You aze hereby notified that the following deficiency list must be corrected immediately. A re-insuection wffl be made on Julv 6, 2010 at 1:30 PM. Failure to comply may result in a criminal citation or revocation of the Certificate of Occupancy. The Saint Paul Legislarive Code requires that no building shall be occupied without a Certificate of Occupancy. The code also provides for the assessment of additional re-inspection fees. DEFICIENCY LIST l. Basement - MSFC 605.1 - Remove unapproved exposed wiring and install in accordance with the electrical code.-Properly secure all loose wiring in the basement. 2. Basement - SPLC 3410 (4), 34.33 (3) - Provide a bathroom floor impervious to water.-Also caulk around shower in an approved manner. 3. Basement - MSFC 605.5 - Discontinue use of extension cords used in lieu of permanent wiring.-Clothes dryer must plug directly into an approved receptacle. 4. Basement - SPLC 34.10 (1) - Abate and rnaintain the basement reasonably &ee from dampness and free ofmold and mildew. 5. Basement - SPLC 34.13 (1) - Provide and maintain all habitable areas with a ceiling height of 7 feet over 1/2 the floor azea.-All 3 basement bedrooms do not have at least the minunum ceiling height required. The entire basement floor slopes significanfly towazds the center of the building. Due to the sloping floors, the ceiling height slopes from outside walls in. Appeal of Shirley and Joseph Ferraro to a Certificate of Occupancy Deficiency List for property at 1963 Grand Avenue. Appellants Shirley and Joseph Ferraro (1418 Ardenview Drive, Arden Hills, MN 55112) appeazed. Ms. Shaff said Inspector Beumer had conducted a complaint inspection on June 2, 2010 and reported that the basement floor sloped and the ceiling height ranged from 6' 1'/2" to 6'8" in the southeast bedroom, from 6'2" to 6'7" in the southwest bedroom, and from 6' to 6'S" in the north bedroom. Ms. Moermond asked how many units were in the building. Ms. Ferraro said it was a single-family home. Ms. Ferraro said removing the drop ceiling would add 9'h inches. Ms. Shaff said there were drop ceilings with less cleazance below the joist. Ms. Ferraro asked whether ceiling height was measured to the top or bottom of the joists. Ms. Shaff said it was measured to the bottom of the joist. Ms. Ferrazo said removing the drop ceiling would add less than nine and a half inches in that case. Ms. Ferraro said digging out the floor would be a major cost. The complaint had come from parents of the tenants and was about moisture in the basement. She said Yhey' d had passed other Certificate of Occupancy inspections. Mr. Ferraro said the building had passed inspections since 2001 when they'd purchased it. Ms. Moermond asked how many bedrooms were in the home. Ms. Ferraro said there were five, with three in the basement. Ms. Ferraro said the tallest bedroom was 6'8" in the middle and was probably that height over half the floor area. Mr. Ferraro provided a diagram of the basement Ms. Moermond and Mr. Ferraro reviewed the diagram. Ms. Ferraro said the inspector had seemed more concerned about the slope than about the ceiling height. She said they had offered to try to level the floor but the inspector had said not to do that. Ms. Moermond asked whether the drop ceiling could be adjusted. Mr. Ferraro said it was already aY the bottom of the joists. Ms. Moermond said she could not recommend a vaziance. Ms. Ferrazo asked whether Ms. Moermond had any suggestions for solutions. Ms. Moermond said she did not. She said she would put the matter on the agenda for the July 7 City Council public hearing. Ms. Ferraro asked whether the City Council would have recommendations. Ms Moermond suggested they consult a contractor. She said she would grant 90 days from the date of the Council's decision for bringing the ceiling into compliance or discontinuing the use of the basement rooms for sleeping. Mr. Farraro asked whether a variance might be granted if they were able to increase the ceiling height but not to the fu117 feet. Ms. Moermond said she would be happy to talk with the Ferraros at that point.
