VJHEREAS, Department of Safety and Inspections has requested the City Council to hold public hearings to consider the advisability and necessity of ordering the repair or wrecking and removal of a one and one half story wood frame house located on property hereinafter referred to as the "Subject Property" and commonly known as 692 MINNEHAHA AVENUE WEST. This property is legally described as follows, to wit: Syndicate No 4 Addition Lot 4 Blk 2 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 �, » 34 35 36 37 38 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before January 24, 2010, the following are the now known interested or responsible parties for the Subject Property: Paula Costilla, 981 St. Albans St N, #206, St. Paul, MN 55103; Resmae Mortgage Corp., 6 Point Drive, Brea, CA 92821; Thomas-Dale/District 7 Planning Cauncil; and WHEREAS, Department of Safety and Inspections has notified the known interested or responsible parties of the "Order to Abate Nuisance Building(s)" dated Apri121, 2010 as provided for in Chapter 45 of the Saint Paul Legislative Code; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair ar demolish the structure located on the Subject Property by May 21, 2010; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public heazings before the Legislative Heazing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing O�cer of the Saint Paul City Council on Tuesday, 3une 22, 2010 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested 10-796 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 or responsible parties to make the 5ubject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition of the struchu to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, July 21, 2010 and the tesfimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Pau1 City Council hereby adopts the following Findings and Order concerning the Subject Property at 692 MINNEHAHA AVENUE WEST. 1. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. Thaf the costs of demolirion and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). 3. That there now exists and has existed multiple Housing or Building code viola6ons at the Subject Property. 4. That an Order to Abate Nuisance BuIlding(s) was sent to the then lrnown responsible parties to correct the deficiencies or to demolish and remove the building(s). � 7 That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placard an the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. If the above conective acrion is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by t1�e City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance wifh Chapter 45 of the Saint Paul LegislaCive Code. According to our files, it has been a vacant building since July 1, 2008. The current property owner is Paula Costilla, per AMANDA and Ramsey County Property records. The city has had to board this building to secure it from trespass. There have been thirteen (13) SUMMARY ABATEMENT NOTICES since 2008. There have been twenty-four (24) WORK ORDER(S) issued for: - Boarding/Securing - Improperly stored refuse, garbage and misc debris - Removal of tall grass and weeds - Removal of snow and ice On March 23, 2010, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on April 21, 2010 with a compliance date of May 21, 2010. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid through assessment on 7/17/09. Provide this office with a copy of the extermination report from a licensed professional Pest Control Operator, and follow their recommendations to eradicate these pests. 3. Lacking deadbolt door locks. Provide one-inch throw deadbolt locks for all entry doors to dwelling unit(s). 4. Lack of Electricity. Immediately restore electrical service. Scrape and repaint to effect a sound condition in a professional manner. 4. Screens must be tight-fitting and securely fastened to the frames. 14. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardware and associated trim in a professional manner. Permit may be required. 15. Lacking window locks. Provide operable window locks for all windows except third floor and above. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by May 21, 2010 the Deparhnent of Safety and Inspections, Division of Code Enforcement, will bea n a substantial abatement process to demolish and remove the buildind(s). The costs of this action, including administrative costs June 24,2010 692 MINNEHAHA AVE W page 4 10-796 and demolition costs will be assessed against the property taaces as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, S75 Jackson Street, Suite 220, (651) 266-8989. This inspection wilt identify specific defects, necessary repairs and legal requirements to correct tl�is nuisance condition. You may also be required to post a five thousand dollar ($5,000.00) performance bond with the Department of Safety and Inspections before any permits are issued, except for a demolition permit. Call the Deparkment of Safety and Inspections fox more information at 651-266-8989. If this building is located in a historic district or site (noted on page 1, above, just below the property address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for the repairs required by this order and compliance with preservation guidelines. Copies of the guidelines and design review application and forms are available from the Deparhnent of Safety and Inspecrions web site (see letterhead) and from the HPC staff. No permits will be issued without HPC review and approval. HPC staff also can be reached by calling 651-266-9078. As an owner or responsible party, you are required by law to provide full and complete disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and any subsequent owners. The property shall not be sold, transferred or conveyed in any manner until the Nuisance Conditions have been abated and the Certificate o£ Code Compliance or Certificate of Occupancy has been issued. The Enforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance condition", subject to demolition and removal by the City. This placard shall not be removed without the written authority of the Department of Safety and Inspections, Division of Code Enforcement. The department is further required to file a copy of this "Order to Abate" with the City Clerk`s Office. If conective action is not taken within the time specified in this order, the Enforcement Officer wIll notify the City Council that abatement action is necessary. The City Clerk will then schedule dates for Public Hearings before the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. If the resolution calis for abatement action the Council may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action is not taken within the specified time, the City shall abate this nuisance. Ordering the owner to remove or repair the building(s) at 692 Minnehaha Avenue West within fifteen (15) days from adoption of resolution. The property owner of record, Paula Costilla, did not appear. No other parties of interest appeared. 10-796 Mr. Yannarelly stated that the building was a one and one-half story, wood frame, single-family dwelling on a lot of 4,792 square feet and had been vacant since July 1, 2008. A code compliance inspection had not been done, the vacant building registration fees in the amount of $1,000 went to assessment on 7uly 17, 2�04, and the $5,000 performance bond had not been posted. On March 23, 2010, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on April 21, 2010 with a compliance date of May 21, 2010. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $16,500 and the building to be $4,900. Real estate taxes for 2007, 2008, 2009 and the first half of 2010 were delinquent in the amount of $7,943.28, plus penalty and interest. Code Enforcement estimates tha cost to repair tha building to exceed $100,000; the cost for demolition to exceed $10,000. There had also been 13 summary abatements issued to this property since 2008, 24 of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse and debris, boarding/securing, cut tall grass and weeds, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Yannarelly presented photographs ofthe properiy. Ms. Moermond commented on the delinquent property taxes and was surprised it had not gone tax forfeiture yet. She asked about the history of the summary abatement orders which went to work ordex at the property. Mr. Yannarelly responded that according to STAMP, work orders had been issued every month since the vacant building file had been opened in 2008. Ms. Moermond asked for a report from Ms. Boulware. Ms. Boulware stated that this building was built in 1885 and was located outside the potentia] Frogtown historic district. There was a mix of housing styles in the neighborhood and the block face was intact. 5he encouraged rehab of the property. Ms. Moermond noted that Resmae was the mortgage company that was one of the first companies to fail during the mortgage foreclosure crisis. She believed this property likely had fallen through the cracks since foreclosure proceedings had never commenced. Cleariy the city had been managing the property with no owner taking responsibility and it appeazed foreclosure was imminent. She recommended the building be removed within 15 days with no option for repair.
