ADMINISTRATIVE ORDER, That the proper City officers are hereby authorized
and directed to execute, on behalf of the City of St. Paul , Supplement
No. 1 (a copy of which is attached hereto and incorporated herein by
reference) to Agreement No. 57474, between the City of St. Paul , the
St. Paul Board of Water Commissioners and the State of Minnesota, De-
partment of Highways, covering the construction, engineering inspection,
contract administration and costs arising therefrom involved in the State
construction of City Projects No. P-0597, B-1041 , S-1519 and T-1059, known
as MARYLAND AVE. - 135E to Westminster St. ; and be it
FURTHER ORDERED, That the construction and engineering inspection
costs payable to the State by the City under the terms of this agree-
ment, estimated as a sum of $372,693.87, shall be paid from P. I .R. Fund
Code 60000, said fund to be reimbursed from 1968, 1970 and 1971 County
Aid Funds, and from funds deposited by K-Mart and Plywood Minnesota.
All costs shall be accounted for under Department of Public Works Proj-
ects No. P-0597, B-1041 , S-1519 and T-1059. All cost and financing es-
timates remain as itemized in Administrative Order No. D-941 , dated
November 5, 1973.

Dear Ms. Mix:
Transmitted herewith are two copies (one blue backed copy with original
signatures and one xerox copy) of the fully executed Supplement No. 1 to
the above referenced tri-party agreement between this department, the City
of St. Paul and the City of St. Paul Board of Water Commissioners. This
supplemental agreement amends and modifies PART I of said Agreement No.
57474 which part provides for the City to appoint the Commissioner of High-
ways to act as its agent and let a construction contract to include City
Project No. 164-020-23 for the above said improvement of East Maryland
Avenue and Bridge No. 6513. Said amendments and modification to Agreement
No. 57474 were mutually agreed upon by the City and this department and are
to provide for the following:
(1) Base the City's share of the construction engineering costs incurred
by the State in connection with the City's cost participation con-
struction on actual engineering costs rather than the agreement pro-

vided for 8 percent of the City's total share of construction costs;
(2) Clarify the provision dealing with the State's responsibility to main-
tain and/or reconstruct said Bridge No. 6513 by the insertion of the
word "future" before maintenance and/or reconstruction;
(3) Add to the claims section of the agreement a provision wherein the
State agrees that all employees of the State and all other persons
employed by the State in connection with the aforesaid East Maryland
Avenue construction project shall not be considered employees of the
City and said State employees shall be the obligation and responsibility
of the State;
(4) Revision of the basis of City payment portion of the agreement to pro-
_ vide for a 100 percent City cost share of the construction of a "full
traffic actuated control system" and the K-Mart and Plywood Minnesota
intersections which construction is not eligible for Federal-aid funds
participation.
The enclosed supplemental agreement copies may be retained for the City's
use.
