WFIEREAS, Department of Safety and Tnspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a single story, wood frame, single family dwelling and its oversized, single stall,
wood frame, detached garage located on property hereinafrer referred to as the "Subject
Property" and commonly known as 1455 ALAMEDA STREET. This property is legally
described as follows, to wit:
NORTHERN PACIFIC ADDITION TO THE CITY OF ST. PAUL, MINN. EX ALLEY S 1/2
OF LOT 9 AND ALL OF LOT 10 BLK 5 '
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before June 15, 2009 the
following aze the now known interested or responsible parties for the Subject Property: Janet M
Shetka
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order idenrified as an"Order to
Abate Nuisance Building(s)" dated September 9, 2009; and
WHEREAS, this order informed the then known interested or responsible parties that the
structute located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by October 9, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Qfficer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 0£ the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, December 22, 2009 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
demolisfling and removing the structure in accardance with all applicable codes and ordinances.
The demolition of the shucture to be completed within fifteen (15) days after the date of the
Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
January 20, 2010 and fhe testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Property at 1455 ALAMEDA STREET.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
fave thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections bas posted a placard on the 5ubject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routlnely monitored by Department of Safety and
Inspections, VacantlNuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within t"�fteen (15) days after the date of the Council
Hearing.
2. If the above conective action is not completed within this period of time Departsnent of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, a11
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul sha11 remove and dispose of such property as provided by law.
4. It is fiuther ordered, Yhat a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The Deparhnent of Safery and Inspections has declared this building(s) to constitute a"nuisance"
as defined by Legislarive Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then known responsible parties to eliminate this nuisaace condition by
correcting the de&ciencies or by razing and removing this building(s).
The property was re-inspected on September 9, 2009. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting influence
of this property. It is the recommendation af the Department of Safety and Inspections that the
City Council pass a resolufion ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safery and
Inspections to proceed to demo]ition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as tases.

The building is a one story, wood frame, single-family dwelling with a detached oversized single
stall garage and a wood frame shed on a lot of 7,841 square feet.
Accarding to our files, it has been a vacant building since July 29, 2008.
The current property owner is danet M Shetka, per AMANDA and Ramsey County Property
records. (Note: Personal ser�vice went to BanePlus Mortgage Corp. in Dallas, TX)
There have been two (2) SUMMARY ABATEMENT NOTICES since 2008.
There has been one (1) WORK ORDER(S) issued for:
- Improperly stored refuse, garbage and misc debris
On August 18, 2009, an inspection of the building was conducted, a list o£ deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORAER TO
ABATE A NUISANCE BUILDING was posted on September 9, 2009 with a compliance date of
October 9, 2009. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid. (Fee assessed 09/03/2009 and pending for 30
days, untill0/03/2009)
Taxation has placed an estimated market value of $94,200 on the land and $92,100 on the
building.
As of December 17, 2009, a Code Compliance Inspection has not been coinpleted.
As of December 17, 2009, the $5,000.00 performance bond has not been posted.

Dear Sir ar Madam:
The VacanUNuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
1455 ALAMEDA ST
and legally described as follows, to wit:
NORTHERN PACIFIC ADDITION TO THE CITY OF ST. PAUL, MINN. EX ALLEY
S 1!2 OF LOT 9 AND ALL OF LOT 10 BLK 5
to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On August 18, 2009, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of de�iciencies is not necessarily all the deficiencies present at this time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall
not again be used for occupancy until such time as a Certificate of Compliance or a
Certi�cate of Occupancy has been issued. All repairs must be in accordance with
appropriate codes. Changes or additions to the electrical system, mechanical system, or
the plumbing system may necessitate updating or upgrading the systems involved.
This is a single story, wood frame, single family dwelling and its oversized, single
stall, wood frame, detached garage.

1. The chimney is defective, deteriorated or in a state of disrzpair. Replace ali
missing or defective bricks, tuckpoint as needed to restore the chimney to a
professional state of maintenance and repair. Permit may be required.
2. The eaves and soffits are in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
3. The exterior walls and(or trim of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
4. The foundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tight, water-tight and
rodent-proof condition. Permit may be required.
The exterior walls of the house and/or garage are defective. Repair all holes,
breaks, loose or rotting siding, to a professional state of maintenance.
6. STORM DOOR(S): The storm door(s) are in disrepair; repair or replace the
door(s).
7. The window and/ar door screens are missing defective or in a state of
disrepair. Provide proper window and door screens for a11 openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
8. The windows and/or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
As owner, agent or responsible party, you aze hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by Octaber 9, 2009 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 3ackson Street, Suite 220, (651)266-8989. This
inspection will identify specific defects, necessary repairs and legal requirements to conect this
nuisance condition.
If this building is located in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the

guidelines and design review application and forms aze available from the Department of Safety
and Inspections web site (see letterhead) and from the HPC staf£ No permits wiil be issued
without HPC review and approval. HPC staff also can be reached by caliing 651-266-9078.
As an owner or responsible party, you aze required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent rentezs and
any subsequent owners. The property shall not be sold, transfened ar conveyed in any manner
unril the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condirion", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If conective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either arder the City to take the
abatement action ar fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

1. Ordering the owner to remove or repair the building(s) at 1455 Alameda Street within
fifteen {15} days from adoption of resolution.
The property owner of record, Janet Shetka, did not appear. Dick Dian, 1474 Alameda Street,
appeared and stated that he was a neighbor to this property and wished to see the building
demolished.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a one
story, wood frame, single-family dwelling with a detached, oversized one stall garage and a wood
frame shed on a lot of 7,841 square feet and had been vacant since July 29, 2008. A code
compliance inspecrion had not been done, the vacant building registration fees in the amount of
$1,000 went to assessment on September 3, 2009, and the $5,000 performance bond had not been
posted. On August 18, 2009, an inspection of the building was done and a list of deficiencies which
constitute a nuisance condition was developed. An order to abate a nuisance building was posted on
September 4, 2009 with a compliance date of October 9, 2009, To date, the property remained in a
condition which comprised a nuisance as defined by the Legislative Code. Ramsey County
TaYation estimated the market value of the land to be approximately $94,200 and the building to be
$91,100. Real estate tases were. Code Enforcement estimates the cost to repair the building to be
approximately $30,000 to $40,000. The cost for demolition was estimated to be approximately
$8,000 to $10,000. There had also been two summary abatements issued to this property since
2Q08, one of which went to work order: to secure the building and the City had to board the
building to secure it from trespass and remove improperly stored refuse and debris. Code
Enforcement recommends the building be repaired ar removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1947 and was a cottage-style building. From the photographs, the exterior appeared to be in good
condition with stucco and brick veneer. It was not located in any historic district and on its own,
did not meet any criteria for designation. Since there weren't any photographs of the interior of the
building, she didn't feel comfo� making a recommendation on whether the building should be
rehabbed or demolished.
Mr. Magner stated that inspectors had been inside the buiiding and found it to be dilapidated with
holes in the wa11s and had not been maintained. Ae said the utilities had been tampered with and
Xcel had cut the power at the pole. He said this neighborhood typically did not experience issues
with vacant buildings; however, there was a lengthy history of problems concerning the individuals
who resided at this property.
Mr. Dian stated that he had looked at the house and he, as well as his neighbors, had considered
purchasing it to rehab it for sale. He said he understood the interior was completely trashed, had
never been taken care of, drugs were stashed and sold from the house, and he believed it should be
demolished. He said the owner, as well as the sons, had chemical dependency issues and had been
in and out of jail. He was also aware that the sons stole property and stashed it in the house as well.
Ms. Moermond read into the record two letters zeceived from neighboring property owners
requesting the property be demolished. Said letters aze attached and made a part of this record.

Ms. Moermond requested Mr. Magner provide her with interiar photographs of the property before
she would make a decision. After the hearing, Ms. Moermond reviewed the photographs of the
interior o£the building indicating that it appeazed to be a severe fire hazard. She recommended the
building be removed within 15 days with no option for repair.
