Appeal of Pah Faggett, on behalf of Rock Temple Church of God in Christ, to a Vacant Building Registration Notice for property at 515 Farrinaton Street. Gazfield Clazk, listing agent, appeared on behalf of the trust and trustees of the property. Patricia Faggett, appellant, appeared later in the hearing. Lou Sudheimer appeared with Pastor Sylvester Davis, the potential buyer of the property, Rock of Ages Global Recovery Foundation. Matt Dornfeld and Steve Magner, DSI — V acant Buildings, appeared on behalf of the department. Amy Spong, PED — HPC, appeared on behalf of the HPC. Mr. Dornfeld stated that the C of O was revoked on January 23, 2009 and the Fire inspector had not transfened the file to Vacant Buildings to allow time for work to be done on making the repairs to the building. On November 24, 2009, the file was transferred and a category 2 vacant building file was opened. He noted that a Team inspection had been conducted on December 14, 2009 which listed 39 deficiencies. According to STANIP, no permits had been pulled and he believed no work had commenced on making any of the repairs. Mr. Magner presented a copy of the Team inspection report to Ms. Moermond. Ms. Spong stated that this building had been inventoried in 1983 and was found to be eligible for further study for historic designation both locally and nationally. Mr. Garfield stated that the Stark family owned and operated the church, the trust, with the oldest son acting as the pastor. The trustees also included two of his brothers and two of his sisters. The trustees now desired to sell the church and found a group, Rock of Ages, who had signed a purchase agreement to buy the church He said the buyer has agreed to make all of the repairs as required on the Team inspection report. The trustees, on behalf of the trust, were appealing the category 2 vacant building status as they wanted to proceed with the sale of the property. Ms. Moermond asked how this would affect the sale of the property. Mr. Garfield responded that it was his understanding that a category 2 vacant building status created an extra level of city requirements which would need to be met before the property could be sold. Mr. Magner stated that wldex Chapter 43 of the Code, only the sale of a residential structure required review by DSI — Code Enforcement with conditions needing to be met before the transfer of title could occur. Since this was a commercial building, no review process was required before the property could be sold. What was required was that all of the deficiencies on the Team inspection report would need to be brought up to code and a certificate of occupancy would need to be obtained before the property could be re-occupied. Mr. Sudheimer stated that Pastor Dauis and his congregation had identified this church as being interested in purchasing for the new home of their church. He said Rock of Ages was willing to make all of the repairs as identified on the inspection report; however, he asked whether they could be granted some latitude to conduct Sunday church services while the repairs were being made. Ms. Moermond stated that the building had been vacant for almost 12 months and she would not allow the building to be re-occupied until it was brought up to code and had a certificate of occupancy. Therefore, she recommended denying the appeal.
