Schnelier, 24630 Hale Avenue, Forest 13 Lake, MN 55025; Ronald 7oseph Adams, 676 Wells Avenue, St. Paul, Mn 55106 14 15 WHEREAS, Division of Code Enforcement has served in accordance with the provisions of 16 Chapter 45 of the Saint Paul I.egislative Code an order idendfied as an "Order to Abate Nuisance 17 Building(s)" dated March 18, 1998; and 18 19 WHEREAS, this order informed the then known interested or responsible parties that the 20 structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and 21 22 WHEREAS, this order informed the interested or responsible parties that they must repair or 23 demolish the structure located on the Subject Property by April 17, 1998; and 24 25 WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring 26 this building(s) to constitute a nuisance condition; subject to demolition; and 27 28 WHEREAS, this nuisance condition has not been corrected and Division of Code 29 Enforcement requested that the City Clerk schedule public hearings before the Legislative Hearing 30 Officer of the City Council and the Saint Paul City Council; and 31 32 WHEREAS, the interested and responsible parties have been served notice in accordance 33 with the provisions of Chapter 45 of the Saint Paul L.egislative Code, of the time, date, place and 34 purpose of the public hearings; and 35 36 WHEREAS a hearing was held before the L.egislative Heazing Officer of the Saint Paul Ciry 37 Council on Tuesday, June 16, 1998 to hear testimony and evidence, and after receiving testimony 38 and evidence, made the recommendation to approve the request to order the interested or responsible 39 parties to make the Subject Properry safe and not detrimental to the public peace, health, safery and 40 welfare and remove its blighting influence on the community by rehabilitating this structure in 41 accordance with all applicable codes and ardinances, or in the alternative by demolishing and 42 removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or 43 demolition of the structure to be completed within fifteen (15) days after the date of the Council 44 Hearing; and ORIGINAL �t$ -SLG WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, June 24, 1998 and the testimony and evidence including the action taken by the I.egislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 674 Wells Street: 1. That the Subject Property comprises a nuisance condi6on as defined in Saint Paul L.egislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed three thousand dollars ($3,000.�0). 3. That theze now exists and has existed multiple Aousing or Building code violations at the Subject Properiy. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected, 6. That Division of Code Enforcement has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by the Department of Fire and Safety 5ervices, Division of Code Enforcement, VacanUNuisance Buildings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ORDER The Saint Paul City Council hereby makes the following order: 1. The above referenced interested or responsible parties sha11 make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabIlitating this siructure and correcting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The Legislative Hearing O�cer recommends denying the appeal. `l�- SG� NIINUTES OF THE LEGISLATIVE HEARING 7LJNE 16, 1998 Room 33Q City Hall Gerry Strathman, Legislative Hearing Officer STAFF PRESENT: Chuck Votel, Code Enforcement; Guy Willits, Code Enforcement Gerry Strathman called the meeting to order at 10:00 am. 674 WeILs Street Chuck Votel reported this building has been vacant since October 1997. The cuaent property owners have not discussed their intentions with the Division of Code Enforcement. The City has issued one summary abatement notice to secure the building. The $200 vacant building fee is unpaid. The real estate taates for 1995 and 1996 aze unpaid in the amount of $3,327.77. The cost to repair is $35,000; the cost to demolish is $5,750. No one appeazed representing the property. Gerry Strathman recommended approval of the 15 day order to remove or repair. 1171 Minnehaha Avenue West Chuck Votel reported this building was condemned in February 1998 and has been vacant since Mazch 1998. One summary abatement was issued to secure the building. The vacant building fees and taaces aze paid. The estimated cost to repair is $60,000, which does not make it feasible for rehabilitation. The estimated cost to demolish is $5,200. Chuck Votel stated he received a call from a Jennifer Watkins who lives next door. Ms. Watkins said she has acguired the building, plans to demolish it, and adding it as a side lot to her property. Mr. Votel expiained to Ms. Watkins the purpose of this hearing and told her she would have a reasonable amount of time to demolish the building herself. Ms. Watkins has already hired a contractor. Am� Woods, 1184 Minnehaha Avenue West, appeared and stated she laves across the street from this properry. She is concerned about the neighborhood. Ms. Woods urged the City to demolish 1171 Minnehaha. It is a mess. There is a lazge hole in the front yard. Ms. W oods stated she has never seen a house look this bad. Marjorie Van Dyke, 1178 Minnehaha Avenue West, appeared and stated she has lived in her house for fifty gears. The house at 1171 Minnehaha is an eyesore. The front stairs aze in poor condition and weeds are growing out of them. In the center of the yazd is wire fencing. Evidentiy, the fence is there to prevent people from falling over the broken sidewalk. Ms. Van Dyke would like to see the property demolished. �g- SG� MINU'I'ES OF TI� LEGISLATIVE HEARING, 6-16-98 Page 2 Cathy Lue, Coznmunity Organizer for the Hamline-Midway Coalition, appeazed and stated she has talked to neighbors who feel the house is in bad shape. These neighbors aze hopeful the properry will be demolished. Beth Randall, Hamline-Midway Area Rehabilitation Corporation (H-MARC) at 1558 Minnehaha Avenue West, appeared and stated H-MARC made an offer to purchase this property and Nancy Watkins made a higher offer. Ms. Randall stated she would like to see ll'71 Minnehaha demolished. There is a sink hole on the property. Ms. Randall stated she would like Ms. Watkins to have no more than 45 days to demolish the property. The door of the house was standing open, but yesterday it was secured again. Chuck Votel stated Jennifer Watkins intends to demolish the house, construct a garage in the reaz, and then construct a house in the front. Mr. Votel feels this is a good plan for the neighborhood. Beth Randail stated Nancy Watkins was arrears a year in taxes on her own property, therefore Ms. Randall was concemed that Ms. Watkins will not be able to maintain two properties and do improvements. Chuck Votel added that the ta�ces aze paid on 1171 Minnehaha. Gerry Strathman recommended approva] of the 15 day order to remove or repair. 1005 , essie Street Susan Mercurio, owner, appeazed and stated she is working on this house. Last month, she checked on the property almost everyday. She found a summary abatement notice on the door. There was a windstorm on May 15 and 16. Ms. Mercurio went to the house that weekend to check on any wind damage. She later had a tree removed. The code compliance report said that the shed had to be removed. Since the report was done, the shed was vandalized. Ms. Mercurio cailed Steven Magner who gave her until the spring to do the outside work. On May 15 and 16, the shed was half down. On the weekend of the 23 and 24�', the shed was completely down. Ms. Mercurids took her lawn mower and string trimmer to the address on May 30, but the lawn was aiready mowed. Susan Mercurio stated the inspector Steven Magner checks her house everyday. She had asked to be given until May 30 to finish the work. Also, one of her potted plants is gone. Guy Willits reported an abatement was done. A letter was mailed May 20 to cut the grass. It was cut on May 29 because it was not cut by the owner on May 20. Gerry Suathman asked when the appeal was filed. Susan Mercurio responded the letter on her door said she had until May 27 to file the appeal. She filed the appeal that day. Mr. Suathman stated the appeal is stamped received by the City Clerk on May 28. Ms. Mercurio stated she received a notice from Shari Moore that the appeal was received on May 27. qg- sc� MINUTES OF Tf� LEGISLATTVE HEARING, 6-16-98 Page 3 Guy Willits stated he was notified on May 29 that the appeal was filed. Ms. Mercurio stated she has not received anything from the City. The only time she finds abatement notices is if they are taped to the house. Gerry Strathman asked aze the metal shed parts gone. Susan Mercurio responded yes. Mr. Strathman stated the appeal for that issue is moot. However, the order to remove the tall weeds and grass is appropriate. The summary abatement should not have been done if this appeal was filed by May 27. The stamp from the City Cierk's o�ce is May 28 and that should have stopped the summary abatement from being done. Susan Mercurio stated she would like her assessment mailed to 1005 Jessie Street. Chuck Votel stated the address on file for Ms. Mercurio is 1032 Duluth Street, Apartment 206. 1005 Jessie is a vacant building, and there has been a problem with the post office not delivering mail to vacant buildings. Ms. Mercurio stated she has changed addresses, is now using 1005 Jessie Sueet as her mailing address, and has been receivang mail there since last November. Gerry Strathman recommended denying the appeal citing the orders were correct, however it is meaningless because the shed parts aze gone and the grass is cut. When the assessment is received for the lawn, Susan Mercurio should file an appeal, and Mr. Strathman will be predisposed to grant it. The cuaent property owners have not discussed their intentions with the Division of Code Enforcement. The City has issued one summary abatement notice to secure the building. The $200 vacant building fee is unpaid. The real estate taates for 1995 and 1996 aze unpaid in the amount of $3,327.77. The cost to repair is $35,000; the cost to demolish is $5,750. No one appeazed representing the property. Gerry Strathman recommended approval of the 15 day order to remove or repair. 1171 Minnehaha Avenue West Chuck Votel reported this building was condemned in February 1998 and has been vacant since Mazch 1998. One summary abatement was issued to secure the building. The vacant building fees and taaces aze paid. The estimated cost to repair is $60,000, which does not make it feasible for rehabilitation. The estimated cost to demolish is $5,200. Chuck Votel stated he received a call from a Jennifer Watkins who lives next door. Ms. Watkins said she has acguired the building, plans to demolish it, and adding it as a side lot to her property. Mr. Votel expiained to Ms. Watkins the purpose of this hearing and told her she would have a reasonable amount of time to demolish the building herself. Ms. Watkins has already hired a contractor. Am� Woods, 1184 Minnehaha Avenue West, appeared and stated she laves across the street from this properry. She is concerned about the neighborhood. Ms. Woods urged the City to demolish 1171 Minnehaha. It is a mess. There is a lazge hole in the front yard. Ms. W oods stated she has never seen a house look this bad. Marjorie Van Dyke, 1178 Minnehaha Avenue West, appeared and stated she has lived in her house for fifty gears. The house at 1171 Minnehaha is an eyesore. The front stairs aze in poor condition and weeds are growing out of them. In the center of the yazd is wire fencing. Evidentiy, the fence is there to prevent people from falling over the broken sidewalk. Ms. Van Dyke would like to see the property demolished. �g- SG� MINU'I'ES OF TI� LEGISLATIVE HEARING, 6-16-98 Page 2 Cathy Lue, Coznmunity Organizer for the Hamline-Midway Coalition, appeazed and stated she has talked to neighbors who feel the house is in bad shape. These neighbors aze hopeful the properry will be demolished. Beth Randall, Hamline-Midway Area Rehabilitation Corporation (H-MARC) at 1558 Minnehaha Avenue West, appeared and stated H-MARC made an offer to purchase this property and Nancy Watkins made a higher offer. Ms. Randall stated she would like to see ll'71 Minnehaha demolished. There is a sink hole on the property. Ms. Randall stated she would like Ms. Watkins to have no more than 45 days to demolish the property. The door of the house was standing open, but yesterday it was secured again. Chuck Votel stated Jennifer Watkins intends to demolish the house, construct a garage in the reaz, and then construct a house in the front. Mr. Votel feels this is a good plan for the neighborhood. Beth Randail stated Nancy Watkins was arrears a year in taxes on her own property, therefore Ms. Randall was concemed that Ms. Watkins will not be able to maintain two properties and do improvements. Chuck Votel added that the ta�ces aze paid on 1171 Minnehaha. Gerry Strathman recommended approva] of the 15 day order to remove or repair. 1005 , essie Street Susan Mercurio, owner, appeazed and stated she is working on this house. Last month, she checked on the property almost everyday. She found a summary abatement notice on the door. There was a windstorm on May 15 and 16. Ms. Mercurio went to the house that weekend to check on any wind damage. She later had a tree removed. The code compliance report said that the shed had to be removed. Since the report was done, the shed was vandalized. Ms. Mercurio cailed Steven Magner who gave her until the spring to do the outside work. On May 15 and 16, the shed was half down. On the weekend of the 23 and 24�', the shed was completely down. Ms. Mercurids took her lawn mower and string trimmer to the address on May 30, but the lawn was aiready mowed. Susan Mercurio stated the inspector Steven Magner checks her house everyday. She had asked to be given until May 30 to finish the work. Also, one of her potted plants is gone. Guy Willits reported an abatement was done. A letter was mailed May 20 to cut the grass. It was cut on May 29 because it was not cut by the owner on May 20. Gerry Suathman asked when the appeal was filed. Susan Mercurio responded the letter on her door said she had until May 27 to file the appeal. She filed the appeal that day. Mr. Suathman stated the appeal is stamped received by the City Clerk on May 28. Ms. Mercurio stated she has not received anything from the City. The only time she finds abatement notices is if they are taped to the house. Gerry Strathman asked aze the metal shed parts gone. Susan Mercurio responded yes. Mr. Strathman stated the appeal for that issue is moot. However, the order to remove the tall weeds and grass is appropriate. The summary abatement should not have been done if this appeal was filed by May 27. The stamp from the City Cierk's o�ce is May 28 and that should have stopped the summary abatement from being done. Susan Mercurio stated she would like her assessment mailed to 1005 Jessie Street. Chuck Votel stated the address on file for Ms. Mercurio is 1032 Duluth Street, Apartment 206. 1005 Jessie is a vacant building, and there has been a problem with the post office not delivering mail to vacant buildings. Ms. Mercurio stated she has changed addresses, is now using 1005 Jessie Sueet as her mailing address, and has been receivang mail there since last November. Gerry Strathman recommended denying the appeal citing the orders were correct, however it is meaningless because the shed parts aze gone and the grass is cut. When the assessment is received for the lawn, Susan Mercurio should file an appeal, and Mr. Strathman will be predisposed to grant it. Gerry Strathman recommended approval of the 15 day order to remove or repair. 1171 Minnehaha Avenue West Chuck Votel reported this building was condemned in February 1998 and has been vacant since Mazch 1998. One summary abatement was issued to secure the building. The vacant building fees and taaces aze paid. The estimated cost to repair is $60,000, which does not make it feasible for rehabilitation. The estimated cost to demolish is $5,200. Chuck Votel stated he received a call from a Jennifer Watkins who lives next door. Ms. Watkins said she has acguired the building, plans to demolish it, and adding it as a side lot to her property. Mr. Votel expiained to Ms. Watkins the purpose of this hearing and told her she would have a reasonable amount of time to demolish the building herself. Ms. Watkins has already hired a contractor. Am� Woods, 1184 Minnehaha Avenue West, appeared and stated she laves across the street from this properry. She is concerned about the neighborhood. Ms. Woods urged the City to demolish 1171 Minnehaha. It is a mess. There is a lazge hole in the front yard. Ms. W oods stated she has never seen a house look this bad. Marjorie Van Dyke, 1178 Minnehaha Avenue West, appeared and stated she has lived in her house for fifty gears. The house at 1171 Minnehaha is an eyesore. The front stairs aze in poor condition and weeds are growing out of them. In the center of the yazd is wire fencing. Evidentiy, the fence is there to prevent people from falling over the broken sidewalk. Beth Randall, Hamline-Midway Area Rehabilitation Corporation (H-MARC) at 1558 Minnehaha Avenue West, appeared and stated H-MARC made an offer to purchase this property and Nancy Watkins made a higher offer. Ms. Randall stated she would like to see ll'71 Minnehaha demolished. There is a sink hole on the property. Ms. Randall stated she would like Ms. Watkins to have no more than 45 days to demolish the property. The door of the house was standing open, but yesterday it was secured again. Chuck Votel stated Jennifer Watkins intends to demolish the house, construct a garage in the reaz, and then construct a house in the front. Mr. Votel feels this is a good plan for the neighborhood. Beth Randail stated Nancy Watkins was arrears a year in taxes on her own property, therefore Ms. Randall was concemed that Ms. Watkins will not be able to maintain two properties and do improvements. Last month, she checked on the property almost everyday. She found a summary abatement notice on the door. There was a windstorm on May 15 and 16. Ms. Mercurio went to the house that weekend to check on any wind damage. She later had a tree removed. The code compliance report said that the shed had to be removed. Since the report was done, the shed was vandalized. Ms. Mercurio cailed Steven Magner who gave her until the spring to do the outside work. On May 15 and 16, the shed was half down. On the weekend of the 23 and 24�', the shed was completely down. Ms. Mercurids took her lawn mower and string trimmer to the address on May 30, but the lawn was aiready mowed. Susan Mercurio stated the inspector Steven Magner checks her house everyday. She had asked to be given until May 30 to finish the work. Also, one of her potted plants is gone. Guy Willits reported an abatement was done. A letter was mailed May 20 to cut the grass. It was cut on May 29 because it was not cut by the owner on May 20. Gerry Suathman asked when the appeal was filed. Susan Mercurio responded the letter on her door said she had until May 27 to file the appeal. She filed the appeal that day. Mr. Suathman stated the appeal is stamped received by the City Clerk on May 28. Susan Mercurio responded yes. Mr. Strathman stated the appeal for that issue is moot. However, the order to remove the tall weeds and grass is appropriate. The summary abatement should not have been done if this appeal was filed by May 27. The stamp from the City Cierk's o�ce is May 28 and that should have stopped the summary abatement from being done. Susan Mercurio stated she would like her assessment mailed to 1005 Jessie Street. Chuck Votel stated the address on file for Ms. Mercurio is 1032 Duluth Street, Apartment 206. 1005 Jessie is a vacant building, and there has been a problem with the post office not delivering mail to vacant buildings. Ms. Mercurio stated she has changed addresses, is now using 1005 Jessie Sueet as her mailing address, and has been receivang mail there since last November. Gerry Strathman recommended denying the appeal citing the orders were correct, however it is meaningless because the shed parts aze gone and the grass is cut. When the assessment is received for the lawn, Susan Mercurio should file an appeal, and Mr. Strathman will be predisposed to grant it.
