1 BE IT RESOLVED, that, upon the petition of the Gerald K. Monette, as documented in Technology
2 Department File Number 1997-13, the public property hereinafter described is hereby vacated and
3 discontinued as public property and, subject to the herein stated exceptions.

5 The property to be vacated is described as follows: See Attached Exhibit "A"

7 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of
8 the Saint Paul Legislative Code as amended, and to the following conditions:

10 1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
11 for this vacation which is due and payable within 60 days of the effective date of this
12 resolution.

14 2. That the land described above is vacated to accommodate a building encroachment and that
15 upon removal, reconstruction, alteration demolition or otherwise non-existence of the
16 encroaching building, the vacated land shall revert to the City of Saint Paul as street right
17 of way without charge or cost to the City of Saint Paul.

19 3. That an easement shall be retained for Northern States Power Company, Electric, over, under
20 and across said vacated area for the purpose of protecting its distribution facilities.

22 4. That the petitioner's their successors. and assigns agree to indemnify, defend and save
23 harmless the City of Saint Paul. its officers. and employees from all suits, actions, or claims of
24 any character brought as a result of injuries or damages received or sustained by any person.

26 but not limited to a claim brought because of any act of omission, neglect. or misconduct of
27 said petitioner or because of any claims or liability arising from any violation of any law or

northerly extension of Lot 17, Block 1, Morton's Addition as more fully described on the
attached resolution..
Please be advised that the necessary acceptance and compensation have been filed. Because
there is an urgency for this to get filed please return it to this office NO LATER THAN
DECEMBER 1, 1997. If you cannot meet this deadline please notify me right away. Thank

Coleman of 901 140th Lane N.W., Andover, Minnesota 55304, as my Attorney-in-Fact ("Agent").
If my Agent is unable to serve for any reason, I designate Linda Coleman of 901 140th Lane N.W., Andover,
Mn 55304, as my Successor Agent.
My Agent shall have full power and authority to act on my behalf but only to the extent permitted by this
Special Power of Attorney. My Agent's powers shall include the power to:
1. Manage, insure, improve, repair, collect rents, execute leases, or take any other action that a landlord

subject to a general power of appointment by my Agent, and (iii) my Agent to have any incidents of ownership
with respect to any life insurance policies that I may own on the life of my Agent.
My Agent shall not be liable for any loss that results from a judgment error that was made in good faith.
However, my Agent shall be liable for willful misconduct or the failure to act in good faith while acting under

My Agent shall not be entitled to any compensation, during my lifetime or upon my death, for any services

Vacation of part of Hoyt Avenue,
west of Arkwright Street due to
garage encroachment
The Department of Public Works has completed a review of the above referenced
vacation proposal. This is an unimproved street with an existing 3'-6" sanitary sewer
in that turns southwest into a 4' sewer in a 35' easement across Lot 15 and along the
railroad. A three foot vacation should not affect our sewer. The Department of Public
Works has no objections to the vacation provided it is of the encroachment area only,
and for the life of the structure only.

WAIVER OF NOTIFICATION OF PUBLIC HEARING
VACATION CITY RIGHT OF WAY
The undersigned has petitioned to vacate right of way in the City of Saint Paul, said
property to be vacated is described as follows:
See Exhibit "A";
and states that as petitioner was entitled to receive notification of a public hearing for said vacation
under Chapter 130 of the Saint Paul City Charter prior to vacating said public right of way.
Notwithstanding failure to receive such notice and concurring with the impending action by
the Saint Paul City Council, the undersigned does hereby waive its right to notification of public
hearing for the vacation of the above mentioned public right of way.
The undersigned does hereby agree to abide by the terms and conditions set forth in the
Council Resolution vacating the above mentioned right of way.
