WHEREAS, the Office of Financial Services Real Estate Section has prepared the attached Report of
Completion of Assessment for the assessment of benefits, cost and expenses for a water service connection
requested by the St. Paul Curling Club Inc. for the property located at 470 Selby Avenue. This project was
completed during the Selby Avenue street paving project.
Preliminary Order: 07-1218 Approved: 12/19/2007
Final Order: 08-114 Approved: 02/20/2008
WHEREAS, the Office of Financial Services Real Estate Section has prepared for the Council's consideration
the attached Assessment Roll listing the benefited property, the property owner, the service provided and the
charges for the service; and hereby submits the Assessment Roll for the City Council's consideration to adopt
and levy the charges as an assessment against the benefited property; now, therefore be it
RESOLVED, that the Saint Paul City Council hereby accepts and approves said Report of Completion of
Assessment and Assessment Roll; and be it further
RESOLVED, that a public hearing be had on said assessment on the 19th day of September, 2012 at 5:30
p.m., in the Council Chambers of the Court House and City Hall Building, in the City of Saint Paul; and that the

lighting and some minor sidewalk replacement.

Final Order: 12-20 Approved 02/15/2012
WHEREAS, the Office of Financial Services Real Estate Section has prepared for the Council's consideration
the attached Assessment Roll listing the benefited property, the property owner, the service provided and the
charges for the service; and hereby submits the Assessment Roll for the City Council's consideration to adopt
and levy the charges as an assessment against the benefited property; now, therefore be it
RESOLVED, that the Saint Paul City Council hereby accepts and approves said Report of Completion of
Assessment and Assessment Roll; and be it further
RESOLVED, that a public hearing be had on said assessment on the 19th day of September, 2012 at 5:30
p.m., in the Council Chambers of the Court House and City Hall Building, in the City of Saint Paul; and that the
Office of Financial Services Real Estate Section provide mailed and published notice of the same as required
by law.

WHEREAS, the Office of Financial Services Real Estate Section has prepared the attached Report of
Completion of Assessment for the assessment of benefits, cost and expenses for installation of a Fire
Protection System at 1560 St. Clair Avenue.
Budget Amendment: RES PH 12-111 Approved 08/01/2012
; and
WHEREAS, the Office of Financial Services Real Estate Section has prepared for the Council's consideration
the attached Assessment Roll listing the benefited property, the property owner, the service provided and the
charges for the service; and hereby submits the Assessment Roll for the City Council's consideration to adopt
and levy the charges as an assessment against the benefited property; now, therefore be it
RESOLVED, that the Council of the City of Saint Paul hereby accepts and approves the Report of Completion
of Assessment and Assessment Roll; and be it further
RESOLVED, that a public hearing be had on the assessment on the 19th day of September, 2012 at the hour
of 5:30 p.m., in the Council Chambers of the Court House and City Hall Building, in the City of Saint Paul; and
that the Office of Financial Services Real Estate Section provide mailed and published notice of the same as
required by law.

Body
In the matter improving the north side of East Sixth Street between Sibley Street and Wacouta Street by
removing the existing 10' sidewalk, abandoning the areaways under the sidewalk as needed, constructing 18'
wide concrete sidewalks, completing storm sewer and other related utility relocations, and other related work
to complete the project.
The Council of the City of Saint Paul having received the report of the Mayor upon the above improvement,
and having considered said report, hereby resolves:
1. That the said report and the same is hereby approved with no alternatives, and that the estimated cost
thereof is $291,600.00, financed by assessments.
2. That a public hearing be had on said improvement on the 17th day of October, 2012, at 5:30 p.m., in the
Council Chambers of the City Hall and Court House Building in the City of Saint Paul.
3. That notice of said public hearing be given to the persons and in the manner provided by the Charter,
stating the time and place of hearing, the nature of the improvement and the total cost thereof as estimated.

SUMMARY OF ENGINEERING RECOMMENDATIONS
Sixth Street Sidewalk Improvements – Sibley to Wacouta
Report Prepared 7-5-2012
Public Hearing 9-19-2012
PROJECT
This project is to improve the sidewalk on the north side of East Sixth Street between Sibley
Street and Wacouta Street, by reconstructing and widening the sidewalk and abandoning
existing areaways and completing all other related work to complete said improvement.
The abutting property owners have requested the sidewalk be widened to allow for operation of
seasonal sidewalk café’s in this area.
EXISTING CONDITIONS
The existing sidewalk is 10’ wide and in poor condition and not wide enough for the size of
sidewalk café desired by the property owners.
From north to south, the existing cross section of 6th between Sibley to Wacouta consists of a
10’ sidewalk, a 10’ wide Bus Lane(on east end) and Parking Lane (on west end), two 10’ wide
traffic lanes, a 10’ wide parking lane, and 10’ wide sidewalk in a 60’ wide right of way. When
cars are parked on the west end, the bus has to merge into adjoining traffic lane to avoid parked
cars. 6th Street is one way westbound.
PROPOSED IMPROVEMENTS
It is proposed to improve the sidewalk on the north side of East Sixth Street between Sibley
Street and Wacouta Street, by removing the existing 10’ wide sidewalk, abandoning the
areaways under the sidewalk as needed, construct an 18’ wide concrete sidewalk, complete
storm sewer and other related utility relocations, install 4 trees, relocate globe style street lights,
complete traffic signal revisions, revise striping and signing to transition and shift traffic lanes as
necessary through the widened sidewalk area, ban parking as needed and remove 22 parking
meters and complete all other related work to complete said improvement.
Under this proposal, the sidewalk would be wide enough to accommodate a 10’ wide sidewalk
café area and a 6’ wide accessible path for pedestrians.
ALTERNATES
To do nothing would be inconsistent with the property owners desire to widen sidewalk and
operate a larger sidewalk café.
During community process for project, there was discussion of implementing a seasonal
sidewalk widening to allow for a larger sidewalk café area in Spring, Summer and Fall but then
be removed during Winter Snow Season. Property Owners were not interested in this option.

POSITIVE BENEFITS
General improvement of the public right-of-way will enhance and add quality to the
neighborhood. The newly rebuilt sidewalk will improve walkability of the area and space
available for seasonal sidewalk café’s. Providing full Bus/Bike Lane will improve transit, traffic
and bicycling in this block.
ADVERSE EFFECTS
In order to maintain 2 westbound traffic lanes to adequately serve traffic, a westbound combined
Bus /Bike Lane, and provide for an 18’ wide sidewalk, it will be necessary to remove parking
and parking meters as follows:
North Side Sixth – Sibley to Wacouta
6 Parking Meters
Estimated Yearly Revenue Lost - $8,000
South Side Sixth – 100’ west of Sibley to 100’ east of Wacouta
16 Parking Meters and 1 signed Handicapped Parking Space
Estimated Yearly Revenue Lost - $17,500
Note that under the Central Corridor Bike Walk Plan adopted by City Council, it is recommended
that the Bus Lanes on 5th and 6th be converted to a shared Bus and Bike Lane which would
require removal of the 6 parking meters on the north side of 6th Street between Sibley and
Wacouta.
Normal problems associated with construction such as noise, dust, reduced access to
businesses, and general disruption will be present.
PUBLIC INPUT
The CapitolRiver Council set up a task force in 2010 and received community input on the
proposal. The full CapitolRiver Council adopted following resolution:
“CapitolRiver Council approves the plans for a permanent sidewalk extension and cafe on 6th
Street between Sibley and Wacouta, and urges building owners to further consider a seasonal
decking option by meeting with John Mannillo.”
TIME SCHEDULE
The project will be completed in the fall of 2012. Exact timing and schedule of project will be
coordinated to minimize disruption to adjacent property owners and the community.

The above costs do not include areaway abandonment which will be directly assessed to
affected property owner.
The assessment rate for this project is $900 per assessable foot. It is proposed to assess 100%
of cost to benefitting property owners.

WHEREAS the Ramsey County Criminal Justice system and its partners within the City of Saint Paul,
including the Chief of Police and City Attorney have agreed to form a criminal justice coordinating council to
serve as a forum through which criminal justice, human services, community and government organizations
may by association, consultation and study, cooperatively promote improvements in the criminal justice
system that transcend various organizations and communities; and
WHEREAS, The Criminal Justice Coordinating Council has established the following mission: “to create safer
communities, Ramsey County justice partners will work collaboratively to employ evidence-based decision
making practices across the criminal justice system to achieve better outcomes that are consistent with
community values”; and
WHEREAS, The Criminal Justice Coordinating Council has established the following goals: enhance
collaboration and communication among justice partners; engage community members; promote fairness and
equity; encourage harm reduction; foster public safety; prevent crime and victimization; promote offender
accountability and change; reduce recidivism; and promote system effectiveness; Now, Therefore Be It

Purpose of Appeal
...I do not intend to pay any additional costs related to the repair of the stairway unless there is either a
reasonable agreement with the City regarding an appropriate allocation of costs, or a court determination as to
who has the responsibility for maintaining this public improvement.
Enclosed is a letter dated February 17, 2009 addressed to Mayor Chris Coleman outlining the history of this
issue.

WHEREAS, in the matter of the appeal of Richard H. Nicholson to a Correction Notice at 260 SUMMIT
AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff
and the appellant;
WHEREAS, the Legislative Hearing Officer recommends that the City Council deny the appeal and grant an
extension to October 31, 2011 to repair the wall; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's
recommendation in this matter.

WHEREAS, the Department of Safety and Inspections has determined that 924 ELEANOR AVENUE is a
nuisance building pursuant to Saint Paul Legislative Code §45.02 as 1) it is a vacant building as defined in
§43.02; and 2) it has multiple housing code or building code violations or it has conditions constituting material
endangerment as defined in §34.23, or it has a documented and confirmed history as a blighting influence in
the community; and
WHEREAS, this property is legally described as follows, to wit: Ruggs Addition Lots 1 And Lot 2 Blk 4; and
WHEREAS, based upon the records in the Ramsey County Recorder's Office and information on file or
obtained by the Department of Safety and Inspections, the following are the owners, interested or responsible
parties for the subject property as of June 8, 2012: Craig Jensen/Sabrina Demars, 924 Eleanor St, St Paul
MN 55102-4009; Wells Fargo Bank NA, MAC: X2598-015, 1 Home Campus, Des Moines IA 50328; Wells

WHEREAS, each of these parties was served a written order dated May 1, 2012 advising them of the basis for
the determination that the subject property was a nuisance, and that the nuisance building was to be repaired
or razed and removed by June 1, 2012; and
WHEREAS, this order informed the interested or responsible parties that they must repair or raze and remove
the structures(s) located on the Subject Property by June 1, 2012; and
WHEREAS, a placard indicating the City's order that this nuisance building be abated was posted on the
building on May 2, 2012 in accordance with Saint Paul Legislative Code §45.11(2)c; and
WHEREAS, the nuisance condition was not corrected by June 1, 2012 and, therefore, an abatement hearing
was scheduled before the City Council on August 1, 2012 and the owner or his duly authorized representative
and any interested parties or their duly authorized representatives were properly notified of the time, date and
place of the hearing; and
WHEREAS, the legislative hearing officer provided the owner and other interested parties an opportunity to
discuss the matter at a legislative hearing on July 10 and July 24, 2012; and
WHEREAS, a public hearing was held on August 1, 2012 and the City Council reviewed the record which
included the exhibits from the Department of Safety and Inspections, the minutes and recommendation of the
legislative hearing officer and any testimony at the hearing; Now, Therefore Be It
RESOLVED, that the Saint Paul City Council hereby finds:
1. That the structure(s) at 924 ELEANOR AVENUE is a nuisance building pursuant to Saint Paul
Legislative Code §45.02, as 1) it is a vacant building as defined in §43.02; and 2) it has multiple housing code
or building code violations or it has conditions constituting material endangerment as defined in §34.23, or it
has a documented and confirmed history as a blighting influence in the community; and 3) these nuisance
conditions have not been corrected after notice of the same to the owner;
2. That the Department of Safety and Inspections has complied with all of the procedural requirements of the
Saint Paul Legislative Code Chapter 45;
3. That the owners, interested parties or responsible parties have not presented a plan acceptable to the
legislative hearing officer and Department of Safety and Inspections staff to repair the structure(s) and correct
all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance report and to
make the structure(s) safe and code compliant within 15 days; And, Be It
FURTHER RESOLVED, that the Council orders that the owners, interested parties or responsible parties shall
raze and remove the structure(s) within 15 days after the City Council public hearing; And, Be it
FURTHER RESOLVED, that if the necessary corrective action has not been taken within the time allotted, the
Department of Safety and Inspections is authorized to take those steps necessary to raze and remove this
structure and to charge the costs incurred in accordance with Saint Paul Legislative Code §45.12(4). Any
personal property or fixtures of any kind shall be removed by the owners, interested parties or responsible
parties prior to the demolition or it will be considered to be abandoned and the City of Saint Paul shall remove
and dispose of such property as it deems appropriate. And, Be It
FINALLY RESOLVED, that this resolution shall be served on any of the parties required to be notified in Saint
Paul Legislative Code §45.12(4).

Dear Sir or Madam:
The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
924 ELEANOR AVE
With the following Historic Preservation information: NONE
and legally described as follows, to wit:
Ruggs Addition Lots 1 And Lot 2 Blk 4
to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On April 10, 2012 a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall
not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued. All repairs must be in accordance with
appropriate codes. Changes or additions to the electrical system, mechanical system, or
the plumbing system may necessitate updating or upgrading the systems involved.
This is a one-story wood frame house, with a two-stall detached, wood frame garage and
another one-stall, detached wood frame garage.

The following Deficiency List is excerpted from the August 17, 2010 Code Compliance Report.
BUILDING
Provide complete storms and screens, in good repair for all door and window openings.
Exit doors shall be capable of being opened from the inside, easily and without the use
of a key. Remove all surface bolts.
Install floor covering in bathroom and kitchen that is impervious to water.
Prepare and paint interior and exterior as necessary. Observe necessary abatement
procedures (EPA, MPCA and St. Paul Legislative Code, Chapter 34 for additional
information) if lead base paint is present.
Install Smoke Detectors/Carbon Monoxide Detectors per MN Co Conservation Code
and the MN Dept. of Labor and Industry.
Provide major clean-up of premises.
Repair siding, soffit, fascia, trim, etc. as necessary.
Provide proper drainage around house to direct water away from foundation of house.
Provide proper drainage around house to direct water away from foundation of garage.
Provide general rehabilitation of garage and replace rotted siding.
Install address numbers visible from street and on the alley side of garage.
Review all applicable codes & policies when replacing windows including egress
windows for sleeping rooms.
Properly repair garage, garage door and fascia on east. Install numbers on both garages
to code.
Second floor bedroom window is to small in both units and no smoke detectors in any
second floor bedrooms.
Owner to supply ladder at final inspection for roof inspection.
A building permit is required to correct the above deficiencies.
ELECTRICAL
Ground the electrical service to the water service with a copper conductor within 5 feet
of the entrance point of the water service
Bond around water meter with a copper wire sized for the electrical service per Article
250 of the NEC
Provide a complete circuit directory at service panel indicating location and use of all
circuits
verify/install a separate 20 ampere laundry circuit and a separate 20 ampere kitchen
appliance circuit
Verify that fuse/circuit breaker amperage matches wire size
install/replace GFCI receptacle in basement and second bathroom adjacent to the sink.
Unit B not working.
Install globe-type enclosed light fixture on all closet lights
Remove all cord wiring and adapters bath A
Repair or Replace all broken, missing or loose light fixtures, switches and outlets, covers
and plates. Kitchen B Unit.
Install hard-wired, battery backup smoke detector per bulletin 80-1 and other smoke
detectors as required by the IRC. Also, Install carbon monoxide detector(s) within 10
feet of all bedrooms

Install receptacle for garage door opener
Remove and or/ re-wire all illegal, improper or hazardous wiring in basement.
Throughout building, install outlets and light fixtures as specified in Bulletin 80-1.
A Unit: Microwave cord through wall. Verify separate ground/neutral bar in panels.
(Disconnects outside - verify)
A Unit: Verify switch operation (south wall)
A Unit: Provide access inside panel. Outside disconnect inside panel covers corroded.
Need new screw in one disconnect. Provide illumination throughout exterior/interior.
B Unit: Reinstall thermostat wire.
All added receptacles must be grounded, tamper-resistant and be on an Arc-Fault Circuit
Interrupter-protected circuit.
Any open walls or walls that are opened as part of this project must be wired to the
standards of the 2008 NEC.
All buildings on the property must meet the St. Paul Property Maintenance Code
(Bulletin 80-1).
All electrical work must be done by a Minnesota-licensed electrical contractor under an
electrical permit.

resulting nuisance condition is not corrected by June 1, 2012 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651) 266-8989. This
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition. You may also be required to post a five thousand dollar ($5,000.00)
performance bond with the Department of Safety and Inspections before any permits are issued,

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transferred or conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a "nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be

provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this

establishment. A third appearance for the same shall be counted as a third appearance regardless of how
much time has passed since the first or second appearance.
(6) For the purpose of a second, third or fourth appearance under this section, "violation" shall mean either
one of those violations listed in paragraph (b)(m) or a violation of section 409.26 (b).
SECTION 2
This Ordinance shall take effect and be in force thirty (30) days following its passage, approval and
publication.

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
SECTION 1
Section 246.03 of the Saint Paul Legislative Code is hereby amended to read as follows:
Sec. 246.03 - Not applicable on licenses premises.
(a) This chapter shall not apply to or prohibit the sale, possession or consumption of such liquors or
beverages on the premises of any establishment properly licensed under Chapter 409 or Chapter 410 of the
Saint Paul Legislative Code.
(b) Notwithstanding the prohibitions of section 246.01 the sale and service of alcoholic beverages within a
sidewalk cafe by a food establishment, which is licensed as a restaurant under Chapter 331A of the
Legislative Code and which is in compliance with the provisions of section 106.01 of the Legislative Code, is
permitted.
(c) The prohibitions of section 246.01 shall not apply to or prohibit the possession or consumption of
nonintoxicating malt liquor, strong beer or wine purchased and consumed during a block party, festival or
community event which has been duly licensed under Chapter 366 of the Legislative Code, when such
possession or consumption occurs on a street which has been blocked off for the block party, festival or
community event in the downtown business district or downtown entertainment district and the nonintoxicating
malt liquor, strong beer or wine is purchased from a duly licensed vendor.
(d) Notwithstanding the prohibitions of section 246.01, the director of the department of parks and recreation
may authorize the sale or service of alcoholic beverages on property under its jurisdiction by either a person

who is the holder of a state catering permit and who has complied with the provisions of Saint Paul Legislative
Code § 409.01 or by the holder of a temporary wine and liquor license issued pursuant to § 409.25 or
temporary 3.2 beer license issued pursuant to § 410.10 except that in no event can the prohibitions contained
in section 246.05 be waived. Such sale or service must be in connection with an event of limited duration
which has been approved by the director of parks and recreation and is subject to all other requirements and
restrictions contained in Minn. Stat. Chapter 340 and Saint Paul Legislative Code Chapters 409 and 410.
SECTION 2

SECTION 1
Section 409.02 of the Saint Paul Legislative Code is hereby amended to read as follows:
Section 409.02 - Definitions
As used in this chapter, the following terms shall have the meanings ascribed to them in this section:

"Downtown Entertainment District" means that portion of the City of Saint Paul lying within and bounded by the
following streets: Beginning at the intersection of Shepard Road with Eagle Parkway, Eagle Parkway to
Exchange Street, Exchange Street to N Walnut Street, North Walnut Street to Smith Avenue, Smith Avenue to
N Chestnut Street, N Chestnut Street to Interstate Freeway 35E, Interstate Freeway 35E to Tenth Street,
Tenth Street to Interstate Freeway 94, Interstate Freeway 94 to Lafayette Bridge, Lafayette Bridge to where
the bridge crosses over Warner Road, Warner Road to Wabasha Bridge, Wabasha Bridge across the
Mississippi River to the water line on the south bank of the river, thence in a westerly direction along the shore
line to the point at which it intersects with "Line A," and then in a straight line across the Mississippi River to
the intersection of Eagle Parkway with Shepard Road.

"Licensee" means any person holding a liquor license within an Entertainment District.

Section 409.30 of the Saint Paul Legislative Code is hereby created to read as follows:
Section 409.30 - District Rules
(a) All licensees within the Downtown Entertainment District must comply with all laws, rules, and regulations
which govern its license type, including the provisions of this ordinance, and all license conditions.
(b) Patrons and guests of a Licensee may exit the licensed premises with open containers of nonintoxicating
malt liquor, strong beer and wine within the confines of the Downtown Entertainment District only if the City
has granted a block party permit pursuant to Legislative Code sections 366.03-.07 and only within the block
party permitted area. Licensee patrons and guests may not enter another licensed premise with open or
closed containers of alcoholic beverages.
(c) No Licensee within Downtown Entertainment District shall allow beverages to be removed from the
licensed premises in any bottles or glass containers.
SECTION 2

SECTION 1
Saint Paul Legislative Code chapter 367 has regulated tattoo parlors within the City since 1977.
In 2010, the Minnesota Legislature enacted Minnesota Statutes chapter 146B, which licenses and regulates
body art technicians and establishments statewide. Minnesota Statutes sections 146B.02 regulates body art
and tattoo establishments in the absence of City regulation that meets or exceeds state law. Minnesota
Statutes section 146B.03 preempts City regulation of body art and tattoo technicians. The state law regulates
the same risks to public health, safety and welfare addressed in Saint Paul Legislative Code chapter 367.
Because body art and tattoo technicians and establishments are comprehensively regulated under Minnesota
Statutes chapter 146B, Saint Paul Legislative Code chapter 367 is hereby repealed.
Chapter 367 of the Saint Paul Legislative Code is hereby repealed as follows:
Chapter 367. - Tattoo Parlors
Sec. 367.01. - Definitions.
The following definitions shall apply in the interpretation and enforcement of this chapter:
(1)
Change of ownership: The word "change of ownership" means a licensed business is sold or
transferred to another person, business or corporation. A change of ownership, as it relates to
an environmental plan review, does not include the changing or adding of officers to an existing
partnership or corporation or change of a mailing address.
(2)
Director: The word "director" means the director of the department of safety and
inspections or his/her designated agent.
(3)
Tattooing: The word "tattooing" means and includes any method of placing designs,
letters, scrolls, figures, symbols, or any other marks upon or under the skin of a person

with ink or colors, by the aid of needles or instruments.
(4)
Person: The word "person" means and includes any individual, firm or corporation,
owner or operator of a tattooing establishment.
(5)
Remodel: The word "remodel" means any reconstruction, alteration or repair that
requires structural, plumbing, mechanical and/or electrical permits; changing the
location of walls; expanding the area of the facility; substantially changing or expanding
the character of the business. "Remodel" does not include replacing a piece of
equipment with a like piece of equipment; replacing wall, floor or ceiling finishes;
repositioning equipment; providing new equipment that does not significantly alter the
character of the business. The director shall have discretion in determining when this
section applies.

Sec. 367.02. - License.
It shall be unlawful for any person to engage in the business of tattooing for a fee without first
obtaining a license.

Sec. 367.03. - Investigation and inspection.
(1)
It shall be the duty of the health officer to investigate the premises where tattooing is proposed
to be practiced, and if it shall appear to the director that the sanitary conditions prevailing upon
the premises comply with the provisions of this chapter and conform to the rules and
regulations promulgated by the director, the license application for the establishment shall be
approved.
(2)
Environmental plan review required. A person shall not begin to construct, remodel, or alter a
tattoo parlor until the director has reviewed and approved the plans and specifications required
by this subsection. The tattoo parlor shall be constructed and finished in conformance with the
approved plans. The director may inspect the tattoo parlor as frequently as deemed necessary
during construction to ensure that construction occurs in conformance with this chapter. The
director shall conduct a final inspection prior to the start of operations and issuance of an
approved license. If work has commenced prior to approval of plans when required, the director
may issue orders to halt the construction, extensive remodeling, expansion, or alteration, or
may issue orders, including demolition or removal, if reasonably necessary to determine
compliance with the standards of this chapter.

Change of ownership review required. Upon a change of ownership of a tattoo parlor, the
director shall conduct a change of ownership review of the premises to determine compliance
with the requirements of this chapter.

Sec. 367.04. - Fee.
The annual fee for a license to engage in the practice of tattooing along with the fees for an environmental
plan review and change of ownership review shall be established by ordinance as specified insection 310.09
(b) of the Saint Paul Legislative Code.

Sec. 367.05. - Tattooing of minors.
It shall be unlawful to tattoo any person under the age of eighteen (18) years.

Sec. 367.06. - General instructions.
The tattooing license and regulations of the department of safety and inspections shall be
posted at all times in a conspicuous place in the tattooing establishment.

Sec. 367.07. - Rules and regulations.
The director shall promulgate rules and regulations reasonably necessary to the safe and sanitary
operation of tattooing establishments after giving the parties affected thereby notice and opportunity to comment.
The director shall make available at least one (1) free copy of the proposed rules and regulations to any party
requesting them. The director shall allow written comments to be submitted for ten (10) days after notice of the
proposed promulgation is given. If, at the end of the ten-day period, the director chooses to adopt the proposed
rules and regulations, whether in the original or in an amended form, he shall make available a copy of such rules
and regulations to all affected persons upon request for at least five (5) days before filing them with the city clerk.
Rules and regulations promulgated pursuant to the provisions of this section shall be effective upon filing with the
office of the city clerk. Amendments to rules and regulations promulgated pursuant to this section shall be
effective twenty (20) days after filing with the office of the city clerk. (Ord. No. 16357, § .07, 10-14-77; Ord. No. 03

Sec. 367.08. - Penalty.
Any person who violates any provision of this chapter or any provision of the rules and
regulations promulgated thereunder shall be subject to a fine of up to three hundred dollars ($300.00)
or imprisonment of up to ninety (90) days or both.

Sec. 367.09. - License revocation.
Any license granted under this chapter may be revoked by the city council whenever the holder
thereof has been convicted a second time for any violation of its provisions or for any violation of the
rules and regulations promulgated thereunder.
