1 W�IEREAS, Depaztment of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a two-story, wood frame house and its two-stall wood frame detached garage
4 located on property hereinafter referred to as the "Subject Properiy" and commonly known as
5 996 AURORA AVENUE. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before June 8, 2009 the
following are the now known interested or responsible parties for the Subject Property: Melanie
Liska, Attorney at Law, 1539 Grand Ave, St Paul, NII� 55105; Thomas L Nins, PO Box 674,
Old Greenwich, CT 0687Q; Myrle E Nins c/o St Paul Church Home, 484 Ashland Ave, St Paul,
MN 55102; Leon Nins, Woodbury HHC, 7012 Lake Road, Woodbury, MN 55125; Suminit-
Unniversity Planning.
WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated September 9, 2009; and
WHEREAS, this order informed the then known interested or responsible parties that tl�e
shucture located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested ar responsible parties that they must repair
or demolish the structure located on the Subject Property by October 9, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparrinent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible partaes have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul LegislaUve Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, December 22, 2009 to hear testimony and evidence, and after
receiving tesUmony and evidence, made the recommendation to approve the request to order the

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
rehabilitating this structure in accordance with all applicable codes and ordinances, or in the
aiternative by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The rehabilitation or demolition of the structure to be completed within sixty
(60) days after the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on W ednesday,
January 20, 2010 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 966 AURORA AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies ar to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
I�ispections, Vacant/Nuisance Buildings.
That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the struchue in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within sixty
(60) days after the date of the Council Aearing.
If the above correcrive acrion is not completed witYun this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this sh fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislati��e Code.

remove this building in a timely maaner, and failing that, authorize Yha Depariment of Safety and
Inspections to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a speeial assessment to be collected in the same manner as taaces.

The building is a two story. wood frame, single-family dwelling with a detached two-stail garage
on a lot of 6,534 square feet.
According to our files, it has been a vacant building since August l, 2007.
The current property owner is Thomas L.1_�ins, per AMANDA and Ramsey County Property
records.
The city has had to board this building to secure it from trespass.
There have been nine (9) SUMMARY ABATEMENT NOTICES since 2007.
There have been nine (9) WORK ORDER(S) issued for:
- Improperly stared refuse, garbage and misc debris
- Boarding/Securing
- Removal of tall grass and weeds
On September 1, 2009, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on September 9, 2009 with a compliance date of
October 9, 2009. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid. (Fee assessed 09/03/2009 and pending for 3D
days, until 10/03/2009)
Taxation has placed an estimated market value of $24,800 on the land and $90,700 on the
building.
As of September 1, 2009, a Code Compliance Inspection has been completed.
As of October 14, 2009, the $5,000.00 performance bond has been posted.
Real Estate taxes for the year 2009 are delinquent in the amount of $3,62230, plus penalty and
interest.
Code Enforcement Officers estimate the cost to repair this structure is $40,000 to �50,000.
The estimated cost to Demolish is �9,000 to $10,000.

Inspections, Division of Code Enforcement, hereby declares the premises located at:

This list of deficiencies is not necessarily all the defciencies present at this time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall
not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued. All repairs must be in accordance with
appropriate codes. Changes or additions to the electrical system, mechanical system, or
the plumbing system may necessitate updating or upgrading the systems involved.

Install hand and guardrails on all stairways and steps as per attachment.
Tnstall plinth blocks under posts in basement.
Tuck Point interior(exterior foundation as needed.
Install floar covering in the bathroom and kitchen that is impervious to water.
Install tempered glass in window on stair landing to Code.
Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
Repair or replace any deteriorated window sash, broken glass, sash holdexs, xe-putty ete. as
necessary.
Provide complete storms and screens, and repair all door and window openings.
Where wall and ceiling covering is removed, attic, replace doors and windows, (insulation,
glass, weather stripping, etc.) shall meet new energy code standards.
Prepare and paint interior and exterior as necessary (take the necessary precautions if lead base
paint is present).
Provide general clean-up of premise.
Provide smoke detectors as per the Minnesota State Building Code.
Repair soffit, fascia trim, etc. as necessary.
Provide proper drainage around house to direct water away from foundation.
Install downspouts and a complete gutter system where needed.
Provide general rehabilitation of garage.
Repair chimney on exterior of house.
New lattice under porch needs to be decay resistant or treated wood.

ELECTRICAL
1. Ground the electrical service to the water service within �'of the entrance point of the
water service.
2. Bond around water meter with a copper wire sized for the electrical service per Article
250 of the NEC.
3. Provide a complete circuit directory at service panel.
4. Verify/install a separate 20 ampere laundry circuit & a separate 20 ampere kitchen
appliance circuit.
5. Install "S" type fuse adapters and proper size "S" fuse or listed circuit breaker.
6. Verify that fuse amperage matches wire size.
7. Close open knockouts in junction boxes with lrnockout seals.
8. Properly strap cables and conduits in basement or service conduit on the exterior of the
house.
Provide one (1) light for each 200 square feet in unfinished basement. One light must
be switch at top of stairs.
Install GFCI receptacle in basement/first bathroom/second bathroom adjacent to
the sink.
Ground bathroom light in second floor bathroom and disconnect receptacle on
fixture.
Install globe-type enclosed light fixture on all closet lights.
Remove all cord wiring.
Repair or replace all broken, missing or loose light fixtures, switches & outlets, covers and
plates.
Check all 3-wire outlets for proper polarity and verify ground.
Remove any 3-wire ungrounded outlets, and replace with 2-wire, or ground 3-wire to code.
Through-out building, install outlets and light fixtures, as specified in Bulletin 80-1.
Install hard-wired, battery backup smoke detector, as specified in Bulletin 80-1, and other
smoke detectors as required by the IRC.
Install exterior lights at side and back enhy doors.
Remove and/ar rewire all illegal, improper ar hazardous wiring in basement/garage.
All electrical work must be done by a licensed electrical contractor under an electrical pernut.
Any open walls, or walls that aze opened as part of this project, must be wired to the standards
ofthe
2005 NEC.
PLUMBING
All plumbing work requires pernut(s) and must be done by a plumbing contractor licensed in
Saint Paul.

NOTES
Most of the roof covering could not be inspected. All must meet appropriate codes when
completed.
There was considerable storage/clutter within property at the time of the inspection. Property is
to meet appropriate Codes when complete.
This is a registered vacant building. In order to reoccupy the building, all deficiencies
listed on the code compliance report must be corrected and be in compliance with the
Minimum Housing Standards of the St. Paul Legislative Code (Chapter 34), and all
required permits must receive final approval.
ORDER:
Repair the structure to a habitable condition.
This structure is a re�stered vacant building that must haue a Code Compliance Certificate
before the structure may be occupied.
Obtain a Code Compliance Certificate from the Department of Safety and Inspections. You
may contact Jim Seeger at 651-266-9046, for a code compliance inspection, permits, and
issuance of the Code Compliance Certificate.
Under Chapter 33.03 of the Saint Paul Legislative Code, failure to obtain a Code Compliance
Certificate before occupying the shucture may result in issuance of criminal summonses.

As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by October 9, 2009 the Deparhnent of Safety and
Inspections, Division of Code Enfarcement, will bea n a substantial abatement process to
demolish and remove the building(s). The costs of this action, includang administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Tnspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 22Q (651)266-8989. This
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition.
If this building is located in a historic district ar site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Department of 5afety
and Tnspections web site (see letterhead) and from the HPC staf£ No permits will be issued
without HPC review and approval. HPC staff also can be reached by calling 651-266-9078.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transferred or conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If conective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. .The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

2. Ordering the owner to remove or repair the building(s) at 996 Aurora Avenue within fifteen
(15) days from adoption of resolution.
Melanie Liska, attomey represettting Sharon Nins, the personal representative of the estate of Leon
Nins. Vincent Ufiano also appeazed and stated that he was a licensed contractor hired by the estate
to make the necessary repairs to the building to bring it into code compliance.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two
story, wood frame, single-family dwelling with a detached two-stall garage on a lot of 6,534 square
feet and had been vacant since August 1, 2007. A code compliance inspection had been done on
September 1, 2009, the vacant building registration fees in the amount of $1,000 went to assessment
on September 3, 2009, and the $5,000 performance bond had been posted on October 14, 2009. On
September 1, 2009, an inspection of the building was done and a list of deficiencies which
constitute a nuisance condition was developed. An order to abate a nuisance building was posted on
September 9, 2009 with a compliance date of October 9, 2009. To date, the property remained in a
condition which comprised a nuisance as defined by the Legislative Code. Ramsey County
TaYation estimated the market value of the land to be approxnnately $24,800 and the building to be
$90,700. Real estate talces for 2009 were delinquent in the amount of $3,622.30, plus penalty and
interest. Code Enforcement estimates the cost to repair the building to be approximately $40,000 to
$50,000. The cost for demolition was estimated to be approlcimately $9,000 to $10,000. There had
also been nine summary abatements issued to this property since 2007, nine ofwhich went to work
order: to secure the building and the City had to board the building to secure it from trespass,
remove improperly stored refuse and debris, boarding/securing, and cut tall grass and weeds. Mr.
Magner stated that he had talked to the contractor who had pulled the necessazy permits and
indicated that he planned to be finished with the rehab by the first week in January. He said that
DSI had no objection to the completion of the rehabilitation. He presented photographs of the
property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1908 and was a Queen Anne-style building. The building had good integrity and although it was
not located in any potential historic district, she encouraged rehab of the building.
Ms. Liska stated that Mr. Uliano had completed 80 to 85 percent of the repairs and they were
requesting additional time to be able to complete the remainder of the repairs. After the property is
completely rehabbed, the estate will convey title to Mr. Uliano. Mr. Uliano stated that he believed
he needed approximately four to five weeks to complete the repairs.
Ms. Moermond asked about the delinquent YaYes. Ms. Liska responded that I,eon Nins had been in
the nursing home for quite some time and Ramsey County had a$45,000 taac lien against the
property. She said that all outstanding debts against the estate would be paid at closing when the
transfer of title occurs.
Ms. Moermond asked Mr. Uliano whether 60 days would be adequate time for him to complete the
rehab. Mr. Uliano responded that he believed the rehab should be completed by that time.
Ms. Moermond recommended the building be removed or repaired within 60 days.
