Facts Regarding this application for appeal:
Egress Windows:
Requirement: windaw sill height of 48"
Current: Window sill Height of 50 to 52"
Maryland Park Apartments was built in 1970. We were the original owner, developer and remain the
current property manager.
We respectfully appeal this corrective notice for the following reasons:
1. Cost prohibitive for ownership (over $100,000) based on current bids.
2. Have added Carbon Monoxide detectors to comply with recent code changes. We are also
retrofitting new high efficiency boilers.
3. Maryland Park is an affordable property with a 142 units of the 170 accepting Section 8 through
the St. Paul Public Housing Authority. If we were required to replace the windows in all of these
units, many families would be required to find other housing during the construction which
would be very difficult for many.
4. State Code is meant to be a"ceiling or a"not to exceed guild line. At the time of construction
Maryland Park met ail equipments.
5. Requiring this action is not compliance with the State Building Code.
6. We have aiready been granted a variance for one of our units (unit 115) for egress and at the
time were underthe impression that it would include all of our windows.

10. Appeal of Stuart Management, Maryland Park Apartments, to a Certificate of Occupancy
Deficiency List for property at 1239 Herbert Street (Rescheduled from May 18)
Mr. Urmann stated that the issue was with window sill height throughout the building as some of
the sill heights in the units were 51 to 58 inches in height and the code required they be no higher
than 48 inches in height. What would be required was the installation of two steps in front of each
window permanently affixed to the wall.
Dave Bedor, Stuart Management, stated that his company had built the building and the sill height
was not an issue in every one of the units. He said they had filed an appeal for unit 115 for egress
windows in July 2009 and he had believed that the grant of the variance covered every unit in the
entire building. He was concemed that installing steps would be a trip hazard and would decrease
the size of the bedrooms.
Ms. Moermond recommended denying the appeal for all units containing a sill height of 51 to 58
inches; the property owner is required to install two steps permanently affixed to the wall in front of
each egress windaw in a11 of those units. Council Public Hearing is scheduled for July 7.
