3 WHEREAS, Highwood Center, Zoning File # 07-206-001, submitted for City Council approval the attached
4 Preiiminary and Final Piat for Highwood Center to create 1 commercial parcei, at 1744 Old Hudson Road,

� WHEREAS, the appropriate City departments have reviewed the plat and found, subject to the
8 recommended conditions, that it meets the requirements of Chapter 69 of the Zoning Code; and
� o WHEREAS, notice of public hearing before the City Council was duly published in the official newspaper
t � of the City on December 10, 2009, and notices were duly mailed to each owner of affected property and

WHEREAS, the City Council held a public hearing on the proposed plat on January 6, 2010, at which all
interested parties were given an opportunity to be heard, the Council having considered all the facts and
recommendations concerning the subdivision;
NOW, THEREFORE BE IT RESOLVED, that the City Council accepts and approves the attached
preliminary and final plat for Highwood Center to create 1 commercial parcel, subject to the following
conditions:
1. A parkland cash dedication in the amount of $2,417.33 is paid prior to the city clerk signing
the finai piat; and
2. The applicant shall file a copy of the Council Resolution approving the plat with the
Ramsey County Recorder's O�ce.
2'1 AND BE IT FURTHER RESOLVED, that the City Clerk shall mail a copy of this resolution to the Applicant,

City staff have reviewed the proposed subdivision, approved the Preliminary Plat on January 17,
2008, and signed off on the Final Plat on December Z, 2009. A staff report will be prepared and
provided to the City Council the week prior to the publ+c hearing

public hearing request will appear on the agenda on or before the December 23, 2009 City

A. PURPQSE: Preliminary and Final Plat for Highwood Center to create 1 commercial parcei
B. PARCEL SIZE: 143.4 ft. of frontage on Otd Hudson Rd. and total lot area of 48,284 sq. ft.
C. EXISTING LAND USE: Medical o�ce buildinglclinic
D. SURROUNDING LAND USE: The site is within the Old HudsonlWhite Bear commercial node.
Grace Lutheran Church is immediately to the west of the site; I-94 is immediately to the south.
E. ZONING CODE CITATiON: §69.301 siates ihat platting is required when a subdivision (1) creates
five or more lots or parcels each of which is 2'IZ acres or less in size, or (2) requires paved streets,
alieys and oiher public improvements, or (3) is previously unplatted land. §69.406 provides criteria
for review of subdivision applications. These criteria are covered below under "Required Findings.°
§69.511 regulates parkland dedication.
�. HISTORYlDISCUSSION: This piat application was first submitted in 2007. At the same time, a site
plan was submitted for a commerciai officelretaii building (File # D7-129847). The site plan was
subsequently aQproved, the building has been constructed.
G. DISTRICT COUNCiL RECOMMENDATION: Di§trict 1 had not commented at the time this staff
report was prepared.
H. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that all of the fo{lowing findings shall
be made prior to approval of a subdivision:
1. Ail the applicable provisions of the Legis(ative Code are complied with. City staff have
reviewed the proposed plat and have determined that all applicabie provisions af city codes are
met.
2. The proposed subdivision wili not be detrimental to the p�esent and potentia! surrounding land
uses. The proposed piat is consistent wiih the surrounding land uses, and will not be
detrimental io present and future use of surroundi�g land.
3. The area surrounding the subdivision can be planned and developed in coordination and
compatibility with the proposed subdivision. The area surrounding the proposed piat is already
deveioped and compatible with the proposed piat.
4. The subdivision is in conformance with the comprehensive plan. The subdivision is in
conformance with the General Policy chapter of the comprehensive plan, which calis for
ensuring fand resources with business potential are made available. It is also in conformance
with redevelopment plans for the area. The District 1 Plan Summary (2004) supports
maintaining of the vitality of the commercial areas.
� 5. The subdivision preserves and incorporates fhe site's importanf existing natural features
whenever possible. The site is in a fully-developed part of St. Paui with no remaining naturai
features.
6. A!/land intended for building sites can be used safely wifhout endangering residents by peri!
from floods, erosion, confinuously high water table, severe soil conditions or ofher menace.

The site is a fully developed area w+th no flooding, erosion, high water tabie ar soil conditian
probiems.
7. The subdivision can be economically served wifh public facilities artd services. The subdivision
can be economically served with pubiic facilities and services from surrounding streets.
I. PARKlAND DEDICATION: §&9.511 requires dedication of two (2) percent of the total land area
of the plat for public use; for parks, playgrounds, trails, open space, or conservation purposes, At
the discretion of the Cifij Council, a cash dedication in lieu of land may be paid prior to the city
cleric's signing of the ftnal plat.
For Yhis plat, staff recommends a cash dedicatia� in the amount of $2,417.33 in lieu of dedication
of land.
J. STAFF RECOMMENDATION; Based on required findings 1 through 7, staff recommends approval
of the preliminary and fina! plat for Highwood Center subject to the following conditions:
1. A parkland cash dedication in fhe amount of $2,417.33 is paid prior fo the city cierk signing fhe
final plat.
2. The applicant shail file a copy of the Council Resolution approving tfie plat with the Ramsey
County Recorder's Office.
