defend and save harmless
35 the City of Saint Paul, its officers, and employees from all suits, actions, or claims of any
36 character brought as a result of injuries or damages received or sustained by any person, persons,
1 or property on account of this vacation or purchaser's use of this property, including but not o -ion
2 limited to a claim brought because of any act of omission, neglect, or misconduct of said
3 petitioner or because of any claims or liability arising from any violation of any law or regulation

26 dedicated for public street purposes, the Council of the City of Saint Paul does hereby approve
27 and authorize, without advertisement therefor and without competitive bids, the sale and
28 conveyance by quit claim deed of the City's interest to that portion of Lot 8 vacated, as described
29 above, to the owner of the parcel of land immediately abutting and contiguous to the portion of
30 vacated Lot 8, Nancy Larson, for the sum of$500.00, which sum is reported by the Valuation
31 Engineer to be the fair market value thereof, and the proper City officers are hereby authorized
32 and directed to execute and deliver the City's quit claim deed for this purpose.

I have requested a date of September 27, 2000 for a Public Hearing to approve the
attached Council Resolution. The purpose of the resolution is to vacate part of a lot near
Point Douglas Road and Clarence Street originally taken for right-of-way purposes. The
portion of Lot 8 northerly of the finished road which has been declared excess right-of-
way will be sold to the adjacent property owner if the vacation is approved.
The usual City offices with rights to the area being vacated have all responded to our
inquiries regarding the proposed vacation. Their responses are with the resolution as it is
being routed for signatures. The resolution is currently in the City Attorney's Office.
I have attached a copy of the Green Sheet, the Council Resolution, the petition, and a
map of the area to be vacated. Please let me know if there is anything else you might
need for this.

maintained the area for some time,has expressed an interest in acquiring this property.

The City's interest in this land would be vacated, and it would be sold to the adjacent property.
City would have no further liability for the area, and it would return to the tax rolls.

minutes to the left, a distance of 27.22 feet; thence in a northeasterly direction at a deflection
angle of 90 degrees to the right, a distance of 113.84 feet, more or less, to the northeasterly
corner of said Lot 8; thence southerly along the east line of Lot 8 to the point of beginning, as
