In 1999, the lead reducfion proguns will operate within the City-County Public Health Service through a Joint
Powers agreement between the City of Saint Paul and Ramsey County. The attached Memo of Understanding
has been negofiated between the City and AFSCME Council 14, Locals 2508 and 1842 to implement the
changes necessitated by the lead abatement JPA.
ADVANTAGESIFAPPROVED:
The lead reduction programs affecting the health of city residents can be most effectively managed if working
withiti the Public Health services instead of Housing Code Enforcement. This agreement provides the necessary
change to existing bargaining contracts to facilitate this transfer of operations.

LEAD HAZARD REDUCTION PROGRAM,

December 2, 1998
Tbis Memorandum of Understanding is made and entered into by and between tt�e City of
Saint Paul (hereafter "City"), AFSCME Council No. 14, its City Locals 1842 and 2508 (hereafter
"City Locals") for the purpose of describing terms and conditions of employment affecting certain
employees of the Lead Paint Hazard Control and Lead Hazard Reduction Programs in the Saint Paul
Citizen Service Office (hereafter "CSO") who, as of January 1, 1999, will be assigned to the
combined City-County public health department as defined in the 1997 Me;norandum of
Understanding dated April 17, 1997, betweeu the City and Ramsey County (hereafter ° 1997 MOU").
The present Memorandum of Understanding concerns individuals employed by the CSO on
December 31, 1998, in the technical job classes of Environmental Health Inspector and
Environmental Heaith Inspector Supervisor, and in the clerical promotional class series up to and
including Clerk IV ( hereafter collectively referred to as "CSO Job Classes").
THE FOLLOWING TERMS ARE ADDED TO EXISTING PROVISIONS OF THE
1997 MOU AND ARE AGREED TO BX THE PARTIES:
Section II. A. Lavoff and Reinstatement, Paragraph 1 entitled Lavoff shall have a
second paragraph that reads:
After January 1,1999 an individual in the CSO Job Classes notified of layoff in either the

CSO or in the combined City-County public health department who is also a City employee at the
time of layoff, may elect to fill a vacancy in other City departments in the same job class. If no
vacancy exists, such employee may elect to bump the least senior employee in the same job class
in the CSO or in the combined City-County public health department, wherever the least senior
position in the same job class is located.
Section II. B. Filling Positions, paragraph 1 entitled Promotions to Non-Sunervisorv
Positions shall have a second paragraph added that reads:
After January 1, 1999, any vacancy to be filled in the CSO Job Classes, in either the CSO
or in the combined City-County public health department, shall first be filled by City employees in
tl�at particular job class of Qie CSO aud/or Q�e combined City-County public health department, if
these employees are eligible, through the Saiut Paul Civil Service selection process and any
applicable City collective bazgaining agreement. The right to qualify for positions in the combined
City-County public health department is limited to only those individuals employed by the City in
the CSO Job Classes prior to January l, 1999. Any position that was assigned to the combined City-
County public health department as of January 1, 1999, and not filled by the method inciuded in this
paragraph, will then become a RCDPH position as defined by the 1997 MOU and filled in
accordance with Ramsey County procedures.
The balance of the 1997 MOU applies according to its stated terms. On .January 1,
1999, City employees in the CSO Job Classes in the Lead Paint Hazard Control and Lead
Hazard Reduction Programs will be treated as SPPH Employees as defined in the 1997 MOU

with an assignment date of January 1, 1999. City employees, who after January 1, 1999,
